Opportunity description

1.The subject matter of the contract is the complete service of removing, transporting and disposing of hazardous waste stored in Sosnowiec at: 1) 9 Bryniczna Street (plot designated in the land register as 4882/2, precinct 9); 2) 59a Mikołajczyka Street (plot designated in the land register as 703/3, precinct 12), hereinafter referred to as the “Waste”. The task consists of the proper and environmentally safe removal, transport and disposal of waste illegally stored on the indicated site. The task must be performed in accordance with the applicable waste management regulations. 2. The description of the subject matter of the contract constitutes Appendix No. 2 to the SWZ, common to both parts of the contract. 3. The use of process D5 will be permissible only if the Contractor demonstrates that disposal of the waste in process D10 is impossible. To confirm the impossibility of applying process D10, the Contractor will be required to present a written statement from a hazardous waste treatment installation confirming that such a possibility does not exist. 4. For parts 1 and 2 of the contract, the Contracting Authority requires a bid bond. 5. Before concluding the contract, the Contractor is required to provide a performance bond amounting to 10% of the total price stated in the tender. CONTRACTORS JOINTLY APPLYING FOR THE AWARD OF A PUBLIC CONTRACT. 1.Contractors may jointly apply for the award of a public contract. In such a case, the Contractors acting jointly are required to appoint an attorney-in-fact to represent them in the procedure or to represent them in the procedure and conclude the contract concerning the public contract in question. All correspondence will be conducted by the Contracting Authority exclusively with the attorney-in-fact. 2. The condition concerning authorization to conduct a specific business or professional activity referred to in Art. 112(2)(2) of the Pzp Act (if formulated) will be met if at least one of the Contractors jointly applying for the award of the contract is authorized to conduct the specific business or professional activity and performs the services for which such authorization is required. 3.With regard to conditions concerning education, professional qualifications or experience, Contractors jointly applying for the award of the contract may rely on the capabilities of those Contractors that will perform the services for which such capabilities are required. 4.In the case referred to in Chapter I, section 4, points 4.2. and 4.3. of the SWZ, Contractors jointly applying for the award of the contract shall attach to the tender, as applicable, a statement indicating which services will be performed by each Contractor. CONTRACTS REFERRED TO IN ART. 214(1)(7) OF THE PZP ACT. The Contracting Authority does not envisage awarding contracts pursuant to Art. 214(1)(7) of the Pzp Act. REQUIREMENTS CONCERNING THE EMPLOYMENT BY THE CONTRACTOR OR SUBCONTRACTOR OF PERSONS ON THE BASIS OF AN EMPLOYMENT RELATIONSHIP. 1.The Contracting Authority requires the Contractor or subcontractor to employ, under an employment contract within the meaning of the provisions of the Act of 26 June 1974, the Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended), employees performing work related to: the transport of hazardous waste and the process of final recovery and disposal of waste at the installation. 2.The method of verifying the employment of the persons referred to in Chapter II, section 5, point 5.1. of the SWZ, the Contracting Authority’s powers to inspect the Contractor’s compliance with the requirements related to the employment of the persons referred to in Chapter II, section 5, point 5.1. of the SWZ, and the penalties for failure to meet these requirements have been described in the draft contractual provisions for parts 1 and 2 of the contract constituting appendices to the SWZ. INFORMATION ON SUBJECT-MATTER EVIDENCE. 1. The Contracting Authority does not require subject-matter evidence to be submitted with the tender. 2. The Contracting Authority provides for the supplementation of subject-matter evidence if, pursuant to Chapter II, section 6, point 6.1. of the SWZ, its submission with the tender is required and the Contractor has not submitted it or the subject-matter evidence submitted is incomplete. SITE VISIT. The Contracting Authority informs Contractors interested in this contract that it is organizing a site visit on separate dates for each part.
