1. The subject matter of the contract is the provision of a service consisting in the collection and management (recovery or disposal) of municipal waste specified in the contract description from properties located within the Municipality of Igołomia-Wawrzeńczyce where residents reside (uninhabited properties, companies, family allotment gardens, institutions, and cemeteries are not covered by the subject matter of the contract), in a manner ensuring the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods, and the reduction of the mass of biodegradable municipal waste sent to landfill, in accordance with the provisions of: the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text, Journal of Laws of 2025, item 733), the Regulation of the Minister of Climate and Environment of 3 August 2021 on the method of calculating levels of preparation for reuse and recycling of municipal waste (Journal of Laws of 2021, item 1530), the Regulation of the Minister of the Environment of 15 December 2017 on levels for reducing the landfilling of biodegradable municipal waste (Journal of Laws of 2017, item 2412), the Act of 14 December 2012 on waste (consolidated text, Journal of Laws of 2026, item 214), and the provisions of the Voivodeship Waste Management Plan, adopted by Resolution No. LXXXI/1191/24 of the Małopolskie Voivodeship Assembly of 25 March 2024 on amending Resolution No. XI/125/03 of the Małopolskie Voivodeship Assembly of 25 August 2003 concerning the Waste Management Plan for the Małopolskie Voivodeship for 2023–2028, as well as in accordance with the currently applicable Regulations for maintaining cleanliness and order within the Municipality of Igołomia-Wawrzeńczyce and the current Resolution of the Igołomia-Wawrzeńczyce Municipal Council on specifying the detailed manner and scope of providing municipal waste collection services, which constitute Appendix No. 1 to the SWZ. 2. The scope of the contract also includes the provision of waste collection equipment: containers and bags, which will be placed by the Contractor at the waste collection locations indicated by the Contracting Authority or provided to property owners. The scope of the contract also includes organizing a Mobile Municipal Separate Waste Collection Point at a location indicated by the Contracting Authority, operating it, and collecting waste from it. 3. A detailed description of the subject matter of the contract, the basic requirements, and data related to contract performance are contained in Appendix No. 10 to the SWZ. 4. Formal requirements related to performance of the subject matter of the contract: 1) The Contracting Authority requires all vehicles used to perform the subject matter of the contract to be equipped with monitoring devices enabling the automatic recording in non-volatile memory of working time, current location, and the distance traveled by the vehicles, together with the actual, unambiguously demonstrated performance of activities (loading waste, unloading waste). The data memory must be retained and readable for a minimum period of 1 year, and reading the data must not erase the contents of the monitoring device’s memory; 2) Throughout the entire period of service performance, the Contractor is required to have an equipment operation monitoring system covering: a) real-time tracking of vehicle positions using the GPS system and communicating with them at any time in order to read the above-mentioned data. The data memory must be retained and readable for a minimum period of 1 year, and reading the data must not erase the contents of the monitoring device’s memory, b) displaying the vehicle’s current position and route traveled on a digital map of the Municipality of Igołomia-Wawrzeńczyce, with accuracy enabling the place (address) where work is performed to be determined unambiguously, c) playback and analysis of the “history” of equipment operation during the contract performance period and settlement thereof on the basis of data read from devices monitoring equipment operation, d) equipping all vehicles used to perform the subject matter of the contract with digital image-recording devices (video recorders) recording travel along all routes, with the possibility of identifying bins and bags placed in front of properties; 3) The Contractor shall provide the Contracting Authority with GPS operation software free of charge. The software must enable the Contracting Authority to determine precisely on a map the vehicle’s position and speed in real time and to replay the history of the route traveled and the place and time of unloading the vehicle. The system must enable continuous monitoring of vehicles with access to archival data (at least 1 year), with the possibility of archiving such data on a computer at the Contracting Authority’s registered office. 4) The software is to function as a map of Poland or of a given region so that a selected road or locality can be found. The system must allow the type of device to be identified in accordance with the equipment list attached to the tender. Operating costs shall be borne by the Contractor. 5) Before commencing performance of the service, the Contractor must train 2 persons designated by the Contracting Authority in the use of the software referred to in points 3) and 4). The training must take place at the Contracting Authority’s registered office. 5. The Contracting Authority: does not permit the submission of tenders for parts, does not permit the submission of variant tenders, does not reserve the possibility of applying for the award of the contract exclusively to contractors referred to in Article 94 of the Pzp Act, does not specify additional requirements related to the employment of persons referred to in Article 96(2)(2) of the Pzp Act, does not envisage concluding a framework agreement, does not envisage selecting the most advantageous tender using an electronic auction, and does not envisage granting advance payments toward performance of the contract. 1.
