The Contracting Authority establishes the following conditions for participation in the procedure, respectively, concerning: Authorisation to conduct specific business or professional activity, where required by separate provisions – this condition for participation in the procedure applies to all tasks (lots) of the subject of the contract 1.2.1 The Contractor holds a valid permit to collect municipal waste from property owners in the municipality for the given task or a valid entry in the register of regulated activities concerning the collection of municipal waste from property owners in the municipality for the given task, in accordance with the requirements of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws 2025, item 733, as amended), covering: 15 01 01 – paper and cardboard packaging, 15 01 02 – plastic packaging, 15 01 04 – metallic packaging, 15 01 06 – Mixed packaging waste, 15 01 07 – glass packaging, 20 01 08 – biodegradable kitchen and canteen waste, 20 02 01 – biodegradable waste, 20 03 01 – unsorted (mixed) municipal waste, 20 03 07 – bulky waste. 1.2.2 The Contractor has a valid entry in the register of entities introducing products, packaged products and managing waste referred to in Art. 49 and 50 of the Act of 14 December 2012 on waste (Journal of Laws of 2023, item 1587, as amended) concerning the transport of waste: 15 01 01 – paper and cardboard packaging, 15 01 02 – plastic packaging, 15 01 04 – metallic packaging, 15 01 06 – Mixed packaging waste, 15 01 07 – glass packaging, 20 01 08 – biodegradable kitchen and canteen waste, 20 02 01 – biodegradable waste, 20 03 01 – unsorted (mixed) municipal waste, 20 03 07 – bulky waste. Technical or professional capacity – this condition for participation in the procedure applies to all tasks (lots) of the subject of the contract 1.4.1 The Contractor has a storage and transport base as referred to in the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122, as amended) and has equipment enabling the collection of municipal waste in at least the following quantities: 1.4.1.1 If the Contractor submits a tender for a maximum of three tasks (lots), it must have at its disposal: a) 1 specialised vehicle weighing over 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, b) 1 specialised vehicle weighing up to 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, c) 1 vehicle weighing up to 7 tonnes for collecting selectively collected municipal waste. 1.4.1.2 If the Contractor submits a tender for more than three tasks (lots), it must have at its disposal: a) 2 specialised vehicles weighing over 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, b) 1 specialised vehicle weighing up to 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, c) 1 vehicle weighing up to 7 tonnes for collecting selectively collected municipal waste. The Contracting Authority may cancel the procurement procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it in accordance with Art. 257 of the Act. If the price of the most advantageous tender exceeds the amount that the Contracting Authority intended to allocate for performance, the Contracting Authority will decide whether it will conclude a contract up to the amount of the funds available, increase the funds allocated for performance, or cancel the procedure.
