The subject of the contract is the collection, transport and management of municipal waste from facilities administered by the municipal and district units of the Silesian garrison. The Contracting Authority establishes the following conditions for participation in the procedure, respectively with regard to: Authorisations to conduct a specific business or professional activity, insofar as this results from separate provisions – this condition for participation in the procedure applies to all tasks (parts) of the subject of the contract 1.2.1 The Contractor holds a valid permit for collecting municipal waste from property owners in the municipality for the given task or a valid entry in the register of regulated activities concerning the collection of municipal waste from property owners in the municipality for the given task, in accordance with the requirements of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws 2025, item 733, as amended) with regard to: 15 01 01 – paper and cardboard packaging, 15 01 02 – plastic packaging, 15 01 04 – metallic packaging, 15 01 06 – mixed packaging waste, 15 01 07 – glass packaging, 20 01 08 – biodegradable kitchen and canteen waste, 20 02 01 – biodegradable waste, 20 03 01 – unsorted (mixed) municipal waste, 20 03 07 – bulky waste. 1.2.2 The Contractor holds a valid entry in the register of entities placing products and packaged products on the market and managing waste, referred to in Articles 49 and 50 of the Act of 14 December 2012 on waste (Journal of Laws of 2023, item 1587, as amended), with regard to waste transport: 15 01 01 – paper and cardboard packaging, 15 01 02 – plastic packaging, 15 01 04 – metallic packaging, 15 01 06 – mixed packaging waste, 15 01 07 – glass packaging, 20 01 08 – biodegradable kitchen and canteen waste, 20 02 01 – biodegradable waste, 20 03 01 – unsorted (mixed) municipal waste, 20 03 07 – bulky waste. Technical or professional capacity – this condition for participation in the procedure applies to all tasks (parts) of the subject of the contract 1.4.1 The Contractor has a storage and transport base as referred to in the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements concerning the collection of municipal waste from property owners (Journal of Laws of 2013, item 122, as amended) and has equipment enabling the collection of municipal waste in at least the following quantity: 1.4.1.1 If the Contractor submits a tender for no more than three tasks (parts), it must have at its disposal: a) 1 specialised vehicle weighing over 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, b) 1 specialised vehicle weighing up to 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, c) 1 vehicle weighing up to 7 tonnes for collecting selectively collected municipal waste. 1.4.1.2 If the Contractor submits a tender for more than three tasks (parts), it must have at its disposal: a) 2 specialised vehicles weighing over 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, b) 1 specialised vehicle weighing up to 7 tonnes, adapted for collecting both mixed municipal waste and biowaste, c) 1 vehicle weighing up to 7 tonnes for collecting selectively collected municipal waste. The Contracting Authority may cancel the contract award procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it in accordance with Article 257 of the Act. If the price of the most advantageous tender exceeds the amount that the Contracting Authority intended to allocate for performance, the Contracting Authority will decide whether it will conclude a contract up to the amount of the funds held, increase the funds allocated for performance, or cancel the procedure.
