The subject matter of the contract is the provision of servicing services for diagnostic devices manufactured by OLYMPUS held by the Dr Alfred Sokołowski Specialist Hospital in Wałbrzych for a period of 36 months. A further and detailed description of the subject matter of the contract (volume, scope, type and quantity of supplies), together with the assortment and price form, is provided in Annex No 1 to the Specification of Contract Terms. The work performed under the contract consists in maintaining the diagnostic devices in full technical and operational working order and includes: • repairs will be carried out depending on the needs of the contracting authority • periodic and preventive inspections specified by the manufacturer include: • diagnostics and repairs, including replacement of damaged parts, • replacement devices for the duration of repairs, • emergency visits, • technical assistance and remote servicing, • updates, • audits • travel • software and design modifications recommended by the manufacturer, improving work efficiency and safety 1. The Contractor declares that, within the above-mentioned scope of the contract description, it has appropriately qualified personnel at its disposal. The scope of work depends on the requirements of the medical device manufacturer. Certificate of authorization compliant with the manufacturer’s declaration. Parts used for repairs must be brand new and approved for use by the device manufacturer. 2. The Contractor shall provide servicing services for medical apparatus and equipment and shall employ personnel possessing the qualifications and professional experience specified by the manufacturers (importers, distributors), in accordance with the Act of 7 April 2022 on medical devices, documented by a certificate. 3. The provision of services must be carried out in accordance with the manufacturer’s requirements specified in the instructions for use, applicable standards, instructions and relevant regulations, in compliance with occupational health and safety and fire protection regulations, in particular in accordance with the Act of 7 April 2022 on medical devices. 4. The Contractor, jointly with the Contracting Authority’s Representative, is obliged to maintain documentation at the Contracting Authority’s premises specifying the dates of subsequent inspections, maintenance and servicing activities arising from the instructions for use and the manufacturer’s recommendations (scheduled replacement of parts, inspection kits). 5. Completion of the technical inspection must be confirmed by an appropriate entry in the technical passport, together with the Contractor’s legible signature, and by issuing a service report (work sheet) with a full description of the work. 6. The Contracting Authority provides for an obligation arising from Article 95 of the Public Procurement Law in the form of employing, under an employment contract as part of the performance of the Contract, a person carrying out activities within the scope of performance of the subject matter of the contract.
