Opportunity description

1) The subject matter of the contract is maintenance services for Technical Security Systems (SOT) and Fire Alarm Systems (SSP) at PSE S.A. facilities. 2) A detailed specification of the subject matter of the contract is provided in Part II of the SWZ – Description of the subject matter of the contract and Part IV of the SWZ – Draft contractual provisions. 3) The subject matter of the contract has been divided into 5 parts, hereinafter referred to as Packages. Details concerning the Packages are provided in Part II of the SWZ. 4) Pursuant to Article 101(4) of the Act, the Contracting Authority permits solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and Article 101(3) of the Act, provided that they make it possible to obtain characteristics or parameters no worse than those referenced. Pursuant to Article 101(5) of the Act, a Contractor relying on solutions equivalent to those described by the Contracting Authority is required to prove in its tender that the proposed solutions meet, to an equivalent degree, the requirements specified in the description of the subject matter of the contract. 5) The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to Subcontractors and to provide the names of the Subcontractors, if already known. 6) Name and code of the Common Procurement Vocabulary: CPV code: 50610000-4 - Repair and maintenance services of security equipment. 7) The Contracting Authority does not require subject-specific means of evidence to be submitted with the tender. 8) Acting pursuant to Article 133(3) of the Act, the Contracting Authority establishes requirements concerning the confidentiality of information provided to Contractors during the procedure. The following parts of the SWZ are confidential: a. Appendices Nos. 1-5 to Part II of the SWZ – Description of the subject matter of the contract, i.e. List of equipment. 9) A Contractor wishing to receive the password for decrypting the above-mentioned documents must submit declarations with the wording specified in templates Nos. 12.1 and 12.2 of Part III of the SWZ. The declarations must be submitted by persons authorized to represent the Contractor (such authorization must arise from registration documents or a power of attorney available to the Contracting Authority in this procedure) and by persons who will participate in the procedure. If the persons submitting these declarations do not have qualified electronic signatures, the Contracting Authority permits the declarations to be signed by hand by the persons making them, scanned, certified as true copies of the originals by persons authorized to make declarations of intent and knowledge on behalf of the Contractor, and transmitted in this form to the Contracting Authority through the Procurement Platform. The Contracting Authority advises that letters containing answers to questions (if any are submitted during the procedure) will also be published in encrypted form—the above-mentioned password must be used to decrypt them (this password will be used throughout the entire procedure). The declaration must be submitted through the Procurement Platform, under the “Questions/information” tab. After they have been received and verified, the password for decrypting the documents will be sent to the email address specified in the information concerning the provision of the password for decrypting the documents. 10) To obtain access to the confidential part of the OPZ, the Contractor shall submit through the Procurement Platform a request for access to the confidential part of the OPZ together with a properly prepared confidentiality declaration. The confidential part of the OPZ will be provided to the Contractor through the Procurement Platform after a proper confidentiality declaration has been submitted. The Contractor is obliged to maintain the confidentiality of the information provided and use it solely for the purpose of preparing a tender in this procedure. The Contracting Authority recommends submitting the request for access to the confidential part of the OPZ together with the confidentiality declaration sufficiently in advance to allow the Contracting Authority to verify the declaration and provide the confidential part of the OPZ, and the Contractor to familiarize itself with its contents and properly prepare its tender. Submission of the request at a time that makes it impossible to realistically familiarize oneself with the confidential part of the OPZ before the tender submission deadline does not in itself constitute grounds for requesting an extension of the tender submission deadline. “The Contracting Authority requires that the subject matter of the contract, including all ICT products, ICT services and ICT processes, within the meaning of Article 2 points 11k, 11l and 11m of the Act of 5 July 2018 on the national cybersecurity system, used to perform the contract—both as main elements and as components, elements of the contract performance environment or accompanying solutions—must not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation of the Government Plenipotentiary for Cybersecurity referred to in Article 33(4) and (4a) of the Act of 5 July 2018 on the national cybersecurity system, finding that they have a negative impact on the fundamental national security interest; 2) ICT products, ICT services or ICT processes whose type has been specified in a decision of the minister responsible for computerization concerning the designation of a supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system. Failure to meet the above requirement will result in rejection of the tender, in the case of public contracts pursuant to Article 226(1)(17) or (19) of the Act of 11 September 2019 – Public Procurement Law. The Contracting Authority reserves the right to verify compliance with the above requirement at every stage of the procedure. Package No. 1 – maintenance services for SOT and SSP at electrical substations in ZKO in Warsaw: Contract performance period: 36 months from the date of conclusion of the contract, but no earlier than: - from 14.12.2026 (Package I – ZKO Warsaw), provided that the contract shall terminate before the expiry of this period if the maximum remuneration provided for in the contract is exhausted earlier. Package No. 2 – maintenance services for SOT and SSP at electrical substations in ZKO in Radom: Contract performance period: 36 months from the date of conclusion of the contract, but no earlier than: - from 07.12.2026 (Package II – ZKO Radom), provided that the contract shall terminate before the expiry of this period if the maximum remuneration provided for in the contract is exhausted earlier. Package No. 3 – maintenance services for SOT and SSP at electrical substations in ZKO in Katowice: Contract performance period: 36 months from the date of conclusion of the contract, but no earlier than: - from 05.12.2026 (Package III – ZKO Katowice), provided that the contract shall terminate before the expiry of this period if the maximum remuneration provided for in the contract is exhausted earlier. Package No. 4 – maintenance services for SOT and SSP at electrical substations in ZKO in Poznań: Contract performance period: 36 months from the date of conclusion of the contract, but no earlier than: - from 04.12.2026 (Package IV – ZKO Poznań), provided that the contract shall terminate before the expiry of this period if the maximum remuneration provided for in the contract is exhausted earlier. Package No. 5 – maintenance services for SOT and SSP at electrical substations in ZKO in Bydgoszcz: Contract performance period: 36 months from the date of conclusion of the contract, but no earlier than: - from 14.12.2026 (Package V – ZKO Bydgoszcz), provided that the contract shall terminate before the expiry of this period if the maximum remuneration provided for in the contract is exhausted earlier.
