Poland – Repair, maintenance and associated services related to aircraft and other equipment – OVERHAUL (MAJOR REPAIR) SERVICE FOR TECHNICAL MATERIAL ASSETS FOR AIRCRAFT IN 2026

Opportunity description

1. The subject of the contract is an overhaul (major repair) service for technical material assets for aircraft in 2026, in the assortment and quantities specified in the Price Form constituting Annex No. 1 to the SWZ. 2. The service shall be performed in accordance with the technical documentation of the manufacturer (Contractor) and shall guarantee the full serviceability of the technical material assets subjected to the service. 3. If technical activities within the scope of performance of the contract (including, among others, assembly and disassembly of equipment, carrying out equipment inspections, transporting equipment and its components, and carrying out equipment repairs) consist in performing work in the manner specified in Art. 22 of the Act of 26 June 1974, the Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended), the persons performing the activities in question shall be employed by the Contractor under an employment contract. 4. Equipment intended for performance of the service shall have a remaining technical service life and shall be handed over together with documentation on the basis of which its basic parameters can be determined. Service lives are determined on the basis of Polish normative documents (technical bulletins, etc.). In the event of discrepancies between the technical documentation of the manufacturer or an authorised overhaul facility and the documents determining the service life referred to above, the Contractor shall, when performing the subject of the contract, be bound by the standards arising from Polish normative documents. 5. If the Contracting Authority sends for overhaul (major repair) technical material assets whose remaining technical service life does not allow the facility performing the service to assign the full service life between overhauls, the Contractor shall assign a service life between overhauls within the remaining technical service life. 6. If it is not possible to overhaul (perform a major repair of) the equipment handed over, the Contracting Authority provides for the possibility of supplying (within the value of the service being performed) equipment of the same type from the Contractor's warehouse stock:  new, manufactured in the year in which the service is performed or manufactured earlier in the case of products that do not have a calendar service life;  after overhaul (major repair), with the full remaining service life between overhauls, provided that the remaining technical service life may not be less than that of the unit sent for overhaul (major repair). If the above circumstances occur, the Contractor is required to obtain the Contracting Authority's written consent in this regard. 7. If new equipment is supplied in accordance with paragraph 6, first indent, the Contractor shall supply with the products an OiB declaration of conformity issued in accordance with the Act of 17 November 2006 on the conformity assessment system for products intended for the needs of national defence and security (consolidated text: Journal of Laws of 2022, item 747) and as specified in the Regulation of the Minister of National Defence of 11 January 2013 on the detailed list of products subject to conformity assessment and the method and procedure for conducting conformity assessment of products intended for the needs of national defence (consolidated text: Journal of Laws of 2021, item 1628) – i.e. under conformity assessment mode I. 8. Following the overhaul (major repair) of the equipment, the Contractor shall assign a service life between overhauls in accordance with the rules set out in the technical documentation of the manufacturer or overhaul facility. The list of documentation, i.e. (name, number, identifier, etc.), is contained in Annex No. 4 to the draft contractual provisions. 9. The products shall be preserved for a period of not less than 2 years and in accordance with the rules specified in defence standard NO-16-A800:2007, and placed in packaging protecting the subject of the contract against loss of usability during transport/storage over the warranty period. The use of protection methods other than those in defence standard NO-16-A800:2007 is permitted, provided that they ensure equivalent or better protection. 10. The subject of the contract shall be subject to a quality assurance process in accordance with the rules specified in the draft contractual provisions constituting Annex No. 2 to the SWZ. 11. The requirements contained in AQAP 2110 ed. D version 1 apply to this contract for items 4, 10÷12, 29, 39, 41 of Annex No. 1 to the draft contractual provisions constituting Annex No. 2 to the SWZ, and the requirements contained in AQAP 2131 ed. C version 1 apply to items 1÷3, 5÷9, 13÷28, 30÷38, 40, 42÷43 of the annex to the draft contractual provisions constituting Annex No. 2 to the SWZ. 12. The Contractor's quality management system shall meet the requirements contained in PN-EN ISO 9001:2015. 13. The Contractor shall provide a warranty for failure-free operation of the equipment following performance of the service for a period of 24 months/200 operating hours (whichever expires first), calculated from the date of acceptance of the product. 14. In accordance with Art. 455 of the Pzp Act, the Contracting Authority permits the possibility of amending the contract without conducting a new contract award procedure in the cases and under the conditions specified in § 18 of the draft contractual provisions constituting Annex No. 2 to the SWZ. 15. The detailed conditions for performance of the contract are specified in the draft contractual provisions. 16. The Contracting Authority reserves the possibility of exercising the option. Under the option, the Contracting Authority may additionally commission an overhaul (major repair) service for technical material assets in the assortment and maximum quantities specified in the Price Form constituting Annex No. 1 to the SWZ. The optional contract shall be performed at the same gross unit prices as in the tender. 17. Pursuant to Art. 257 of the Pzp Act, the Contracting Authority provides for the possibility of cancelling the contract award procedure if the public funds that the Contracting Authority intends to allocate to financing the contract are not awarded to it. 18. The award of the contract does not involve providing the Contractor with classified information, access to which requires compliance with the provisions of the Act of 5 August 2010 on the protection of classified information (consolidated text: Journal of Laws of 2024, item 632, as amended). 20. The Contracting Authority divided the subject of the contract into 43 lots.
