Opportunity description

1. The subject of the procurement is the repair of tram parts and components specified in Appendix No. 3 to the SWZ, divided into: 1) Group I – Brake calipers for trams: Tatra (RT6 MF06 AC), Moderus Gamma, 2) Group II - Replacement of wheel tyres - Solaris Tramino S105p, 3) Group III - Brake calipers for the Siemens NGT6D tram, 4) Group IV - Brake calipers for the Siemens Combino tram. 2. Under the option right, the Contracting Authority reserves the possibility of extending the subject of the procure-ment for a period not exceeding 6 months from the expiry date specified in Chapter IV of the SWZ, in accordance with § 6 para. 2 and 3 and § 10 of Appendix No. 6 to the SWZ (Ppu template), up to 30% of the basic procurement. 3. The technical conditions for the performance and acceptance of components and elements subject to repair are specified in Appendix No. 5 to the SWZ. 4. On the basis of Appendices to the SWZ No. 3 (Price Form) and No. 5 (Technical conditions for the performance and acceptance of components and elements subject to repair) – appendices to the contract will be prepared. 5. The Contracting Authority permits the submission of partial tenders for individual comprehensive groups. 6. The Contracting Authority does not permit the submission of partial tenders within a given group. 7. The Contracting Authority does not permit the submission of variant tenders. 8. The Contracting Authority does not envisage concluding a framework agreement or conducting an electronic auction. 9. The Contracting Authority permits the performance of the subject of the procurement to be entrusted to subcontractors. In such a case, the Contractor shall indicate, in Appendix No. 2 to the SWZ (Tender Form), the parts of the procurement that it intends to entrust to subcontractors and shall provide the names of the subcontractors, if already known. The Contractor shall be liable for the acts or omissions of subcontractors as for its own. 10. In this procedure, the Contracting Authority does not require the submission of subject-matter evidence. 11. In the public procurement award procedure, the Contracting Authority exercises the right to restrict access to the procurement for Contractors from third countries with which the European Union is not bound by any international agreement guaranteeing access to the public procurement market on the basis of reciprocity and equality. This restriction consists of excluding them from participation in the procedure. 12. The Contracting Authority does not permit participation in the procedure by Contractors (or Contractors jointly applying for the procurement, at least one of whom is) with their registered office (respectively: place of residence) in countries other than a Member State of the European Union, a state of the European Economic Area, a state party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization, or a state party to an agreement concluded with the European Union governing reciprocal access to public procurement. 13. The Contracting Authority does not permit Contractors (or Contractors jointly applying for the procurement, at least one of whom is) with their registered office (respectively: place of residence) in a Member State of the European Union, a state of the European Economic Area, a state party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization, or a state party to an agreement concluded with the European Union governing reciprocal access to public procurement, to rely, under the rules described in Article 118 of the Pzp Act, on the technical and professional capacities or the financial or economic standing of entities with their registered office (respectively: place of residence) in countries other than a Member State of the European Union, a state of the European Economic Area, a state party to the Agreement on Government Procurement (GPA) concluded within the framework of the World Trade Organization, or a state party to an agreement concluded with the European Union governing reciprocal access to public procurement. 14. Upon receiving a tender from a Contractor from outside the EU, the Contracting Authority shall verify whether the tender is covered by agreements concluded by the EU concerning the award of public contracts in an international context, such as the GPA or free trade agreements, in order to determine whether the Contractor has obtained access to this procurement. 15. Pursuant to Article 226 para. 1 point 5 of the Pzp Act, the Contracting Authority shall reject, as non-compliant with the procurement conditions, a tender submitted by a Contractor from a third country that has not concluded the Agreement on Government Procurement (GPA) or a bilateral free trade agreement between the EU and that country guaranteeing access to the public procurement market on the basis of reciprocity and equality. 16. The Contracting Authority may cancel the procurement award procedure, as applicable, before the deadline for submitting tenders if circumstances have arisen that make the continuation of the procedure unjustified, in accordance with Article 256 of the Pzp Act.
