Opportunity description

1. The Contracting Authority will apply the procedure referred to in Article 139(1) of the Public Procurement Law (i.e. the so-called reverse procedure). In the procedure, pursuant to Article 139(1) of the Public Procurement Law, the Contracting Authority will first examine and evaluate the tenders submitted and will then carry out the qualitative selection of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion referred to in Chapter VI of the SWZ and fulfilment of the conditions for participation in the procedure described in Chapter VII of the SWZ. 2. The Contractor is required to submit, together with the Tender, declarations of non-exclusion and fulfilment of the conditions for participation in the procedure in the form of the European Single Procurement Document (JEDZ). 3. The Contractor may use a JEDZ submitted in a separate procurement procedure if it confirms that the information contained therein remains correct. 4. Where Contractors jointly apply for the contract, each Contractor shall submit a JEDZ. These declarations confirm the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure to the extent that each Contractor demonstrates fulfilment of the conditions for participation in the procedure. 5. If the Contractor relies on the resources of other entities in order to demonstrate fulfilment of the conditions for participation and to demonstrate the absence of grounds for exclusion from the procedure, it shall submit a JEDZ concerning those entities to the extent that it relies on their resources; the JEDZ should be completed to the extent that the Contractor uses the resources of another entity, and the Contractor shall submit declarations and documents concerning the grounds for exclusion. 6. With regard to “Part IV Selection criteria” of the JEDZ, the Contractor may limit itself to completing section alpha, General statement concerning all selection criteria, in which case the Contractor shall not complete any of the remaining sections (A-D) in Part IV of the JEDZ. 7. In order to confirm the absence of grounds for excluding the Contractor from participation in the procedure and to confirm fulfilment of the conditions for participation in the procedure, the Contracting Authority will, within a specified period of no less than 10 days from the date of the request, call upon the Contractor whose tender received the highest evaluation to submit entity-specific evidence current as at the date of submission. Details are provided in the SWZ. 8. A Contractor in respect of whom the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine apply shall also be excluded from the procurement procedure. 9. At the request of the Contracting Authority, the Contractor is required to submit the entity-specific evidence referred to in §2(1), points 1)-2) and points 6)-7), of the Regulation of the MRPiT of 23.12.2020 on entity-specific evidence and other documents or declarations that a contracting authority may require from a contractor with regard to the grounds for exclusion from the procedure indicated by the Contracting Authority in this notice. 10. If the Contractor has its registered office or place of residence outside the Republic of Poland, it is required to submit the entity-specific evidence referred to in §4 of the regulation referred to in point 9 above. 11. If the Contractor relies on the capacities or situation of entities making resources available, it is required to submit entity-specific evidence concerning those entities in accordance with §5 of the regulation referred to in point 7 above. 12. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1), point 7), of the Public Procurement Law. 13. The Contracting Authority provides for the possibility of cancelling the procurement procedure pursuant to Article 257 of the Public Procurement Law. 14. For this contract, the Contracting Authority did not conduct preliminary market consultations before launching the procedure. The subject matter of the contract is an inventory of selected groups of aquatic and semi-aquatic invertebrate organisms inhabiting the peatlands of Karkonosze National Park and an attempt to assess the impact of global warming on the diversity, distribution and status of their populations. The subject matter of the contract consists of the following activities: 1) Field sampling 2) Laboratory analysis of the collected samples 3) Analysis of the results obtained 4) Preparation of the final report and annual reports.
