1. The subject of the contract is the supply of a slit-lamp simulator (anterior and posterior segment with gonioscopy) – 1 unit. 2. Brief description: An advanced training workstation integrating a simulation computer, slit lamp, head phantom and a complete educational environment for learning examinations of the anterior and posterior segments of the eye, fundoscopy and gonioscopy. Equipped with an SLT laser training module – selective laser trabeculoplasty. The device is intended for intensive use in training centers, clinics, medical universities and simulation centers. A detailed description of the subject of the contract is contained in Appendix No. 3 to the SWZ – OPZ. 3. CPV code: 38970000-5 4. The detailed scope of performance of the subject of the contract, constituting the draft provisions of the public procurement contract, is contained in the contract template constituting Appendix No. 2 to the SWZ. 5. The required deadline for performance of the subject of the contract is: up to 3 weeks from the date of conclusion/signing of the contract. 6. Pursuant to Art. 257 of the uPzp, the Contracting Authority provides for the possibility of cancelling the proceedings in question if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. 7. The Contracting Authority provides for the application of the so-called reverse procedure referred to in Art. 139(1) of the uPzp, i.e. the Contracting Authority will first examine and evaluate the tenders and then perform the qualitative selection of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings. 9. The Contractor is bound by the tender from the deadline for submission of tenders until 05.12.2026 (90 days). 10. The tender must consist of: 10.1. the Contractor's tender form – an interactive form available on the e-Zamówienia Platform; 10.2. the declaration referred to in Chapter VII point 1 of the SWZ - JEDZ - an interactive form available on the e-Zamówienia Platform; The Contractor is required to attach to the Tender a declaration current as at the tender submission date that it is not subject to exclusion and fulfills the conditions for participation in the proceedings. The Contractor shall submit the declaration in question in the form of the European Single Procurement Document, hereinafter referred to as JEDZ, constituting Appendix No. 2 to Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the European Single Procurement Document. The information contained in the JEDZ constitutes preliminary confirmation that the Contractor is not subject to exclusion and fulfills the conditions for participation in the proceedings. 10.3. the declaration referred to in Chapter VII point 1a of the SWZ - (as applicable) Declaration, Appendix No. 5 to the SWZ; 10.4. (if applicable) the commitment of the entity making resources available, referred to in Chapter VII point 6 of the SWZ; 10.5. (if applicable) indication that information constituting a trade secret is reserved in accordance with Chapter X point 6; 10.6. the document(s) establishing the right to sign the Tender in accordance with Chapter X point 15 of the SWZ; (if applicable) relevant powers of attorney in accordance with Chapter X point 16 of the SWZ; 10.7. (if applicable) Declaration of contractors jointly applying for the contract - in accordance with Art. 117(4) of the uPzp. 10.8. SUBJECT-MATTER EVIDENCE confirming that the supplies offered by the Contractor meet the requirements and characteristics specified by the Contracting Authority: a description of the offered subject of the contract - the technical specification of the offered subject of the contract together with any Information for Contractors – allowing verification of the compliance of the offered device/set with the Contracting Authority's requirements presented, as applicable, in Appendix No. 3 to the SWZ – completed Appendix No. 2 to the SWZ. The Contracting Authority considers the parameters indicated by the Contractor in Appendix 3 to the SWZ OPZ, column Offered parameters, to constitute subject-matter evidence – confirmation of fulfillment of the requirements through the parameters offered by the Contractor. Pursuant to Art. 107 of the uPzp, if the Contractor has not submitted the subject-matter evidence or the submitted subject-matter evidence is incomplete, the Contracting Authority will request its submission or supplementation within a specified deadline (current as at the date of its submission). 1. The delivered subject of the contract must be brand-new, complete and technically operational. The term “brand-new” shall mean a subject of the contract that has not been used prior to the delivery date, excluding use necessary to test its correct operation after manufacture. The subject of the contract must be free from physical and legal defects and third-party claims. 5. The detailed scope of performance of the subject of the contract, constituting the draft provisions of the public procurement contract, is contained in the contract template constituting Appendix No. 2 to the SWZ. 6. The required deadline for performance of the subject of the contract is: up to 3 weeks from the date of conclusion/signing of the contract. 7. The Contracting Authority does not provide for an option right. A. INFORMATION ON ELECTRONIC MEANS OF COMMUNICATION that the Contracting Authority will use to communicate with Contractors, and information on the technical and organizational requirements for preparing, sending and receiving electronic correspondence - Chapter X of the SWZ. The Contracting Authority stipulates that the Tender may be submitted exclusively via the e-Zamówienia platform. B. Type and scope of amendments to the contract and the conditions for introducing them: 1. As a separate Appendix No. 2 to the SWZ, the Contracting Authority has provided a contract template specifying the contractual conditions for performance of the public contract in question. 2. The Contracting Authority provides for the possibility of amending the concluded contract in relation to the content of the selected tender within the scope regulated by Arts. 454-455 of the uPzp, as specified in the Contract Template and in the SWZ. 8.
