2. The contract shall be performed in accordance with the Description of the Subject Matter of the Contract, the Detailed Technical Specifications, the model contract and the SWZ. 3. For all elements, the Contractor shall supply together with the delivery and hand over to the person exercising Supervision (on behalf of the Contracting Authority): a) Product warranty, b) Technical approval or national technical assessment issued by an authorized body, together with the declaration of performance. The handing over of the above-mentioned documents to the person responsible for performance of the contract on behalf of the Contracting Authority shall constitute the basis for accepting the invoice issued by the Contractor. 4. Before commencing the works, the Contractor shall present the elements intended for incorporation to the person exercising supervision for approval. 5. The Contracting Authority shall accept the completed deliveries, including installation, within 14 days from the date on which the Contractor reports completion of the contract. 6. The acceptance protocol signed by both parties shall constitute the basis for the Contractor to issue a VAT invoice. 7. The Contractor shall clean the road right-of-way on an ongoing basis. 8. The Contractor shall provide the signage and safeguards for the works while they are being carried out at its own expense. 9. The Contractor shall provide all necessary materials, means of transport and persons necessary to perform the contract. 10. The Contracting Authority reserves the right, without the need to amend the contract, to which the Contractor agrees, to change or reduce the number of units of individual ranges of materials compared with those specified in the price form. The Contractor shall receive remuneration for the quantities of services actually performed. 11. Settlement shall be based on unit prices (specified in tender cost estimates A1, A2 and A3 constituting an attachment to the tender offer) for the individual quantities. The unit price should include preparatory work, works signage, embedding, positioning and assembly, transport, loading and unloading, as well as cleaning work. 12. The Contractor shall be obliged to ensure safe conditions for road and pedestrian traffic in the area of the services covered by the contract, on the basis of the temporary traffic management design (for the duration of the services) supplied by the Contracting Authority in accordance with the applicable regulations and approved by the traffic authority for provincial roads. 13. The Contractor shall provide the signage and safeguards for the works while they are being carried out at its own expense. 14. A delay in handing over the road right-of-way for reasons attributable to the Contractor may not constitute grounds for changing the deadline for performance of the contract. 15. Pursuant to Article 91(1) of the PZP Act, the contract has been divided into three Tasks. The Contracting Authority permits the submission of partial tenders for individual tasks while retaining the full scope of services. The Contractor may submit a tender for the performance of one or more tasks specified in point IV, subpoint 1 of the SWZ. Tender validity period 1. The Contractor shall be bound by the tender until 08.12.2026. 18. The procedure may be cancelled as a result of funds not being awarded to finance the contract. Pursuant to Article 257 of the Pzp Act, the Contracting Authority may cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it, and the possibility of cancelling the procedure on this basis was provided for in the contract notice. Contract performance deadline: 60 days from the date of signing the contract Task No. 1 – Supply of signs, signage elements and road traffic safety devices, including installation, along provincial road No. 849 from km 2+937 to km 51+500 in accordance with the bill of quantities and Permanent Traffic Management Design registration No. 4063.28.2025 dated 04.03.2025. 1. The scope of the contract includes: 1) Installation of new signage. Installation of signs together with posts, in accordance with the bill of quantities and the permanent traffic management design. 2) Relocation of existing signage. Relocation of signs together with posts, in accordance with the bill of quantities and the permanent traffic management design. 3) Removal of existing signage. The existing signage shall be removed and transported to a landfill selected by the Contractor for subsequent disposal in accordance with the Waste Act of 14 December 2012 (Journal of Laws 2023, item 1587); Removal of signs, signs with posts and posts, in accordance with the bill of quantities and the permanent traffic management design. 4) Supply and installation of U-1a and U1b posts a) manufacture of U-1a posts in accordance with the requirements of the SST (D 07.02.02 Guide posts and kilometre and hectometre signs) – whereby these should be: - guide posts made of plastics such as polyethylene (PE), polyvinyl chloride (PVC), made as a uniform monolith for all roads; b) affixing U-7 and U-8 signs (hectometre posts) or U-7, U-8 and U-1f signs (kilometre posts) to the appropriate number of posts; c) transport of the above-mentioned elements to the installation site (in accordance with the copies of the Traffic Management Design sheets supplied by the Contracting Authority) – using the Contractor’s own transport; d) removal of the old U-1a posts currently existing on site on the section from km 15+500 to km 34+100 and on the section from km 38+000 to km 58+500 (on both sides – comprehensive replacement); e) U-1a posts removed from the road shall be transported to a landfill selected by the Contractor and adapted for the storage of plastic elements, for their subsequent disposal in accordance with the Waste Act of 14 December 2012 (Journal of Laws 2023, item 1587); f) installation of new posts (on shoulders or lawns), following prior measurements in accordance with the attachment: List of U-1a posts to be installed in 2026 along provincial road No. 849 in the area of the Provincial Roads District in Zamość; g) taking measurements and verifying the correct installation of the U-1a posts against the relevant Traffic Management Design sheets, and cleaning up the works site. Charging takes place from renewable energy sources using a photovoltaic module and wind generator, mounted on a hot-dip galvanized support structure adapted to bear loads under the solar-wind system.
