The subject of the contract is the task entitled: “Transport of pupils (including those with disabilities) to schools and educational institutions in the 2026/2027 school year” (divided into 8 lots), including: a) Lot No. 1: “Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the centre in Dąbrowa Górnicza”. b) Lot No. 2: “Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to schools and institutions in Katowice”. c) Lot No. 3: “Provision of transport and care during the transport of children and pupils with disabilities from the city of Mysłowice to schools and institutions in Mysłowice”. d) Lot No. 4: “Provision of transport and care during the transport of pupils (including those with disabilities) from the city of Mysłowice to the school in Mysłowice (Ławki)”. e) Lot No. 5: “Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the centre in Katowice (Giszowiec)”. f) Lot No. 6: “Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the school in Katowice (Nikiszowiec)”. g) Lot No. 7: “Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the school in Sosnowiec and the centre in Jaworzno”. h) Lot No. 8: “Provision of transport and care during the transport of children and pupils (including those with disabilities) from the city of Mysłowice to School and Preschool Complex No. 3 in Mysłowice”. The scope of the service will include: a) Collection of children and pupils at the time and place agreed by the Contractor with the parents/legal guardians and the Contracting Authority. b) Transport to schools and institutions in accordance with Appendix No. 2 to the SWZ. c) Collection of children and pupils at times agreed by the Contractor with the schools, centres and educational institutions. d) Transport of children and pupils to their homes in accordance with Appendix No. 2 to the SWZ. Tasks and duties of the carrier (driver): a) Ensuring the safe boarding, transport and exiting of children and pupils from the vehicle. b) Exercising particular caution during the transport of children and pupils by adapting speed to road conditions, in accordance with road traffic regulations. c) Providing replacement transport in the event of a vehicle breakdown. d) Taking care of the technical condition of the vehicle, performing daily servicing, and maintaining the cleanliness and appearance of the vehicle. e) Having a legible identification badge bearing their first name and surname, attached in a visible place. f) Cooperating with the caregiver and mutually notifying one another of any problems, inconveniences or hazards that arise. g) Drivers and persons caring for children and pupils must have valid medical examinations and training in occupational health and safety regulations, fire safety and first aid. h) When a road collision or an event obstructing travel occurs, taking action jointly with the caregiver aimed first and foremost at ensuring the safety of children and pupils, as well as minimising material losses. i) The carrier bears full liability for damage resulting from the operation of vehicles and the transport of children and pupils with disabilities, taking into account the applicable rules arising from compulsory third-party liability insurance. j) Keeping the address details of the transported children and pupils confidential and not disclosing them to unauthorised persons. k) The Contractor guarantees the safety of persons and property while providing transport services for children and pupils. The Contracting Authority assumes no liability for accidents and events of any kind resulting in bodily injury, death or material damage caused by an act or omission of the Contractor. The Contractor must perform the contract in accordance with the law, and in particular in compliance with: the Act of 6 September 2001 on Road Transport (consolidated text, Journal of Laws of 2025, item 1490, as amended), the Act of 16 December 2010 on Public Collective Transport (consolidated text, Journal of Laws of 2025, item 285, as amended), and the Act of 20 June 1997 – Road Traffic Law (consolidated text, Journal of Laws of 2024, item 1251, as amended). l) The Contractor is obliged to ensure that, during transport, children and pupils are under the care of persons (drivers and caregivers) who in no way raise doubts as to whether they may look after children and pupils, and in particular who have not been convicted of offences against minors and bodily integrity, have not been prohibited from conducting educational activities, and are not listed in the Register of Sexual Offenders. Tasks and duties of the caregiver: a) Having a legible identification badge bearing their first name and surname, attached in a visible place. b) Ensuring the safe boarding, transport and exiting from the vehicle of the child and pupil (including those with disabilities), providing care, assistance and advice to children and pupils (including those with disabilities). c) Collecting children and pupils from their parents/legal guardians outside their homes before lessons begin. d) After arrival at the school or institution, escorting children and pupils to the cloakroom and handing them over to the person on duty; after classes, collecting children and pupils from the cloakroom of the school, centre or institution and, following transport, placing them in the care of their parents/legal guardians. e) Paying attention to the proper behaviour of children and pupils during the journey. f) Cooperating with the directors of schools, centres and institutions by reporting changes concerning the status of the transport of children and pupils (including those with disabilities), the service start and end times, etc. g) In the event of a breakdown of the transporting vehicle Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the Special Educational Centre for Children and Young People with Disabilities in Dąbrowa Górnicza, ul. Swobodna 59, transport route according to Appendix No. 2 to the SWZ – addresses of pupils transported by the city of Mysłowice (approx. 80 km there and back). The Contracting Authority anticipates transporting up to 9 persons using at least one vehicle and transporting 2 persons using one vehicle. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the motor vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. The Contractor is responsible for the care and safety of pupils during transport, on the way from the motor vehicles to the institution and from the institution to the motor vehicles. The Contractor shall cooperate with the Contracting Authority, the director of the institution and the parents/legal guardians within the scope covered by the contract being performed. Throughout the entire period of performance of the subject of the contract, the Contractor is obliged to provide the transported pupils with the care of at least two adults (a caregiver – independently of the driver, with at least one caregiver in each vehicle). The caregiver may be an adult who guarantees the safe transport of pupils to and from the institution. The caregiver’s duties include: ensuring the safety of pupils during travel, assisting pupils when boarding and exiting motor vehicles, ensuring that pupils reach the institution safely and return home safely. Motor vehicles transporting up to 9 persons must be adapted to transport children with disabilities and young people with disabilities who use wheelchairs. The Contracting Authority does not require a vehicle adapted to transport persons using wheelchairs in the case of transport for 2 persons. The estimated number of transport days is 193. Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the School and Preschool Complex for Deaf and Hard-of-Hearing Children in Katowice, ul. Grażyńskiego 17, “Nasza Szkoła” Non-Public Primary School in Katowice, ul. Harcerzy Września 1939 No. 5, Special Primary School No. 7 in Katowice, ul. Szkolna 5, Special Vocational School Complex No. 6 in Katowice, ul. Rolna 22, transport route according to Appendix No. 2 to the SWZ – addresses of children and pupils transported by the city of Mysłowice (approx. 150 km there and back). The Contracting Authority anticipates transporting up to 16 persons using at least two vehicles. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the motor vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. The Contractor is responsible for the care and safety of children and pupils during transport, on the way from the motor vehicles to the schools and institutions and from the schools and institutions to the motor vehicles. The Contractor shall cooperate with the Contracting Authority, the directors of the institutions and the parents/legal guardians within the scope covered by the contract being performed. Throughout the entire period of performance of the subject of the contract, the Contractor is obliged to provide the transported children, pupils and young people with the care of at least two adults (a caregiver – independently of the driver, with at least one caregiver in each vehicle). Provision of transport and care during the transport of children and pupils with disabilities from the city of Mysłowice to Henryk Sienkiewicz Primary School No. 13 with Integration and Bilingual Classes in Mysłowice, ul. Hlonda 14, Janusz Korczak Special School Complex in Mysłowice, ul. Wały 4, Kornel Makuszyński Primary School No. 7 with Bilingual Classes in Mysłowice, ul. Górnicza 4, Integration Preschool in Mysłowice, ul. Portowa 11a, Preschool No. 16 with Integration Classes in Mysłowice, ul. The Contracting Authority anticipates transporting up to 85 persons using at least two vehicles. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the motor vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. The Contractor is responsible for the care and safety of children and pupils during transport, on the way from the motor vehicles to the schools and institutions and from the schools and institutions to the motor vehicles. The Contractor shall cooperate with the Contracting Authority, the directors of the schools and institutions and the parents/legal guardians within the scope covered by the contract being performed. Piastów Śląskich 8 and ul. Dzierżonia 26, transport route according to Appendix No. 2 to the SWZ – addresses of pupils transported by the city of Mysłowice (approximately 30 km there and back). The Contracting Authority anticipates transporting up to 61 persons using at least one vehicle. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. The Contractor is responsible for the care and safety of pupils during transport, on the way from the vehicles to the school and from the school to the vehicles. The Contractor shall cooperate with the Contracting Authority, the school director and the parents/legal guardians within the scope covered by the contract being performed. Provision of transport and care during the transport of pupils with disabilities from the city of Mysłowice to the Dr Maria Trzcińska-Fajfrowska Rehabilitation, Education and Child-Rearing Centre in Katowice, ul. Gościnna 8 (Occupational Therapy Workshops – ul. Wojciecha 23), transport route according to Appendix No. 2 to the SWZ – addresses of children transported by the city of Mysłowice (approx. 60 km there and back). The Contracting Authority anticipates transporting up to 8 persons using at least one vehicle. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the motor vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. The Contractor is responsible for the care and safety of pupils during transport, on the way from the motor vehicles to the institution and from the institution to the motor vehicles. The Contracting Authority anticipates transporting up to 10 persons using at least one vehicle. The Contractor is obliged to equip the motor vehicles with means of communication (e.g. a mobile telephone), and the motor vehicles should meet the technical requirements and have the necessary equipment specified in the Road Traffic Law. The Contractor shall ensure safe and hygienic transport conditions and punctual performance of the subject of the contract. Wolności 11, transport route according to Appendix No. 2 to the SWZ – addresses of pupils transported by the city of Mysłowice (approx. 70 km there and back). The Contracting Authority anticipates transporting up to 8 persons using at least one vehicle. The Contractor will be responsible for the care and safety of pupils with disabilities during transport, on the way from the motor vehicle to the school/centre and from the school/centre to the motor vehicle. The Contractor will cooperate with the Contracting Authority, the director of the school/centre and the parents/legal guardians within the scope covered by the contract being performed. Throughout the entire period of performance of the subject of the contract, the Contractor will be obliged to provide the transported pupils with disabilities with the care of at least one adult (a caregiver – independently of the driver, with at least one caregiver in each vehicle). The caregiver may be an adult who guarantees the safe transport of pupils to and from the school/centre. The caregiver’s duties will include: ensuring the safety of pupils with disabilities during travel, providing assistance when boarding and exiting motor vehicles, and ensuring safe arrival at the school/centre and a safe return home. The motor vehicles must be adapted to transport children with disabilities and young people with disabilities who use wheelchairs. The estimated number of transport days is 193. Provision of transport and care during the transport of children and pupils (including those with disabilities) from the city of Mysłowice who attend School and Preschool Complex No. 2 in Mysłowice, ul. Wybickiego 79, to School and Preschool Complex No. 3 in Mysłowice, ul. Laryska 101 (approximately 6 km there and back). The Contracting Authority anticipates transporting up to 26 persons using at least one vehicle, with 5 journeys per working day. The first journey starts no earlier than 7:30, while the last journey will end no later than 16:30, with a maximum of 20 children and pupils during a single journey (the exact transport route schedule will be provided to the Contractor before the start of the 2026/2027 school year).
