Opportunity description

The subject of the contract consists of transporting children and pupils, including children and pupils with disabilities, to and from educational institutions in the 2026/2027 school year, carried out under four tasks. For Task No. 1 and Task No. 2, the Contractor shall also provide free transport to and from each route for transport attendants. If a ticket must be issued for a transport attendant, the Contractor shall issue it at its own expense. For Task No. 1 and Task No. 2, the Contracting Authority shall provide care for the children and pupils during transport to and from the institutions. For Task No. 3 and Task No. 4, the Contractor shall provide care for the children and pupils during transport to and from the institutions. The transport attendant may not be the driver of the bus carrying the children and pupils on the individual transport routes. The transport attendant must be an adult who has completed a first-aid course. The Contractor shall ensure performance of the subject of the contract using roadworthy buses with valid technical inspections, approved for road use, in a technical condition giving no grounds for objection, meeting safety requirements (in accordance with applicable law), in an appropriate sanitary condition, kept clean while maintaining their interior and exterior appearance, and heated during the winter period. For Task No. 2, Task No. 3 and Task No. 4, the Contractor shall additionally provide buses equipped with passenger seat belts. The Contracting Authority reserves the right to inspect documents confirming the technical condition of the buses. The Contractor shall be required to check whether the details of the persons performing the subject of the contract (bus drivers and, in the case of Task No. 3 and Task No. 4, also transport attendants) are entered in the Register of Sexual Offenders, in accordance with Art. 21 of the Act of 13 May 2016 on counteracting threats of sexual crime and the protection of minors (Journal of Laws of 2026, item 110, as amended). The Contractor shall be required to possess and comply with the Standards for the Protection of Minors drawn up by the Contractor pursuant to Art. 22b of the Act on counteracting threats of sexual crime and the protection of minors. Additional information: The Contracting Authority requires a bid bond in the amount of: - Task No. 1 – PLN 10,000.00, - Task No. 2 – PLN 1,000.00, - Task No. 3 – PLN 1,000.00, - Task No. 4 – PLN 800.00, lodged with the Contracting Authority before the deadline for submission of tenders and maintained continuously until the expiry of the tender validity period, except in the cases referred to in Art. 98(1)(2) and (3) and Art. 98(2) of the Pzp Act, provided that a bid bond lodged in cash must be credited to the Contracting Authority’s bank account specified in the SWZ before the deadline for submission of tenders. The Contracting Authority does not envisage awarding contracts referred to in Art. 214(1)(7) of the Pzp Act. The Contracting Authority envisages amendments to the provisions of the concluded contract; details are specified in the draft contract, separate for the given task, constituting Annex No. 10 to the SWZ. The Contracting Authority does not envisage reimbursement of the costs of participation in the procedure. The Contracting Authority does not envisage making advance payments towards performance of the contract. The Contractor may entrust performance of part of the contract to subcontractors; detailed requirements are specified in the SWZ. The Contracting Authority does not require a performance bond. The Contracting Authority envisages requirements related to performance of the contract in connection with Art. 95 of the Pzp Act; details are specified in the SWZ. Contractors may jointly apply for the award of the contract. Pursuant to Art. 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, 04.05.2016, p. 1, as amended), hereinafter GDPR, the Contracting Authority states that: 1) The controller of your personal data is: Gmina Staszów (ul. Opatowska 31, 28-200 Staszów, contact telephone: 15 864 83 05); 2) The Controller has appointed a Data Protection Officer whom you may contact in all matters concerning the processing of personal data via the e-mail address: inspektor@cbi24.pl or in writing at the Controller’s address; 3) Your personal data shall be processed for the purpose of exercising rights and fulfilling obligations arising from legal provisions (Art. 6(1)(c) GDPR), for a purpose connected with the contract award procedure for: “Transport of children and pupils, including children and pupils with disabilities, to and from educational institutions in the 2026/2027 school year” and the conclusion of a contract, and the legal basis for their processing is the Contracting Authority’s legal obligation, as a public finance sector entity, to apply formalised contract award procedures—the Act of 11 September 2019—Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320, as amended)—hereinafter the Pzp Act. Detailed information is specified in the SWZ. Task No. 1 The subject of the contract for Task No. 1 concerns routes No. I to No. XII and includes transporting a total of 610 children and pupils to and from educational institutions in the city and municipality of Staszów, carried out through the purchase of monthly tickets. The Contracting Authority reserves the right to change the number of children and pupils transported on the individual routes during performance of the contract. Contract performance period: from 01.09.2026 to 25.06.2027. The Contracting Authority shall provide care for the children and pupils during transport to and from the institutions. The Contractor shall provide free transport to and from the institutions for transport attendants. The Contractor shall ensure performance of the subject of the contract using roadworthy buses having: a number of seats corresponding to the number of persons transported on each route, valid technical inspections, approval for road use, a technical condition giving no grounds for objection, compliance with safety requirements (in accordance with applicable law), an appropriate sanitary condition, cleanliness while maintaining their interior and exterior appearance, and heating during the winter period. The Contracting Authority reserves the right to inspect documents confirming the technical condition of the buses. The Contractor shall be required to check whether the details of the bus drivers performing the subject of the contract are entered in the Register of Sexual Offenders, in accordance with Art. 21 of the Act of 13 May 2016 on counteracting threats of sexual crime and the protection of minors (Journal of Laws of 2026, item 110, as amended). Task No. 2 The subject of the contract for Task No. 2 concerns one route, No. XIII (140 km per day), and includes transporting a total of 18 children and pupils with disabilities to and from educational institutions in the City and Municipality of Staszów over 231 school days. Performance period: from 01.09.2026 to 30.07.2027. The Contracting Authority shall provide care for the children and pupils during transport to and from the institutions. The Contractor shall provide free transport to and from the institutions for the transport attendant. The Contracting Authority reserves the right to change the number of children and pupils transported during performance of the contract. The Contractor shall ensure performance of the subject of the contract using roadworthy buses equipped with passenger seat belts, with valid technical inspections, approved for road use, in a technical condition giving no grounds for objection, meeting safety requirements (in accordance with applicable law), in an appropriate sanitary condition, kept clean while maintaining their interior and exterior appearance, and heated during the winter period. The Contracting Authority reserves the right to inspect documents confirming the technical condition of the buses. The Contractor shall perform the subject of the contract using a category M3*) vehicle referred to in Art. 4(1)(a) of Regulation 2018/858, other than class I and class A*) vehicles referred to in Art. 3(2) and (3) of Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor (OJ EU L 200, 31.07.2009, p. 1, as subsequently amended). *) Category M3 vehicles—motor vehicles with a maximum mass exceeding 5 tonnes and having more than eight seating positions in addition to the driver’s seating position, irrespective of whether these motor vehicles may have space for standing passengers. Category M3 class I vehicles—category M3 vehicles capable of carrying more than 22 passengers, excluding the driver, constructed with areas for standing passengers to allow frequent passenger movement. Category M3 class A vehicles—category M3 vehicles capable of carrying no more than 22 passengers, excluding the driver, designed to carry standing passengers and having seats and provision for standing passengers. The Contractor shall be required to check whether the details of the bus drivers performing the subject of the contract are entered in the Register of Sexual Offenders, in accordance with Art. 21 of the Act of 13 May 2016 on counteracting threats of sexual crime and the protection of minors (Journal of Laws of 2026, item 110, as amended). The Contractor shall be required to possess and comply with the Standards for the Protection of Minors drawn up by the Contractor pursuant to Art. 22b of the Act on counteracting threats of sexual crime and the protection of minors. Task No. 3 The subject of the contract for Task No. 3 concerns one route, No. XIV (200 km per day), and includes transporting, together with providing care during transport, a total of 17 children and pupils with disabilities from the Municipality of Staszów to the Powiatowy Zespół Placówek Szkolno-Wychowawczych in Mielec, ul. Królowej Jadwigi 1, 39-300 Mielec (PZPS-W MIELEC), over 188 school days. Performance period: from 01.09.2026 to 25.06.2027. The Contractor shall provide care for the children and pupils during transport to and from the institution. The transport attendant may not be the driver of the bus carrying the children and pupils on the route covered by the subject of the contract. The transport attendant must be an adult who has completed a first-aid course. The duties of the transport attendant include in particular: - care, supervision and ensuring safety while transporting the children and pupils from their places of residence to the above-mentioned educational institution; - providing assistance to the transported children and pupils when safely boarding and alighting from the bus; - collecting the children and pupils from their parents/legal guardians in front of their homes, accompanying them from the bus to the educational institution and placing them in the care of a person designated by the educational institution; - after classes have ended—collecting the children and pupils from the educational institution, accompanying them to the bus and, after transporting them to their homes, placing them in the care of their parents/legal guardians. The Contracting Authority reserves the right to change the number of children and pupils transported during performance of the contract. The Contractor shall ensure performance of the subject of the contract using roadworthy buses equipped with passenger seat belts, with valid technical inspections, approved for road use, in a technical condition giving no grounds for objection, meeting safety requirements (in accordance with applicable law), in an appropriate sanitary condition, kept clean while maintaining their interior and exterior appearance, and heated during the winter period. Task No. 4 The subject of the contract for Task No. 4 concerns one route, No. XV (104 km per day), and includes transporting, together with providing care during transport, 4 pupils with disabilities from the Municipality of Staszów to: 1) Zespół Szkół Centrum Kształcenia Rolniczego in Sichów Duży, Sichów Duży 89, 28-236 Rytwiany (ZSCKR Sichów Duży), 2) Specjalny Ośrodek Szkolno-Wychowawczy in Bronina, Bronina 59, 28-100 Busko-Zdrój (SOS-W Bronina), over 188 school days. Performance period: from 01.09.2026 to 25.06.2027. The Contractor shall provide care for the children and pupils during transport to and from the institutions. The transport attendant may not be the driver of the bus carrying the children and pupils on the route covered by the subject of the contract. The transport attendant must be an adult who has completed a first-aid course. The Contractor shall perform the subject of the contract using 1 category M2*) vehicle referred to in Art. 4(1)(a) and (b) of Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC (OJ EU L 151, 14.06.2018, p. 1, as subsequently amended), powered by electricity or hydrogen. *) Category M2 vehicles—motor vehicles with a maximum mass not exceeding 5 tonnes and having more than eight seating positions in addition to the driver’s seating position, irrespective of whether these motor vehicles may have space for standing passengers.
