4.3. The subject matter of the contract is the provision by the Contractor of transport services in the field of public collective transport within the Municipality of Podegrodzie, on lines P1–P5 specified in this Description of the Subject Matter of the Contract. Transport services will be provided using electric buses purchased with funding from the National Recovery and Resilience Plan (KPO), intended for the implementation of the project: “Purchase of zero-emission non-urban buses for the Municipality of Podegrodzie” under Investment E1.1.2 Zero- and low-emission collective transport. These buses constitute the fleet intended to operate transport services under this contract and must be used in accordance with the requirements of the Contracting Authority and the applicable provisions of law. A detailed description of the subject matter of the contract is set out in attachments no. 10 to the SWZ. 4.5. Furthermore, under the contract, the Contractor is obliged to: 1) use the buses and charging points, including servicing and carrying out warranty repairs, in accordance with the DNSH principle with regard to the following environmental objectives: a) “Climate change mitigation” - ensuring that activities related to the operation and maintenance of the fleet and vehicle charging points do not contribute to exacerbating climate change through emissions exceeding permissible standards. b) “Climate change adaptation” - guaranteeing that the fleet is resistant to climate changes such as extreme temperatures, heavy rainfall and snowfall, and other weather phenomena. c) “Sustainable use and protection of water and marine resources” - ensuring that the operation and maintenance of the fleet and vehicle charging points do not lead to the pollution of surface water or groundwater or to a reduction in the availability of water resources. d) “Circular economy, including waste prevention and recycling” - ensuring the minimization of waste generation and promoting the recycling of materials used in the production of items consumed in the process of operating and maintaining vehicle charging points. e) “Prevention and control of air, water or soil pollution” - limiting the negative environmental impact of activities by preventing air, water and soil pollution. f) “Protection and restoration of biodiversity and ecosystems” by preventing damage to biodiversity and ecosystems through minimizing interference with the natural environment. 2) Documenting the operation/technical inspections/servicing of buses and charging points according to the following rules: Operation stage • Internal strategy/instructions concerning the operation and maintenance of the fleet, confirming due care for compliance with standards concerning electric drive - EV/BEV. • Reports from periodic technical inspections confirming maintenance of the EV/BEV standard. • reports from operational inspections/technical inspections of chargers. Operation stage • reports from operational inspections/technical inspections (including air conditioning and heating), • reports from operational inspections/technical inspections of chargers. Operation stage • reports from operational inspections/technical inspections containing information on proper use and the absence of a negative impact on water resources, • internal strategy/instructions concerning the operation and maintenance of vehicles and charging stations, taking into account matters of proper use and protection of water resources (if held by the OOW). Operation stage • Internal strategy/instructions concerning operation and maintenance or another document, including, for example, internal instructions for the contractor (e.g. service provider) regarding waste management in accordance with the above scope • reports from operational inspections/technical inspections for vehicles and charging stations containing relevant information on the application of circular economy principles, including waste prevention and recycling, • agreements with authorized waste recipients and/or waste transfer notes. Operation stage • reports from operational inspections and technical inspections of vehicles and charging stations containing relevant information regarding the absence of a negative impact on this objective, • internal strategy/instructions concerning operation and maintenance, including, for example, internal instructions for the contractor (e.g. service provider) regarding the prevention and control of air, water or soil pollution. Operation stage • internal strategy/instructions concerning the operation and maintenance of the purchased fleet in accordance with its intended purpose, • reports from operational inspections and technical inspections for vehicles and charging stations. 4.6. Requirements concerning employment on the basis of an employment relationship, in the circumstances referred to in Art. 95: Pursuant to Art. 95 sec. 1 of the Pzp Act, the Contracting Authority requires the contractor or subcontractor to employ, under an employment contract, persons performing activities such as:  driving buses - drivers who will directly perform activities within the scope of implementation of the contract constituting the subject matter of these proceedings. (excluding persons independently performing a given activity as part of a sole proprietorship, i.e. “self-employment,” or conducting business in the form of a civil-law partnership or partnership where the activity will be performed by persons who are partners in that partnership).
