Due to the limited number of characters in the form for submitting notices electronically, further information concerning the procedure is provided below (numbering carried over from the SWZ): 5.1.4 A commitment by the entity providing resources to place the necessary resources at the Contractor’s disposal for the purpose of performing the contract in question, or another entity-related means of evidence confirming that, when performing the contract, the Contractor will have at its disposal the necessary resources of those entities, where the Contractor relies on the capacities or situation of entities providing resources. 5.1.5 The commitment of the entity providing resources referred to in point 5.1.4 confirms that the relationship between the Contractor and the entity/entities providing resources guarantees genuine access to those resources and specifies in particular: - the scope of the resources of the entity providing resources available to the Contractor; - the manner and period in which the resources are made available to the Contractor and used by it in performing the contract; - whether and to what extent the entity providing resources, on whose capacities the Contractor relies with regard to the conditions for participation in the procedure concerning education, professional qualifications or experience, will perform the contract/the part thereof to which the indicated capacities relate. NOTE - The Contractor is obliged to fulfil the information obligation provided for in Article 13 or Article 14 of the GDPR with respect to natural persons from whom it has obtained personal data directly or indirectly (where Subcontractors/Third-party entities/Contractors forming part of a consortium are used) for the purpose of applying for the award of the contract in this procedure. 5.1.6. A statement indicating which parts of the contract will be performed by the respective Contractors, in the case of Contractors jointly applying for the award of the contract and with regard to the conditions indicated in point 4.1.5 - drawn up according to the template constituting Appendix No. 5 to the SWZ (if applicable). 5.1.7. A list of persons assigned by the Contractor to perform the public contract, in particular those responsible for providing the services, together with information on the professional qualifications, authorisations, experience and education necessary to perform the public contract, as well as the activities performed by them and information on the basis on which those persons are available. The list must be drawn up according to the template constituting Appendix No. 7 to the SWZ. NOTE: The submission of the lists referred to in points 5.1.7 and 7.11(e) results from Article 126(2) of the Act. The lists are necessary to ensure the proper conduct of the procedure because the Contracting Authority has used, as a tender evaluation criterion, the experience of the persons who will be assigned to perform the contract and who meet the condition for participation in the procedure, verification of which requires the assessment of both documents. 5.5 A Contractor entered in an official list of approved contractors or a Contractor certified by certification bodies meeting the requirements of European certification standards may, instead of the entity-related means of evidence referred to in points 5.2.1-5.2.3, submit a certificate of entry in the official list issued by the competent authority or a certificate issued by the competent certification body of the country in which the Contractor has its registered office or place of residence, indicating the entity-related means of evidence constituting the basis for entry or certification, unless the Contracting Authority has reasonable grounds to question the information contained in the certificate. 5.6 The Contractor is not obliged to submit the entity-related means of evidence referred to in Chapter 5 of the SWZ if the Contracting Authority can obtain them from free and publicly accessible databases, in particular public registers within the meaning of the Act of 17 February 2005 on the computerisation of the activities of entities performing public tasks, hereinafter referred to as the “Computerisation Act”, provided that the Contractor has indicated in the ESPD the data enabling access to those means. The Contractor is not obliged to submit entity-related means of evidence already held by the Contracting Authority if the Contractor identifies those means and confirms their correctness and validity. 5.7 Entity-related means of evidence and documents or statements drawn up in a foreign language must be submitted together with translations into Polish. If the entity-related means of evidence, documents or statements referred to in Chapter 5 of the SWZ are drawn up in a foreign language, the Contractor is obliged to provide their translation into Polish. 7.11 The tender must contain: a) the FO drawn up and completed according to the template constituting Appendix No. 6 to the SWZ, in which, among other things, the following must be provided: the price; b) a power of attorney or another document confirming authorisation to represent the Contractor – if applicable; c) the statements and documents referred to in point 5.1, with the proviso that the documents referred to in points 5.1.4 and 5.1.6 – if applicable; d) justification for designating information contained in the tender as a trade secret – if applicable; e) the list “Experience of persons assigned to perform the contract”, containing information enabling an evaluation to be made in accordance with the tender evaluation criterion specified in point 12.3. The list must be drawn up according to the template constituting Appendix No. 8 to the SWZ. f) a document subject to evaluation in accordance with the criteria indicated in point 12.4 of the SWZ, i.e. “Preliminary concept for conducting two-day training”, containing: a) Comprehensiveness and coherence of the concept; b) Diversity of engaging and workshop-based methods; g) where the tender security is provided in a form other than money, the original tender security document (guarantee or surety). 16.1 The draft contractual provisions constitute Appendix No. 2 to the SWZ.
