1. The procedure for the award of the public contract in question is conducted pursuant to the provisions of the Act of 11 September 2019 Public Procurement Law – hereinafter referred to as the “Pzp Act” – and the implementing provisions issued pursuant thereto, in particular the Regulation of the Minister of Development, Labour and Technology of 23 December 2020 on entity-related means of evidence and other documents or declarations that the contracting authority may require from the contractor – hereinafter referred to as the “MR Regulation” – under an open tender procedure. 2. The contract for social and other specific services is being processed under the regime of Article 132 in conjunction with Article 359(1) of the Pzp Act. 3. Pursuant to Article 139 of the Pzp Act, the Contracting Authority will first examine and evaluate the tenders and will then carry out the entity-related qualification of the contractor whose tender has received the highest evaluation, with regard to the absence of grounds for exclusion from the procedure and fulfilment of the conditions for participation. 4. Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority reserves the right to cancel the procedure in question if the funds that the Contracting Authority intended to allocate to finance all or part of the contract in question are not granted to it. In the event of cancellation on the basis of the above-mentioned grounds, Contractors shall not be entitled to reimbursement of the costs of participation in the procedure. 5. The Contractor shall remain bound by the submitted tender until 20.10.2026. The period during which the tender remains binding shall commence upon expiry of the deadline for submission of tenders. The subject matter of the contract is the protection of the technical and administrative facilities and the company port at the Hydrotechnical Facility in Włocławek at ul. Płocka 171, belonging to PGW Wody Polskie, Catchment Area Management Board in Włocławek, ul. Okrzei 74a, 87-800 Włocławek.
