Opportunity description

1 The subject matter of the contract is the supply and configuration of ICT infrastructure components and computers and IT accessories - divided into 2 parts: Part No. 1 of the contract – supply of ICT infrastructure components, including servers, network switches, UPS power supplies together with a warranty, a server operating system and the granting of a licence and an access licence, together with the implementation and configuration of the virtualization environment and network switches, under the terms described in the Description of the subject matter of the contract for Part No. 1, constituting Appendix No. 1a to the SWZ (hereinafter: “OPZ No. 1”) and in the Draft contractual provisions for Part No. 1, constituting Appendix No. 2a to the SWZ (hereinafter: “PPU No. 1”); Part No. 2 of the contract – supply of portable computers (laptops) and IT accessories, including tablets with keyboards, drives for a NAS array, a 5G modem set with a Wi-Fi router, and RAM for laptops, together with a warranty under the terms described in the Description of the subject matter of the contract for Part No. 2, constituting Appendix No. 1b to the SWZ (hereinafter: “OPZ No. 2”) and in the Draft contractual provisions for Part No. 2, constituting Appendix No. 2b to the SWZ (hereinafter: “PPU No. 2”). 2 Under the option referred to in Art. 441 of the Pzp Act (hereinafter the “Option”), the Contracting Authority reserves the right to place an order covering the supply of an additional type 1 server, within the scope and under the terms specified in OPZ No. 1 and PPU No. 1. 3 The Contracting Authority reserves the right not to exercise the Option. The Contractor shall not be entitled to any claims against the Contracting Authority due to the Option not being exercised. 4 Where, in the description of the subject matter of the contract, pursuant to Art. 99(5) of the Pzp Act, trademarks, patents or origin, source or a specific process characterizing the products supplied by a specific Contractor have been indicated, the Contracting Authority permits the offering of equivalent solutions. 5 Where, in the description of the subject matter of the contract, pursuant to Art. 101(4) of the Pzp Act, reference has been made to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101(1)(2) and (3), the Contracting Authority permits the offering of equivalent solutions. 6 The Contracting Authority requires that the offered performance, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, shall not include: 6.1 ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have a negative impact on the fundamental national security interest; 6.2 an ICT product whose type has been specified in a decision recognizing a supplier as a high-risk supplier, as referred to in Art. 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, nor ICT services or ICT processes specified in that decision. Failure to meet the above requirement shall result in rejection of the tender, as applicable, pursuant to Art. 226(1)(17) or (19) of the Pzp Act. 7 The detailed description of the subject matter of the contract for each part of the contract has been specified separately in OPZ No. 1 and OPZ No. 2, and the detailed terms and conditions for the performance of the contract for each part of the contract have been specified separately in PPU No. 1 and PPU No. 2. 1.
