1. The subject matter of the contract is the supply of network and server devices, divided into lots: ‒ Lot I of the procedure - Supply of production and backup servers: includes the supply of 4 production servers and 2 backup servers; ‒ Lot II of the procedure - Supply of an enterprise-class disk array and a disk array intended for data backup: includes the supply of 2 enterprise-class disk arrays and 2 disk arrays intended for backup; ‒ Lot III of the procedure - Supply of an LTO-9 tape library: includes the supply of 2 LTO-9 tape libraries; ‒ Lot IV of the procedure - Supply of Fibre Channel switches: includes the supply of 4 Fibre Channel switches. Applies to Lots I, II, III and IV of the procedure: 2. The Contractor undertakes to supply brand-new, fully functional equipment manufactured in accordance with applicable norms and standards and covered by the manufacturer's warranty. The Contractor's warranty period constitutes a non-price criterion for the evaluation of tenders. 3. The Contractor declares that, on the date of signing the Equipment Acceptance Protocol, the equipment offered may not be designated by the manufacturer for withdrawal from production or sale. 4. The warranty does not exclude, limit or suspend the Contracting Authority's rights arising from the provisions of law concerning statutory warranty for physical defects and legal defects in the equipment. The Contracting Authority is entitled to exercise its rights under the statutory warranty for defects independently of the rights arising from the warranty. 5. Detailed information concerning the warranty is contained in §9. Warranty conditions in the Essential Provisions of the Contract, constituting Annexes No. 3a, 3c and 3d to the SWZ for Lots I, III and IV of the procedure respectively, and in §8. A detailed description of the subject matter of the contract and the method of performance are described in Annexes No. 1a, 1b, 1c and 1d to the SWZ, constituting the description of the subject matter of the contract for Lots I, II, III and IV of the procedure respectively, and in Annexes No. 3a, 3b, 3c and 3d to the SWZ, constituting the Essential Provisions of the Contract for Lots I, II, III and IV of the procedure respectively. 7. If the procurement documents were to indicate trademarks, patents or origin with regard to certain materials or devices, the Contracting Authority, pursuant to Art. 99(5) of the Pzp, permits the offering of equivalent materials or devices. Materials or devices originating from specific manufacturers define the minimum quality parameters and functional characteristics that the materials or devices offered by the Contractor must meet in order to satisfy the requirements set by the Contracting Authority. Materials and devices originating from specific manufacturers constitute only a quality benchmark for the subject matter of the contract. By “minimum quality parameters and functional characteristics,” the Contracting Authority means requirements concerning materials or devices contained in publicly available sources, catalogues and manufacturers' websites. The use of example manufacturer names is intended to clarify the level of the Contracting Authority's expectations with regard to a specific solution. The use of product/manufacturer names is solely illustrative. When indicating the designation of a specific manufacturer (supplier) or a specific product in the description of the subject matter of the contract, the Contracting Authority simultaneously permits equivalent products with functional parameters and quality characteristics at least at the level of the parameters of the indicated product, thereby accepting any product with the indicated or better parameters. 8. Whenever the Contracting Authority describes the subject matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, it permits solutions equivalent to those described. 9. Whenever a specific label or certificate referred to in Art. 104 and 105 of the Pzp is used in the SWZ or procurement documents, the Contracting Authority also accepts all other markings confirming that the construction works, supplies or services meet equivalent requirements. 10. In cases where, for reasons beyond its control, the Contractor is unable to obtain the label or certificate specified by the Contracting Authority confirming that the construction works, supplies or services it offers meet equivalent requirements, the Contracting Authority shall, within a time limit set by it, accept other means of evidence, in particular the manufacturer's technical documentation, provided that the Contractor proves that the construction works, supplies or services it offers meet the requirements of the specified marking or the specified requirements indicated by the Contracting Authority. 11. The use in the SWZ or procurement documents of a requirement to possess a certificate issued by a conformity assessment body or a test report issued by such a body as a means of evidence confirming compliance with the requirements or characteristics specified in the description of the subject matter of the contract, tender evaluation criteria or contract performance conditions means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The Contracting Authority also accepts other appropriate means of evidence, in particular the manufacturer's technical documentation, where the Contractor concerned has neither access to certificates or test reports nor the possibility of obtaining them within the relevant time limit, provided that this lack of access cannot be attributed to the Contractor concerned and that the Contractor concerned proves that the construction works, supplies or services it performs meet the requirements or criteria specified in the description of the subject matter of the contract, tender evaluation criteria or contract performance conditions.
