1. The subject matter of the contract is the delivery and installation of servers for production processes, including technical support. 2. Pursuant to Article 139 of the Public Procurement Law, the Contracting Authority provides for the reverse order of evaluation of tenders, i.e. it will first examine and evaluate the tenders and then carry out the qualification of the Contractor whose tender received the highest score, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 4. The Contracting Authority is the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter the “GDPR”. 5. The Contractor submits its tender via the eZamówienia Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/ 6. The Contracting Authority stipulates that, pursuant to Article 257 of the Public Procurement Law, it may cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to finance the contract are not awarded to it. 7. The tender shall be submitted, under pain of nullity, in electronic form, in accordance with the requirements strictly specified in the SWZ. 8. The Contracting Authority will not award the contract if the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organizational measures in connection with Russia’s actions destabilizing the situation in Ukraine (Official Journal of the EU L of 2014, No 229, p. 1, as amended) occur, and will exclude the Contractor if at least one of the grounds for exclusion specified in Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (consolidated text, Journal of Laws of 2025, item 514) occurs – in order to confirm the absence of grounds for exclusion, a declaration constituting Appendix No 7 to the Tender Form must be submitted together with the tender. 9. Delivery to the Location and transfer to the Contracting Authority of ownership of the Equipment, i.e. 6 Type 1 servers (computing) and 3 Type 2 servers (management), together with the Software and provision of the Licenses necessary for the proper functioning of the Equipment, Installation of the Equipment in RACK cabinets at the Location, and provision to the Contracting Authority of the Documentation, including as-built documentation, and the other data and documents referred to in § 5(1) and (10) of the Agreement; - within a maximum period of up to 45 days from the date of conclusion of the Agreement – no later than 15.12.2026; 10. Provision of a Warranty for the Equipment for a period of 60 months from the date of acceptance specified in the Final Acceptance Protocol signed by the Parties; 11. Provision of Technical Support for the Equipment and Software for a period of 60 months from the date of acceptance specified in the Final Acceptance Protocol signed by the Parties. 12. The Contracting Authority requires the submission, together with the tender, of subject-matter evidence confirming the compliance of the offered supplies with the requirements specified in Chapter II of the SWZ – Description of the Subject Matter of the Contract.
