Opportunity description

The subject matter of the contract is the purchase of two servers with support. The contract is being carried out as part of the project entitled: Digitization and provision of the digital resources of Polskie Wydawnictwo Muzyczne and the Polish Composers’ Union under the European Funds for Digital Development 2021-2027 program, co-financed by the European Regional Development Fund. The Detailed Description of the Subject Matter of the Contract and the scope of the Contractor’s obligations are specified in the annexes to the SWZ. The Contracting Authority is not dividing the contract into lots because the subject matter of the contract constitutes a single coherent IT solution, including the supply of two identical servers, licenses, installation, configuration of a high-availability cluster, implementation, and support. Dividing the contract could cause difficulties in coordinating the work, the risk of incompatibility between individual components, and the dispersion of responsibility for the proper operation of the entire environment. The absence of division is justified by technical and organizational considerations and is not intended to restrict competition. 1. Wherever trademarks, proper names, or origin (in particular: Windows Server 2025) are indicated in this description of the subject matter of the contract, the Contracting Authority permits equivalent solutions pursuant to Article 99(5) of the PZP Act, provided that the criteria described in point XIII of Annex No. 1 (OPZ) are jointly met. 2. A Contractor relying on solutions equivalent to those described by the Contracting Authority in the subject matter of the contract is required to demonstrate in the content of its submitted tender that the supplies it offers meet the requirements specified by the Contracting Authority. The Contracting Authority will consider as equivalent solutions those that make it possible to achieve the effect intended by the Contracting Authority using other technical solutions. A solution that is identical (the same) cannot be considered an equivalent solution; only one that, in terms of the compared characteristics, demonstrates exactly the same or a very similar utility value may be considered equivalent. By indicating manufacturers’ names, trademarks, standards, approvals, or reference systems, the Contracting Authority intended to specify the minimum quality parameters and functional characteristics that the goods must meet in order to satisfy the requirements set by the Contracting Authority, and these constitute solely a quality benchmark for the subject matter of the contract. By the provision concerning minimum quality parameter requirements, the Contracting Authority means the requirements for goods contained in publicly available sources, catalogs, manufacturers’ websites, etc. The use of example manufacturers’ names is intended solely to clarify the level of the Contracting Authority’s expectations with regard to a particular solution. 3. If the supply of an equivalent product is offered, the tender must include a List of parameters of the offered operating system, constituting Annex No. 1B.
