Opportunity description

1. The subject matter of the procedure is the conclusion of framework agreements for the provision of accommodation and catering services for police officers, hereinafter referred to as the service. 2. Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the “GDPR”, the Contracting Authority informs that: 1) the controller of your personal data is the Commander of the Warsaw Metropolitan Police; 2) supervision over the proper processing of personal data is exercised by the personal data protection officer: address: ul. Nowolipie 2, 00-150 Warszawa; email address: iod@ksp.policja.gov.pl 3. A detailed description of the subject matter of the contract is provided in Chapter XIX of the SWZ and Annex No 6 to the SWZ. 4. The Contracting Authority does not require, for any task, the submission of subject-matter evidence with the tender. 5. The Contracting Authority permits the performance of part of the contract to be entrusted to a Subcontractor. 6. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it will entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 7. Employment requirements based on an employment relationship in the circumstances referred to in Article 95 of the Act 1) The Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing the following activities in connection with the performance of the contract: preparation of meals. 2) during the performance of the contract, the Contracting Authority is entitled to carry out inspections of the Contractor concerning compliance by the Contractor or Subcontractor with the requirement to employ, on the basis of an employment relationship, persons performing the activities specified in point 1. In order to verify compliance with these requirements, the Contracting Authority is entitled, in particular, to request: a) a declaration from the employed worker, b) a declaration from the contractor or subcontractor concerning the employment of the worker under an employment contract, c) a copy, certified as true to the original, of the employed worker’s employment contract, d) other documents containing information, including personal data, necessary to verify employment under an employment contract, in particular the first name and surname of the employed worker, the date on which the employment contract was concluded, the type of employment contract and the scope of the worker’s duties; 3) At each request of the Contracting Authority, within the time limit specified in that request, the Contractor shall submit to the Contracting Authority the evidence specified in point 2 in order to confirm compliance with the requirement that the Contractor or Subcontractor employ, on the basis of an employment relationship, persons performing the activities listed in point 1. The Contracting Authority specifies the penalties for failure to comply with these requirements in Chapter XIX of the SWZ. 4) where there are justified doubts as to compliance with labour law by the Contractor or Subcontractor, the Contracting Authority may request that an inspection be conducted by the National Labour Inspectorate. 8. The Contracting Authority reserves the right to conduct a site visit and inspect the hotels/hotel facilities of the Contractors whose tenders receive the highest scores in terms of the facility’s compliance with the requirements contained in the SWZ. If the facility does not meet the requirements described in the SWZ or the Contractor does not make the facility available for inspection by the Contracting Authority, the Contracting Authority shall reject the Contractor’s tender pursuant to Article 226(1)(5) of the Act: “The Contracting Authority shall reject a tender if: its content does not comply with the contract conditions”. 9. The procedure for awarding contracts under the framework agreements is described in Chapter XIX of the SWZ. 10. The purpose of this procedure is for the Contracting Authority to conclude framework agreements (for each task) with a maximum of 5 (five) Contractors whose tender prices do not exceed the amount that the Contracting Authority can allocate to finance the framework agreement and whose tenders rank from 1 to 5 under the tender evaluation criteria, unless fewer Contractors submit tenders that are not subject to rejection. 11. The type and scope of amendments to the agreement are specified in Chapter XIX of the SWZ. 12. The Contractor is bound by the tender for 90 days from the expiry of the deadline for submission of tenders, with the first day of the period during which the tender is binding being the day on which the deadline for submission of tenders expires, i.e. until 15.07.2026. 13. Contractors that are not subject to exclusion pursuant to Article 108(1) and (2) of the Act and Article 109(1), points 1 and 4, 7, 8, and 10 of the Act, as well as Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (i.e. Journal of Laws of 2025, item 514), and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 229 of 31.7.2014, p. 1), as amended, hereinafter: Regulation 833/2014, as worded by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 111 of 8.4.2022, p. 1), and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, may apply for the award of this contract.
