Poland – Sewage, refuse, cleaning and environmental services – “Collection, transport and management of municipal waste from inhabited properties in the Municipality of Mykanów 2026/2027”

Opportunity description

1. The subject matter of the contract is the provision of the service of collection, transport and management of municipal waste from all inhabited properties located in the Municipality of Mykanów and from the Selective Municipal Waste Collection Point (PSZOK). 2. The Contractor is obliged to collect and manage the entire municipal waste stream from: 1) single-family residential properties, 2) multi-unit residential properties, 3) the selective municipal waste collection point (PSZOK). 3. A detailed description and the method of performance of the contract are contained in the Description of the Subject Matter of the Contract, constituting Annex No. 6 to the SWZ. . Contractors who meet the conditions concerning the following may apply for the award of the contract: 1) capacity to conduct business activities: The Contracting Authority does not impose a condition in the above scope. 2) authorisation to conduct a specific business or professional activity, insofar as this results from separate regulations: Description of the method for assessing compliance with the condition: The Contractor must demonstrate that it: - has a current entry in the register of regulated activities concerning the collection of municipal waste from property owners, maintained by the Mayor of the Municipality of Mykanów pursuant to the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2025, item 733, as amended); - has a current entry in the register of entities introducing products and packaged products and managing waste, referred to in Article 49 et seq. of the Act of 14 December 2012 on Waste (Journal of Laws of 2023, item 1587, as amended), within the scope of entities transporting waste. 3) economic or financial standing: Description of the method for assessing compliance with the condition: The Contractor must demonstrate that it: has civil liability insurance covering the conducted activity related to the subject matter of the contract in an amount not less than PLN 2,000,000.00 (in words: two million zlotys 00/100). 4) technical or professional capacity: Description of the method for assessing compliance with the condition: a) The Contractor must demonstrate that, during the last 3 years before the deadline for submission of tenders, or, if the period of conducting business is shorter, during that period, it has performed or is performing principal services corresponding by type to the service constituting the subject matter of the contract, including the performance or ongoing performance of services involving the collection of municipal waste and the collection of segregated waste from a total of at least 3,000 properties, and the contract was performed for at least 12 months. The Contracting Authority requires that the service referred to in the preceding sentence be performed under one contract for one Contracting Authority, which means that contracts may not be combined – except where the Contractor demonstrates performance of contracts for a municipality/city: - in which the number of properties is not less than 3,000, - which was divided into sectors in which the number of properties is less than 3,000, - the Contractor performs contracts in two or more sectors, and the total number of properties in those sectors is not less than 3,000. Note: With regard to Contractors jointly applying for the award of the contract, in relation to the condition concerning technical or professional capacity, the Contracting Authority permits the condition to be met jointly by the Contractors – this applies only to possession of equipment; as regards experience, it must be met by at least one of the Contractors applying jointly. The Contracting Authority therefore does not permit aggregation [combining capacities] with regard to this condition for participation in the procedure, as this would distort the purpose that should be achieved through the condition formulated in this manner. b) The Contractor must demonstrate that it has or will have at its disposal, for the purpose of performing the contract, specialist vehicles meeting the technical requirements specified by the provisions of the Road Traffic Act and other specific regulations, in the following quantities: - at least three vehicles adapted for collecting mixed municipal waste and ash from containers with capacities of 80 l, 120 l, 240 l and 1100 l (refuse collection vehicle type), - at least two dual-compartment vehicles adapted for collecting bags containing selectively collected municipal waste, - at least one vehicle with a payload capacity of up to 3.5 Mg enabling the collection of both mixed and selectively collected municipal waste from properties that are difficult for a refuse collection vehicle to access, - at least two vehicles adapted for loading, unloading and transporting containers with a capacity of 7 m3 (hook-lift truck), - at least three vehicles adapted for collecting bulky waste. All means of transport used to provide the service must meet at least the EURO V emissions standard and must be equipped with a GPRS monitoring system. All of the above-mentioned vehicles at the Contractor’s disposal should be permanently and legibly marked (company name, contact details), registered, approved for road use, and have current technical inspections and roadworthiness certificates – for the purpose of verifying the condition, the Contracting Authority has the right to request presentation of the vehicle registration certificates. The vehicles should be equipped with monitoring based on a satellite positioning system (GPS), enabling the permanent recording, storage and retrieval of data concerning vehicle locations and stopping places, as well as sensors recording data concerning waste unloading locations. The design of the vehicles must prevent the uncontrolled escape of waste during its storage, transshipment and transport, and minimise the impact of weather conditions on the waste. The Contracting Authority requires the Contractor to submit with the tender a declaration consenting to an inspection of its production or technical capacity. The Contractor is obliged to transfer non-segregated (mixed) municipal waste collected from owners of inhabited properties in the Municipality of Mykanów to municipal installations in accordance with applicable law. The Contractor is obliged to transfer selectively collected municipal waste gathered from owners of inhabited properties to waste recovery or disposal installations in accordance with the waste management hierarchy pursuant to the Act of 14 December 2012 on Waste (Journal of Laws of 2023, item 1587, as amended). Note: The subject matter of the contract is the collection and management of the entire stream of municipal waste generated within the Municipality of Mykanów from inhabited properties, on the assumption that there is no limit on the quantity of non-segregated (mixed) and segregated waste collected from residents. The Contracting Authority does not permit municipal waste commissioned by the Contracting Authority to be collected together with waste from another municipality or with any other waste. Waste will be collected directly from inhabited properties, divided into: 1) non-segregated (mixed) municipal waste, 2) ash from domestic furnaces, /NOTE – the Contractor shall collect the ash waste fraction only under waste code ex 20 01 99 (ashes from households)/ 3) paper, 4) jointly collected waste comprising the following fractions: plastics, composite packaging waste and metals, 5) glass, 6) biowaste, 7) furniture and other bulky waste, 8) waste electrical and electronic equipment, 9) waste tyres; /NOTE – the Contracting Authority informs that, as part of the mobile waste collection, the Contractor is obliged to collect waste tyres originating from households, in particular from passenger cars, motorcycles, mopeds, scooters and bicycles, regardless of the degree of wear, damage, cutting, deformation or absence of tread./ 10) textile and clothing waste. Collection of waste from the selective municipal waste collection point (PSZOK): 1) expired medicines, 2) chemicals, 3) construction and demolition waste from households (including, among other things, mixed concrete waste, brick rubble, waste ceramic materials and ceramic furnishing elements collected together, removed plaster, wallpaper, veneers, OSB boards, complete windows with wooden or plastic frames, door leaves together with glass panes, waste roofing felt, mineral wool), 4) construction polystyrene, 5) ash from domestic furnaces, 6) hazardous waste, 7) paper, 8) jointly collected waste comprising the following fractions: plastics, composite packaging waste and metals, 9) glass, 10) biowaste, 11) furniture and other bulky waste, 12) waste tyres, /NOTE – the Contracting Authority informs that the Contractor is obliged to collect waste tyres originating from households, in particular from passenger cars, motorcycles, mopeds, scooters and bicycles, regardless of the degree of wear, damage, cutting, deformation or absence of tread./ 13) waste not qualifying as medical waste generated in the household as a result of administering medicinal products by injection and monitoring the levels of substances in the blood, in particular needles and syringes, 14) textile and clothing waste, 15) waste batteries and accumulators, 16) waste electrical and electronic equipment. IV. Containers used for collecting municipal waste: 1. Non-segregated (mixed) municipal waste will be collected: a) from single-family residential properties in containers with capacities of: 80 l, 120 l, 240 l, b) from multi-unit residential properties in containers with capacities of 240 l and 1100 l. 2. Ash from domestic furnaces from inhabited properties, both single-family and multi-family residential properties, will be collected in containers with a capacity of 240 l. 3. Single-family residential properties are equipped by the Contracting Authority with containers for non-segregated (mixed) municipal waste and containers for ash. 4. The Contractor shall equip multi-unit residential properties with containers with capacities of 1100 l or 240 l for the following waste: non-segregated (mixed) and segregated: paper, glass, plastics, bio and ash. 5. The Contracting Authority reserves the right to additionally equip multi-family residential properties with additional containers. Waste containers should be new or in good technical condition (used), meeting the applicable standards. Used containers may be installed; however, they must be fit to receive waste, i.e.:  they may not bear traces of previous use,  the containers must be clean,  the containers and container lids may not show signs of cracks or damage,  the container wheels must be functional enough to allow them to be moved without difficulty,  the containers should have functional wheel locks. 6. The initial equipping of multi-unit residential properties with containers for non-segregated (mixed) waste, containers for segregated waste and containers for ash should take place within 3 days of conclusion of the contract, and subsequently should be carried out on an ongoing basis throughout the entire term of the contract. 7. Segregated waste will be collected from single-family residential properties in 120 l bags according to the following colour scheme:  glass – green,  plastics, composite packaging, metals – yellow,  paper – blue,  biowaste – brown. 8. Each month during waste collection, starting from December 2026, the Contractor shall provide each property covered by collection with new bags for collecting segregated waste (yellow, green, blue, brown) in a quantity corresponding to the number of bags put out. If, during collection, the property owner reports a need for additional bags due to an increased quantity of segregated waste generated, the Contractor shall provide additional bags in the quantity necessary to collect the waste Procedure: open.
