The subject of the contract is the comprehensive execution of a project involving the construction of a sanitary sewerage network in Zgorzałe, Stężyca, Szymbark. The subject of the contract is the construction of a gravity sanitary sewerage network and a pressure sewerage network together with sewage pumping stations. The scope of the works includes the construction of pipelines together with inspection chambers, installation of sewage pumping stations, construction of electrical installations and pumping station control systems, earthworks, restoration of surfaces, together with the performance of the necessary tests, examinations and commissioning. A detailed description of the contract has been included in the attachment to the SWZ. In order to calculate the tender price correctly, the Contractor is obliged to familiarise itself with all documentation attached to these proceedings and to make every effort to prepare the tender correctly and calculate the tender price reliably. The contract is being implemented as part of the project: “Expansion of the sewerage system in the Stężyca municipality”. Source of funding: European Funds for Pomerania 2021–2027, measure FEPM.02.12, and the Contracting Authority’s own funds. Agreement No FEPM.02.12IZ.000003/2500 on co-financing the Project: “Expansion of the sewerage system in the Stężyca municipality” This contract is part of a larger contract. Each part is the subject of a separate procedure. The value of the entire investment exceeds the amount specified in the provisions referred to in Article 3(1) of the Pzp. The Contractor may submit one tender. The tender shall be prepared in Polish, under pain of nullity, in electronic form and shall bear a qualified electronic signature in accordance with Article 63(1) of the Pzp. Detailed requirements concerning construction progress, stages and requirements concerning the Schedule have been set out in the draft agreement constituting an attachment to the SWZ. Documents constituting the tender that must be submitted: • Tender form (Attachment No 1), • JEDZ declaration concerning the absence of grounds for exclusion from the procedure and fulfilment of the conditions for participation in the procedure. Where Contractors jointly apply for the contract, each Contractor shall submit a JEDZ declaration. These declarations confirm the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure to the extent that each Contractor demonstrates fulfilment of the conditions for participation in the procedure. • Power of attorney authorising submission of the tender, if the tender is submitted by an authorised representative; • Bid bond – if submitted in the form of a guarantee or surety in accordance with the conditions specified in the SWZ. • Commitment of the entity making resources available and the entity’s JEDZ declaration concerning the absence of grounds for exclusion and fulfilment of the conditions – if applicable. • Contractors jointly applying for the award of the contract shall attach to the tender a declaration indicating which services will be performed by the individual contractors. Qualified signatures used by Contractors to sign any files must meet the requirements of the “Regulation of the European Parliament and of the Council on electronic identification and trust services for electronic transactions in the internal market (eIDAS) (EU) No 910/2014 from 1 July 2016. Permissible amendments to the provisions of the concluded agreement are possible within the scope specified in the model agreement. A material amendment to the provisions of the concluded agreement requires written form (an annex to the agreement) under pain of nullity and requires acceptance by each Party to the agreement. Permissible amendments to the agreement are also specified in Article 455 of the PZP. The Contracting Authority anticipates the implementation of contracts involving the repetition of similar construction works. The scope of the contract will not exceed 20% of the value of the basic contract and will consist of the performance of similar works covered by the basic contract and consistent in terms of subject matter, in particular: earthworks – excavations, construction of a sanitary sewerage network, construction of chambers, construction of connections, construction of water supply networks, construction of sewage pumping stations, performance of works concerning technological installations and electrical and automation installations necessary for the proper operation of the pumping stations, development of the pumping station site, performance of construction works related to the restoration of surfaces, including paved surfaces. The Contracting Authority will award the contract under a negotiated procedure without prior publication, provided that a need arises on the part of the Contracting Authority and funds are secured for this purpose, following negotiations with the Contractor. Information concerning the Contractor’s conduct of a site visit or its inspection of documents necessary for the performance of the contract, as referred to in Article 131(2) of the PZP Act: The Contracting Authority does not impose such requirements. The Contracting Authority anticipates applying the reversed order of tender evaluation in accordance with Article 139(1) of the PZP: The Contracting Authority may first examine and evaluate the tenders and then assess the qualitative selection criteria of the Contractor whose tender received the highest evaluation.
