1. The subject of the contract is the winter maintenance of roads in the city of Biała Podlaska in the 2026-2027 season, carried out in accordance with Order No. 118/24 of 11.06.2024 of the Mayor concerning the introduction of winter maintenance guidelines

1. The subject of the contract is the winter maintenance of roads in the city of Biała Podlaska in the 2026-2027 season, carried out in accordance with Order No. 118/24 of 11.06.2024 of the Mayor concerning the introduction of winter road maintenance guidelines (ZUD). 2. Name(s) and code(s) of the Common Procurement Vocabulary: (CPV): 90620000-9 – Snow-clearing services, 90630000-2 – Ice-clearing services. 3. The winter season lasts from 01 November 2026 to 31 March 2027. 4. Minimum standards for road maintenance in the city: 1) roads covered by the first priority of winter maintenance: a) national road – enhanced standard 2; b) voivodeship roads – ordinary standard 2; c) district roads – standard 3; d) municipal roads – standard 3; 2) roads covered by the second priority of winter maintenance – standard 4; 3) roads designated for sanding – standard 4; 4) access (service) roads of the national road – standard 4; 5) unpaved roads – standard 6; subject to paragraph 6 point 1. 6) The list of roads and the statement of surface areas: a) the national road with connecting roads constitutes Annex No. 1 to the SWZ; b) access (service) roads to the national road, cleared of snow exclusively at the Contracting Authority’s instruction, constitute Annex No. 2 to the SWZ; c) streets covered by the first priority of winter maintenance constitute Annex No. 3 to the SWZ; d) streets covered by the second priority of winter maintenance constitute Annex No. 4 to the SWZ; e) streets covered by snow clearing and sanding constitute Annex No. 5 to the SWZ; f) unpaved roads, cleared of snow exclusively at the Contracting Authority’s request, constitute Annex No. 6 to the SWZ; 5. The Contracting Authority reserves the right to change the list of roads assigned to each winter maintenance priority. A change to the list of roads does not require an annex to the contract. The Contractor will be notified of the change in writing. As of the specified date, the amended list of roads, to the extent of the change made, replaces its previous provisions. 6. The scope of the Contractor’s obligations depends on the standard of road maintenance in the city and includes the following activities: 1) snow clearing of street carriageways: 2) ensuring on an ongoing basis the passability of the streets specified in Annexes Nos. 1, 3, 4 and 5 (winter road maintenance standards 2 ÷ 4); 3) in the event of heavy snowfall, the permissible period during which streets are impassable may not exceed 4 hours for the streets listed in Annex No. 1 – access (service) roads, the national road, Nos. 4 and 5 (winter road maintenance standard 4); 4) in the event of particularly difficult weather conditions, periods during which streets are impassable are permitted in accordance with the winter road maintenance standards in Biała Podlaska; 5) ongoing removal of slipperiness by spreading a salt solution using a salt spreader on the streets specified in Annexes 1, 3 and 4 or, if necessary, spreading a sand-salt mixture; 6) combating slipperiness on the streets specified in Annex No. 5 by sanding; 7) in the event of heavy snowfall: a) removing snow from locations indicated by the Contracting Authority; b) clearing snow from unpaved roads indicated by the Contracting Authority; c) clearing snow from access (service) roads indicated by the Contracting Authority; 8) conducting the necessary round-the-clock duty shifts and inspections of surface conditions to determine whether the use of equipment is warranted; 9) The Contracting Authority reserves the right to forgo the Contractor’s performance of part of the services if any work is being carried out within the road right-of-way. 10) The winter maintenance standards for roads managed by the Mayor of Biała Podlaska are specified in Order No. 118/24 of the Mayor of Biała Podlaska of 11 June 2024 concerning the introduction of the “Winter Road Maintenance Guidelines,” constituting Annex No. 7 to the contract. 7. At its own expense, the Contractor shall provide premises and a yard for the purposes of conducting the ZUD operation and shall bear all costs related to maintaining these facilities during the contract performance period. 8. No later than 7 days before the start of the winter season, the Contractor is required to notify the Contracting Authority of its readiness for ZUD. Within 3 days of the notification, the Contracting Authority will inspect the equipment and accumulated materials. The inspection by the Contracting Authority covers the equipment specified in § 4 paragraph 12 of the draft contract and the quantities of accumulated materials in accordance with the ZUD guidelines.
