1. Winter maintenance of roads in the town and municipality of Pszczyna in the 2026/2027 season includes snow removal and combating winter slipperiness on roads (carriageways, sidewalks, bicycle paths, pedestrian and bicycle routes, bus bays and parking bays), parking lots, as well as the removal (transportation) of snow from indicated locations, and street sweeping after the winter period. 2. The detailed scope of the subject matter of the contract is specified in Annex No. 1 to the SWZ, i.e. the Detailed Technical Specification. The list of roads, sidewalks and parking lots subject to winter maintenance and the list of roads designated for sweeping after the winter season are specified in Annexes Nos. 8, 9, 10 and 11 to the SWZ. 3. Winter road maintenance services in the town of Pszczyna will be provided using plough carriers, in accordance with the submitted tender. 4. The Contracting Authority requires the installation, in the technical area of the plough carriers and carriers with a sand spreader that will perform work in the town of Pszczyna, of tracking devices transmitting current information and archived information from the last 60 days concerning the vehicle’s position together with its identifier. The tracking device must ensure buffering of location data in the event of a lack/loss of GSM coverage and its transmission immediately after the connection is restored. The Contractor shall provide the Contracting Authority with access data for the location system for the plough carriers before commencing provision of the service. If necessary, the Contractor shall provide training to an employee of the Contracting Authority in operating the program. 5. The Contractor shall provide an appropriate quantity of equipment for snow removal and combating slipperiness and an appropriate number of persons with the relevant qualifications necessary to perform the contract. 6. 6. The Contractor is required to have a Base within the Municipality of Pszczyna equipped with: a) a hardened, fenced yard for storing abrasive materials and chemical agents in such a manner that they are protected against the effects of moisture in specially prepared warehouses so that they do not lead to degradation of the natural environment. The warehouse should be located near the maintained roads so that its location does not cause delays in the operation of equipment on the roads. Materials stored in the warehouse should be roofed. The Contractor shall report (readiness) – the locations of the equipment facilities and the materials warehouse 7 days before the date of conclusion of the contract. b) a dispatch point (open throughout the provision of the service). The dispatcher should have access to information on the actual location of vehicles and have direct communication with each plough/spreader operator and with the Contracting Authority. The Contractor shall organize the base together with its equipment no later than 20 November 2025. 7. As part of the remuneration, the Contractor is required to purchase and store an appropriate quantity of chemical and abrasive materials used to combat slipperiness. The stock of materials for eliminating winter slipperiness must ensure continuity of work related to winter road maintenance. 8. If any third-party claims arising from services performed by the Contractor are brought against the Contracting Authority, the Contractor shall assume all liability and conduct of the case relating to the claim and shall settle such claims on its own if they are justified. The Contractor shall immediately notify the third party that it has assumed the claim. 9. The Contracting Authority shall not recognize any third-party claims arising in connection with services provided by the Contractor in respect of which the Contracting Authority would subsequently be entitled to a recourse claim against the Contractor. 10. The Contractor bears full liability toward residents and third parties for damage caused during performance of the service; in particular, it is liable for traffic-related damage resulting from vehicles participating in road traffic and property damage concerning the property of owners of real estate adjacent to the areas from which snow is removed, as well as any other damage. 11. The subject matter of the contract is financed from the budget of the Municipality of Pszczyna. 12. Requirements concerning the employment by the Contractor or Subcontractor of persons on the basis of an employment relationship. 12.1. Pursuant to Article 95(1) of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, under an employment contract, persons performing activities within the scope of performance of the contract in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277, as amended). The Contracting Authority requires the Contractor to employ persons performing the functions of Dispatchers under an employment contract. 12.2. During performance of the contract, the Contracting Authority is entitled to carry out inspections of the Contractor concerning compliance by the Contractor or Subcontractor with the requirement to employ under an employment contract the persons performing the activities indicated in point 12.1 of the SWZ. In particular, the Contracting Authority is entitled to: 1) request statements and documents confirming compliance with the above-mentioned requirements and assess them; 2) request explanations in the event of doubts concerning confirmation of compliance with the above-mentioned requirements; 3) conduct inspections at the place where the service is performed. 12.3. During performance of the contract, at each request of the Contracting Authority and within the time limit specified in that request, the Contractor shall submit to the Contracting Authority the evidence indicated below in order to confirm compliance with the requirement that the Contractor or Subcontractor employ under an employment contract persons performing the activities indicated in point 12.1: 1) statements by the contractor or subcontractor concerning the employment of an employee under an employment contract, 12.4. For failure by the Contractor or Subcontractor to comply with the requirement to employ under an employment contract persons performing the activities indicated in point 12.1, the Contracting Authority provides for a sanction in the form of an obligation for the Contractor to pay a contractual penalty in the amount specified in the draft contract constituting - Annexes No. 6 to the SWZ. 1.
