The contract for the services in question includes, among other things: − maintaining the passability of designated district roads by clearing snow with ploughs, − reducing slipperiness on district roads by spreading chemical agents and abrasive materials, - sweeping district roads, − the contract covers the entire area of Ostrołęka County. A map of the area constitutes an annex to the SWZ. The Contractor will perform the service in accordance with instructions issued by the Managers of the respective Road Districts by telephone for individual works, with the deadline for their completion being specified. (Note! The bills of quantities constitute an informational basis only, in accordance with the provisions of Chapter XV concerning the method of calculating the price). The Contractor is obliged to provide, on its own, all materials necessary for winter road maintenance. The materials should be stored in such a way that they are properly prepared for use, regardless of the prevailing weather conditions. The materials must be used in accordance with the Regulation of the Minister of the Environment (Journal of Laws of 2005, No. 230, item 1960) on the types and conditions of use of agents that may be used on public roads and on streets and squares. Motor vehicles used to perform winter road maintenance should be equipped with a yellow flashing warning light signal, in accordance with Article 54 of the Act of 20 June 1997, Road Traffic Law (consolidated text: Journal of Laws of 2024, item 1251, as amended), meeting the conditions specified in § 38 of the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text: Journal of Laws of 2016, item 2022, as amended). Parts of devices mounted on the vehicle that protrude beyond the vehicle outline should, however, meet the conditions specified in §39 of the aforementioned regulation. Motor vehicles and other equipment, as well as the materials used to perform winter road maintenance, should comply with all legal provisions concerning road travel and ensuring the safety of persons and vehicles travelling on the road and in its surroundings. The Contractor must have round-the-clock duty services responsible for accepting orders and providing reports on road passability, and must ensure telephone communication with equipment units. The Contractor bears full liability for damage caused by failure to provide services resulting from its own negligence or as a consequence of insufficient performance, or performance inconsistent with the applicable regulations and contractual conditions, of works related to winter road maintenance.
