Opportunity description

1. The subject matter of the contract is the performance of services falling within the scope of the contract entitled: “Winter maintenance of district and voivodeship roads in the 2026/2027 winter season”. Winter maintenance of voivodeship and district roads consists in particular in ensuring their passability and limiting disruptions to the flow of road traffic caused by precipitation, by preventing and eliminating winter slipperiness of roads and removing snow and slush, as well as ensuring the availability of specialist equipment and employees to operate it. 2. The scope of the contract includes: services using specialist equipment together with operator services and the preparation of a mixture for combating road slipperiness, in accordance with the requirements of the individual Road Districts. 3. The Contracting Authority’s requirements for the individual types of services covered by this contract are set out in the Price Calculation, constituting Appendices: Nos. 2A, 2B and 2C to the SWZ (for the individual parts of the contract). The quantities of services adopted in the Price Calculation are quantities estimated by the Contracting Authority, which will be ordered successively and, depending on the actual prevailing weather conditions, may be reduced or increased. In connection with the above: 1) the Contracting Authority reserves the possibility of: changes between the quantities of individual services presented in the Price Calculation, while maintaining the value of the maximum remuneration specified in § 5 sec. 1, 2) the Contracting Authority provides for the possibility of extending the scope of the contract through the exercise of the option right, consisting in increasing, during the performance period of the individual contracts, the quantitative scope of the contract, but not exceeding 70 % of the value of the contractual (basic) remuneration. 6. The Contracting Authority requires the Contractor to hold current civil liability insurance (OC) covering the business activity related to the subject matter of the contract, with a guaranteed sum of not less than PLN 1 000 000, 00 (one million zlotys 00/100). Before concluding the contract, the Contractor will be required to submit to the Contracting Authority a copy of the document confirming this fact). 7. The Contracting Authority requires the Contractor to employ, or ensure such employment by a Subcontractor, under an employment contract within the meaning of Art. 22 § 1 of the Act of 26 June 1974 – Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended), persons performing the following activities: clearing snow from roads, spreading sand and road salt to eliminate road slipperiness, equipment operators and drivers. 8. The detailed method of performing the subject matter of the contract is set out in the Draft contractual provisions, constituting Appendix No. 7 to the SWZ, and the Technical specification for winter road maintenance in the 2026/2027 winter season, which constitutes Appendix No. 11 to the SWZ. 9. The Contracting Authority divides the contract into three parts and thus permits the submission of partial tenders referred to in Art. 91 of the PZP Act. 10. In this procedure, the Contracting Authority will apply the procedure referred to in Art. 139 sec. 1 of the PZP Act (the so-called reverse procedure). First, the Contracting Authority will examine and evaluate the tenders and will then carry out the entity qualification of the contractor whose tender was rated highest, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure.
