1. The subject of the contract is the supply of software for the needs of the National School of Judiciary and Public Prosecution. 2. The subject of the contract has been divided into 2 parts: Part 1: Purchase of a subscription providing access to a graphics package; Part 2: Supply of an antivirus software package. 3. The description of the subject of the contract (hereinafter referred to as OPZ) is specified in detail in Appendix No. 2 to the SWZ and in Appendix No. 2A to the SWZ – “Equivalence criteria”. 4. The method of performance of the subject of the contract is specified in detail in the draft contractual provisions, which constitute, respectively, Appendix No. 3a to the SWZ (for Part 1) and Appendix No. 3b to the SWZ (for Part 2). 5. In cases where the procurement documents indicate trademarks, symbols, patents, origin, source or a particular process characterising specific products or services supplied by a particular Contractor, which would lead to certain Contractors or products being favoured or eliminated, this means that the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and comprehensible manner and this is justified by the specific nature of the subject of the contract. In such a case, the Contracting Authority permits the submission of tenders containing equivalent products. Any references to trademarks, patents, origin, source or a particular process must be read together with the words “or equivalent”, with the criterion used to assess equivalence being fulfilment of at least the same features (i.e. functional and performance characteristics) as those stated in the description of the subject of the contract, and technical parameters at least at the level indicated by the Contracting Authority (in this respect, the Contracting Authority also permits solutions better than those described by it, in particular those resulting from the modernisation of the technological production line). A Contractor offering equivalent products is obliged to prove in the tender, in particular by means of subject-matter evidence, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree. The Contractor is obliged to state in the tender the name of the equivalent product and the name of the manufacturer, and to demonstrate equivalence by specifying the characteristics of the equivalent product, in particular by means of information originating from the manufacturer, e.g. a product description or printout(s) from the manufacturer’s websites, or the manufacturer’s catalogue sheet, or a product description/technical specification, or other subject-matter evidence. The subject-matter evidence referred to above may not be supplemented. 6. In cases where the Contracting Authority describes the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 101 sec. 1 point 2 and sec. 3 of the Pzp Act, this means that it permits solutions equivalent to those described, and such reference is accompanied by the words “or equivalent”. A Contractor relying on equivalent solutions is obliged to demonstrate in the tender, in particular by means of subject-matter evidence, that the solution it offers meets the requirements specified by the Contracting Authority to an equivalent degree. The subject-matter evidence referred to above may not be supplemented. 7. The Contracting Authority intends to allocate the following amount for performance of the contract: PLN 34 597,32 gross, including: Part 1: PLN 21 121,00 gross, Part 2: PLN 13 476,32 gross. 8. In this procedure, communication between Contractors and the Contracting Authority will take place via the ProPublico online platform (hereinafter: the “Platform”) operating at https://e-propublico.pl. 9.
