The subject of the Contract is the supply and subsequent implementation of a Human Resources and Payroll System at the State Water Holding Polish Waters, together with Data Migration and Post-Implementation Assistance, as well as the provision of Maintenance Service and a Modification Service carried out under the option right, in accordance with the Contracting Authority’s requirements set out in the Description of the subject matter of the contract (Appendix No. 1 to the SWZ) and the Agreement (Appendix No. 10 to the SWZ). The Contracting Authority envisages the following stages of contract performance: Stage 0 – Project Preparation, Stage 1 – Analysis, Stage 2 – System Construction, Stage 3 – Training, Stage 4 – Production Launch, Stage 5 – Post-Implementation Assistance, Stage 6 - Maintenance Service. The Contracting Authority requires that the offered subject matter of the contract, including all ICT products, ICT services and ICT processes used to perform the contract, shall not include: a) ICT products*, ICT services or ICT processes indicated in the recommendation referred to in Art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system (Journal of Laws of 2026, items 20 and 252), stating their negative impact on the fundamental national security interest, b) an ICT product whose type has been specified in the decision on recognizing a supplier as a high-risk supplier, referred to in Art. 67b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system, or an ICT service or ICT process specified in that decision. If the Contractor offers a solution referred to in point 1) or 2) above, the tender will be rejected pursuant to Art. 226 sec. 1 point 17) or point 19) of the Pzp Act. The Contractor is obliged to submit, together with the Tender Form, a “List of ICT elements used during contract performance,” the template for which constitutes Appendix No. 2c to the SWZ. *ICT (from English: Information and Communication Technologies) – Information and Communication Technologies Procedure: open.
