The subject matter of the basic contract is the purchase (renewal of the subscriptions currently held by the Contracting Authority in the quantities described in Table No. 2 of the Description of the Subject Matter of the Contract) of subscriptions for the use of Red Hat software (based on open-source solutions), together with manufacturer support, in accordance with the manufacturer’s current licensing model. A detailed description of the subject matter of the contract, the list of tasks and deadlines, and the conditions for performance of the subject matter of the contract, payments, etc. are set out in the Draft Contractual Provisions (hereinafter: “PPU”), constituting Annex No. 2 to the SWZ, and in the Description of the Subject Matter of the Contract (hereinafter: “OPZ”), constituting Annex No. 1 to the SWZ. The Contracting Authority has divided the subject matter of the contract accordingly into the basic contract and the contract covered by the option right. The Contracting Authority provides for the possibility of exercising the option right consisting in the purchase of additional new Red Hat software subscriptions (based on open-source solutions), together with manufacturer support. The list of software subscriptions that may be purchased by the Contracting Authority under the optional part of the contract is provided in Table No. 3 of the Description of the Subject Matter of the Contract. Detailed information concerning the option, including its scope, the deadline for the Contracting Authority to exercise this entitlement, and the rules governing implementation of the Option, is set out in the PPU. The Contracting Authority states that the option right is an entitlement of the Contracting Authority which it may, but is not required to, exercise under this contract. Exercise of the option right, in whole or in part, is reserved to the sole discretion of the Contracting Authority. If the Contracting Authority does not exercise the option right in whole or in part, the Contractor shall not be entitled to additional remuneration or to any claim whatsoever. NOTE: The trademarks, patents, and places of origin indicated in this SWZ and the annexes to the SWZ are justified by the specific nature of the subject matter of the contract—they refer to the description of software operating within the Contracting Authority’s existing ICT infrastructure and its expansion. Whenever trademarks, patents or origin, sources or specific processes, as well as standards, technical assessments, technical specifications, and technical reference systems are used in the SWZ, including in the Description of the Subject Matter of the Contract, the Contracting Authority permits a solution equivalent to the one described. An equivalent product for the specified subject matter of the contract shall mean a product with the minimum parameters and requirements detailed (listed) and defined within the detailed scope in the OPZ. The Contracting Authority permits the submission of equivalent tenders, and all goods specified in the documentation as originating from particular manufacturers define the minimum quality parameters and functional characteristics that the goods must meet in order to satisfy the requirements established by the Contracting Authority and constitute solely a quality benchmark for the subject matter of the contract. By the provision concerning minimum quality parameter requirements, the Contracting Authority means the requirements for goods contained in publicly available sources, catalogs, and manufacturers’ websites. The use of manufacturers’ names as examples is intended solely to clarify the level of the Contracting Authority’s expectations with respect to a particular solution. When describing the subject matter of the contract and indicating a particular manufacturer’s designation or a particular product, the Contracting Authority also permits equivalent products with quality parameters and functional characteristics at least at the level of the parameters of the indicated product, thereby accepting any product with the indicated or better parameters. The use of manufacturers’/products’ names is solely illustrative. An equivalent quality standard shall mean one which confirms that the products supplied comply with specified standards or technical specifications, or certifies that the Contractor’s activities comply with quality standards, or certifies that the Contractor’s activities comply with equivalent quality standards referring to quality assurance systems based on the relevant European standards, or duly confirms the Contractor’s application of equivalent quality assurance measures. An equivalent quality standard shall mean one which confirms that the products supplied comply with specified standards or technical specifications, or certifies the Contractor’s compliance with specified quality management standards, including accessibility for persons with disabilities, or certifies the Contractor’s compliance with specified equivalent quality management standards, including accessibility for persons with disabilities, referring to quality management systems based on the relevant series of European standards and certified by accredited bodies. A Contractor relying on solutions equivalent to those described by the Contracting Authority is required to demonstrate that the equivalent solution it offers meets the requirements specified in the OPZ. Equivalence in terms of technical, functional, or operational parameters must, in particular, ensure the attainment of parameters no worse than those adopted by the Contracting Authority.
