Opportunity description

1. The subject matter of the contract is the delivery, installation and commissioning of VR software (simulator) for learning human anatomy. 2. The procedure is conducted under the project entitled ANTY DROP OUT ANS GNIEZNO FERS.01.05-IP.08-0161/25-00. Source of funding: The contract is financed under the project entitled ANTY DROP OUT ANS GNIEZNO FERS.01.05-IP.08-0161/25-00. 3. A detailed description of the subject matter of the contract is contained in Appendix No. 1 to the SWZ – “Description of the subject matter of the contract”. 4. The Contracting Authority imposes no restrictions regarding the origin of the Contractor or the subject matter of the contract in terms of market access and participation in this procedure. 5. The Contracting Authority does not allow the submission of tenders for individual lots. The subject matter of the contract constitutes a single functionally and technologically coherent undertaking. The individual elements of the contract are closely interconnected and mutually dependent. In the Contracting Authority’s opinion, not dividing the contract into lots does not restrict competition, while ensuring the proper, timely and safe performance of the contract. 6. Pursuant to Article 226(1)(19) of the Pzp Act, the Contracting Authority shall reject a tender if it includes an ICT product whose type has been specified in a decision recognizing a supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or an ICT service or ICT process specified in that decision. 7. The Contracting Authority does not allow the submission of variant tenders. 8. The Contracting Authority allows the submission of equivalent tenders. Equivalent solutions: 8.1. Whenever standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act are used in the description of the subject matter of the contract, the Contractor should assume that such a reference is accompanied by the words “or equivalent”. 8.2. A Contractor relying on an equivalent solution is required, pursuant to Article 101(5) of the Pzp Act, to prove in its tender that the solutions it proposes meet, to an equivalent degree, the requirements specified by the Contracting Authority in the Description of the subject matter of the contract. In such a case, the Contractor shall attach to the tender the method of demonstrating the equivalence of the solutions, together with its description or standards confirming that the proposed solutions meet, to an equivalent degree, the requirements specified in the Description of the subject matter of the contract. 8.3. If the Contracting Authority has doubts regarding the determination of the equivalence of the submitted tender, all obligations related to proving that the solutions proposed by the Contractor meet, to an equivalent degree, the requirements specified by the Contracting Authority in the description of the subject matter of the contract shall rest with the Contractor. 8.4. If the subject matter of the contract is described by reference to trademarks, patents or origin, source or a specific process that characterizes the products or services provided by a specific contractor, and the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and intelligible manner, such reference shall be accompanied by the words “or equivalent”. 8.5. Having regard to the provisions of the Pzp Act, the Contracting Authority allows the submission of equivalent tenders pursuant to Article 99(5) of the Pzp Act, treating the stipulated requirements and technical parameters defining the subject matter of the contract as the minimum equivalence criteria. 8.6. Demonstrating the equivalence of standards, technical assessments, technical specifications and technical reference systems is the responsibility of the Contractor and should be documented by the Contractor and submitted with the tender.
