1. The subject matter of the contract is: 1.1 the supply and implementation at the Mazovian Regional Occupational Medicine Centre SPZOZ in Płock of ERP-class software, hereinafter referred to as the Application Software, as part of the project entitled “Digital solutions for the Mazovian administration”, implemented under Priority FEMA.01 “European Funds for a more competitive and intelligent Mazovia”, Measure FEMA.01.02 “E-services” of the Regional Programme “European Funds for Mazovia 20212027”, under the partnership agreement concluded for the implementation of the Project “Digital solutions for the Mazovian administration” No B/UMWMUF/UM/CG/6/2025 dated 31.03.2025 between the Mazovian Voivodeship, with its registered office in Warsaw at ul. Jagiellońska 26, 03719 Warsaw, represented by the Management Board of the Mazovian Voivodeship, and the Mazovian Regional Occupational Medicine Centre (Independent Public Health Care Institution), 09402 Płock, ul. Kolegialna 17, represented by the acting Director of MWOMP. By an ERP system, the Contracting Authority means: Enterprise Resource Planning (ERP) System, a group of integrated IT systems (modularly organised IT systems) integrating traditional management functions related to financial and management accounting, finance, human resources and payroll, procurement, warehouse management, sales planning and execution, logistics, etc. In this document, it is synonymous with the “grey part”. 1.2 Integration of the Application Software with the systems owned and used by MWOMP: a) HIS – under the name MEDIQUS, produced by Gabos Software Sp. z o.o. b) EZD – Electronic Document Workflow, produced by Comarch S.A. c) Business Intelligence – produced by Gabos Software Sp. z o.o. / TDZ Technika dla zdrowia Sp. z o.o., together with the migration of data from the SYMFONIA system produced by SAGE SYMFONIA and used by MWOMP. The scope and rules of integration and data migration are described in Annex No 1 to the SWZ. 1.3 Granting a licence to use the Application Software, in accordance with Annexes No 1 and 6 to the SWZ. 1.4 Installation and commissioning of the supplied, integrated and modernised systems. 1.5 Implementation of the Application Software at MWOMP, in accordance with the description contained in Annex No 6 to the SWZ. 1.6 Provision by the Contractor of a quality guarantee for the completed subject matter of the Agreement (in accordance with the declared guarantee period in Annex No 2 to the SWZ – the minimum guarantee period is 36 months), as well as covering it with software maintenance during that period. The guarantee and software maintenance periods commence on the day following the date of signing the protocol referred to in § 7 of the draft agreement. 1.7 The conditions defining the Contractor’s obligations arising from the quality guarantee and software maintenance provided are contained in the draft agreement (Annex No 8 to the SWZ). 1.8 Other obligations of the Contractor specified by the Contracting Authority in the SWZ, in particular in the draft agreement. The procedure for the award of a classic contract with a value exceeding the EU thresholds is conducted as an open tender procedure referred to in Art. 132 of the PZP Act and in accordance with the requirements set out in these Terms of Reference, hereinafter referred to as the “SWZ”, and the partnership agreement for the implementation of the Project “Digital solutions for the Mazovian administration” No B/UMWMUF/UM/CG/6/2025 dated 31.03.2025 between the Mazovian Voivodeship, with its registered office in Warsaw at ul. Jagiellońska 26, 03719 Warsaw, represented by the Management Board of the Mazovian Voivodeship, and the Mazovian Regional Occupational Medicine Centre (Independent Public Health Care Institution), 09402 Płock, ul. Kolegialna 17, represented by the acting Director of MWOMP. 2. The activities undertaken by the Contracting Authority and Contractors in the procurement procedure are governed by the provisions of the aforementioned PZP Act and the Act of 23 April 1964, Civil Code (consolidated text of 25 July 2025, Journal of Laws of 2025, item 1071, as amended), unless the provisions of the Public Procurement Law provide otherwise. 3. The Contracting Authority provides for the procedure stipulated in Art. 139(1) of the PZP Act, which is described in § 32 of the SWZ. Procedure: open.
