1. The subject matter of the contract is the modernization of the network traffic security system by supplying licenses for internal software installed on Palo Alto Network devices already owned by the contracting authority, with the serial numbers indicated in Part IV of the SWZ; the licenses must cover the period until the expiry date of the current warranty and technical support for these devices, i.e. until 24.01.2030. The modernization of the security system also involves the supply of hardware components covered by the optional contract, which make it possible to increase the performance of the network traffic security system. 2. The detailed requirements concerning the subject matter of the contract constitute an integral part of the description of the subject matter of the contract and are contained in Part IV of the SWZ. 3. The subject matter of the contract must be covered by a warranty in accordance with the requirements specified in Parts III and IV of the SWZ. 4. The warranty period will be calculated from the date on which the handover and acceptance report for the subject matter of the contract is drawn up. 5. The supplied subject matter of the contract covered by the option must be brand-new, not displayed at exhibitions, complete and technically operational. The term “brand-new” shall mean the subject matter of the contract in its original packaging, unused before the date of delivery, except for use necessary to test its correct operation after manufacture. 6. The subject matter of the contract must be free from any physical and legal defects and third-party claims. 7. The supplied subject matter of the contract must originate from the manufacturer’s distribution channel that does not exclude distribution to the Polish market and ensures the exercise of warranty rights. 8. The subject matter of the contract must be supplied together with operating instructions, drivers and any accompanying software necessary for the proper use of the subject matter of the contract (to obtain the full functionality indicated in Part IV of the SWZ). The contracting authority will not be required to pay any additional amounts, in particular license fees, and any licenses will be granted as part of the contractor’s remuneration, without time or territorial limitations, unless expressly stated otherwise in Part IV of the SWZ. If licenses, codes or other rights are required to launch and use this software, they must be supplied at no additional charge. Codes, licenses and other rights must also be supplied when they are necessary to launch or configure hardware components. 9. The contracting authority requires that the offered subject matter of the contract, comprising ICT products, ICT services and ICT processes used to perform the contract, shall not include: • ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, stating their negative impact on the fundamental security interest of the state; • an ICT product whose type has been specified in the decision recognizing a supplier as a high-risk supplier, referred to in Art. 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. Failure to meet the above requirements will result in the rejection of the tender pursuant, as applicable, to Art. 226(1)(17) or (19) of the Pzp Act. 10. Whenever this SWZ refers to an ICT solution, ICT element, ICT product, ICT service or ICT process, this shall mean an ICT product, ICT service or ICT process referred to in the Act of 5 July 2018 on the National Cybersecurity System (hereinafter also referred to as the KSC Act). 11. Since the subject matter of the basic contract and the contract covered by the option right consists of licenses and hardware components and related software, both the main elements and the components, service delivery environment elements or accompanying solutions will therefore be subject to verification with regard to the requirements referred to in point I.3.11 of the SWZ. 12. Pursuant to Art. 441(1) of the Pzp Act, the contracting authority provides for the possibility of exercising the option right. The option consists of purchasing Networking Cards (a maximum of 2 units) and Data Processing Cards (a maximum of 6 units).
