Opportunity description
The subject matter of the contract is the supply and installation, in individual households and public utility buildings, of Renewable Energy Source installations (photovoltaic cells with energy storage systems) within the Municipality and Town of Odolanów as part of the investment task entitled “Investment activities relating to the construction of infrastructure for the Energy Cluster of the Municipalities of Odolanów, Przygodzice, Sulmierzyce”. The task is being implemented under the “design and build” formula on the properties of residents of the Municipality and Town of Odolanów and in Public Utility Buildings, under agreement No KPOD.03.12-IP.05-0022/24, project entitled “Investment activities relating to the construction of infrastructure for the Energy Cluster of the Municipalities of Odolanów, Przygodzice, Sulmierzyce”, co-financed under Investment B2.2.2/G1.1.2 of the National Recovery and Resilience Plan (KPO): Renewable energy installations implemented by energy communities, Part B: investment support for energy communities. 5.1. 1. The task has been divided into four parts. 1) Part one: Supply and installation of photovoltaic panels and energy storage systems for AREA 1 – ODOLANÓW. 2) Part two: Supply and installation of photovoltaic panels and energy storage systems for AREA 2 – BONIKÓW, GARKI, HUTA, NADSTAWKI, RACZYCE, ŚWIECA, UCIECHÓW, 3) Part three: Supply and installation of photovoltaic panels and energy storage systems for AREA 3 – BABY, GLIŚNICA, GORZYCE MAŁE, KUROCH, KACZORY, NABYSZYCE, TARCHAŁY MAŁE, TARCHAŁY WIELKIE, WIERZBNO. 4) Part four: Supply and installation of photovoltaic panels and energy storage systems for Public Utility Buildings of the Municipality and Town of Odolanów. 2. Information on the capacity and number of photovoltaic installations and the capacities and numbers of energy storage systems in the individual parts of the contract is specified in Annex No 11 to the SWZ. The information provided in this annex results from the funding application and residents’ declarations regarding participation in the project and may therefore change during the procedure or performance of the agreement. The Contracting Authority reserves the possibility of downward or upward adjustments under the option. The Contracting Authority guarantees implementation of the basic scope of a given part of the contract at a level no lower than 90 % of the total capacity of the photovoltaic installations and 90 % of the total capacity of the energy storage systems specified for that part of the contract in the SWZ. The Contracting Authority’s exercise of the option right consisting in reducing the material scope of the contract may not result in the total capacity of the photovoltaic installations or the total capacity of the energy storage systems intended for implementation falling below the above-mentioned level of 90 % of the basic scope. This means that the maximum reduction in the scope of the contract under the option right may amount, respectively, to no more than 10 % of the total capacity of the photovoltaic installations and no more than 10 % of the total capacity of the energy storage systems specified for the basic scope of a given part of the contract. If the scope of the contract is reduced, the Contractor’s remuneration will be reduced accordingly on the basis of the unit prices specified in the Contractor’s tender. 3. Description applicable to all parts: The scope of work for all parts of the contract includes preparing construction and detailed designs (a design for each construction facility), together with all arrangements, opinions, consents and decisions required by law, and notifying the micro-installation to the electricity grid, and, on that basis, performing all construction and installation work on residents’ properties and in public utility buildings, as well as fulfilling the remaining obligations specified in the PFU and the agreement, including conducting instructional training for facility users on operating the installations and servicing the installations during the guarantee and statutory warranty period. 5.2. Detailed description of the subject matter of the contract: - for tasks Nos 1, 2, 3, it is contained in the Functional and Utility Program prepared by PERSEM Sp. z o.o., ul. Kędzierzyńska 17A/102, 41-902 Bytom, constituting Annex No 12 to the SWZ., - for task No 4, it is contained in the Functional and Utility Program prepared by PERSEM Sp. z o.o., ul. Kędzierzyńska 17A/102, 41-902 Bytom, constituting Annex No 13 to the SWZ. The Contracting Authority has posted the SWZ and the annexes, which form an integral part thereof, on the website of the procedure. The Contractor’s rights and obligations also arise from the draft agreement constituting an annex to the SWZ. 5.3. The Contracting Authority provides for the possibility of convening a meeting of Contractors to clarify the content of the SWZ. The meeting date will be announced at a later date. The Contracting Authority will make information about the meeting date available on the website of the procedure. The meeting will take place at the registered office of the Municipal and Town Office of Odolanów, room 2.1 Conference Room (address: Rynek 1, 63-430 Odolanów). The description of the subject matter of the contract concerning equivalence, concerning art.100 sec. 1 of the Pzp Act, and concerning requirements for the conformity of ICT solutions is contained in point 5.4 of the SWZ. Pursuant to art.139 sec.1 of the Pzp Act, the Contracting Authority will first examine and evaluate the tenders and will then perform the qualitative selection of the Contractor whose tender was rated highest with respect to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. The Contracting Authority does not provide for advance payments toward performance of the contract. In accordance with art.455 sec.1 point 1 of the Pzp Act, the Contracting Authority provides for the possibility of amending the provisions of the concluded agreement. The proposed provisions concerning amendment of the public procurement agreement shall apply according to the rules, within the scope and in the cases specified in the draft agreement, which constitutes an integral annex to the SWZ. The Contracting Authority permits the submission of partial tenders for individual parts of the contract, provided that Contractors may not subdivide those parts. No market consultations were conducted before the procedure was initiated. Supply and installation of photovoltaic panels and energy storage systems for AREA 1 - ODOLANÓW . I. Description: Part 1 of the task consists of the supply and installation of photovoltaic panels with a total capacity of 775,40 kWp and energy storage systems with a total capacity of 1258 kWh for 199 households of residents of the Municipality and Town of Odolanów. The Contracting Authority specifies: - the approximate number of installations located on the roofs of residential/farm/garage buildings - 168 installations, - the approximate number of installations located on the ground – 31 installations. Depending on technical conditions, if it is not possible to install an installation on the roofs of residential/farm/garage buildings, the investment will be located on converted land on the plot adjacent to the residential building. The Contracting Authority reserves the right to change the indicated locations or installation capacity and storage capacity if a resident withdraws from the installation of a given installation or if it is technically impossible to construct the installation at a given location. In such a case, either a new location will be specified together with the type of installation and storage capacity from among the types of installations indicated in the annex to the tender and a storage capacity of 6 or 10 kWh, or the scope of the contract will be reduced under the option or by an amendment to the agreement. II. OPTION with respect to part 1 of the task. 1. The Contracting Authority reserves the possibility of exercising the option right referred to in art. 441 sec. 1 of the Pzp Act, within the scope described below: 1.1. The Contracting Authority reserves the possibility of increasing or reducing the material scope of the contract with respect to the number or capacity of photovoltaic installations and the number or capacity of energy storage systems. The basic scope of the contract covering part 1 of the task comprises the supply and installation of 199 photovoltaic installations and energy storage systems with a total capacity of 775,40 kWp and energy storage systems with a total capacity of 1258 kWh. Under the option: 1. The Contracting Authority may increase: 1) the total capacity of the photovoltaic installations by a maximum of 198 kWp by adding new locations within the types of installations specified in Annex No 11 to the SWZ, 2) the total capacity of the energy storage systems by a maximum of 330 kWh by adding new locations within the types of installations specified in Annex No 11 to the SWZ. 2. The Contracting Authority may reduce: 1) the total capacity of the photovoltaic installations by a maximum of 42 kWp by withdrawing from current locations, 2) the total capacity of the energy storage systems by a maximum of 70 kWh by withdrawing from current locations. 1.2. The Contractor’s remuneration will be increased or reduced accordingly on the basis of the unit prices specified in the tender form, expressed as a price per 1 kWp for photovoltaic installations and per 1 kWh for energy storage systems. 1.3. The Contracting Authority is not obliged to exercise the option right, and the Contractor shall have no claim for an additional or reduced order. 1.4. The Contracting Authority provides for the possibility of exercising the Option in the event of: 1. an increase in the basic material scope of the contract specified in the SWZ for a given part as a result of savings generated, i.e. where the price of the most advantageous tender is lower than the amount allocated for performance of the task, 2. the possibility of increasing the basic material scope of the contract specified in the SWZ as a result of residents withdrawing or the technical impossibility of locating an installation (storage system) on the ground or on a building in another part of the contract awarded on the basis of this procedure, 3. a reduction in the basic material scope of the contract specified in the SWZ as a result of: a) residents withdrawing from participation in the project for various reasons, b) the technical impossibility of locating an installation on the ground or on a building, or a change in that location relative to the declared location, 1. 5. Time limit for exercising the option right: The Contracting Authority may exercise the option right during the term of the agreement. Exercise of the option right will consist in submitting a declaration to the Contractor that the option right is being exercised; this declaration will also specify the scope of the contract covered by the option right. The Contracting Authority may submit declarations that it is exercising the option right multiple times until the material scope covered by the option right has been exhausted. If the Contracting Authority submits such a declaration, then, in the event of an increase in the material scope, the Contractor is obliged to perform, during the period from the date of receipt of the declaration until the end of the term of the agreement, the entire material scope ordered by the Contracting Authority under the option. The place of implementation of the option will be the entire area of the Municipality and Town of Odolanów. Therefore, a contractor performing parts 1 to 3 of the contract will be obliged to perform the increased scope of the contract extending territorially beyond the area of its part but within the administrative boundaries of the Municipality and Town of Odolanów. I. Description: Part 2 of the task consists of the supply and installation of photovoltaic panels with a total capacity of 1075,60 kWp and energy storage systems with a total capacity of 1718 kWh for 269 households of residents of the Municipality and Town of Odolanów. The Contracting Authority specifies: - the approximate number of installations located on the roofs of residential/farm/garage buildings - 213 installations, - the approximate number of installations located on the ground – 56 installations. Depending on technical conditions, if it is not possible to install an installation on the roofs of residential/farm/garage buildings, the investment will be located on converted land on the plot adjacent to the residential building. The Contracting Authority reserves the right to change the indicated locations or installation capacity and storage capacity if a resident withdraws from the installation of a given installation or if it is technically impossible to construct the installation at a given location. In such a case, either a new location will be specified together with the type of installation and storage capacity from among the types of installations indicated in the annex to the tender and a storage capacity of 6 or 10 kWh, or the scope of the contract will be reduced under the option or by an amendment to the agreement. II. OPTION with respect to part 2 of the task. 1. The Contracting Authority reserves the possibility of exercising the option right referred to in art. 441 sec. 1 of the Pzp Act, within the scope described below: 1.1. The Contracting Authority reserves the possibility of increasing or reducing the material scope of the contract with respect to the number or capacity of photovoltaic installations and the number or capacity of energy storage systems. The basic scope of the contract covering part 2 of the task comprises the supply and installation of 269 photovoltaic installations and energy storage systems with a total capacity of 1075,60 kWp and energy storage systems with a total capacity of 1718 kWh. Under the option: 1. The Contracting Authority may increase: 1) the total capacity of the photovoltaic installations by a maximum of 204 kWp, by adding new locations within the types of installations specified in Annex No 11 to the SWZ, 2) the total capacity of the energy storage systems by a maximum of 340 kWh by adding new locations within the types of installations specified in Annex No 11 to the SWZ. 2. The Contracting Authority may reduce: 1) the total capacity of the photovoltaic installations by a maximum of 36 kWp by withdrawing from current locations, 2) the total capacity of the energy storage systems by a maximum of 60 kWh by withdrawing from current locations. 1.2. The Contractor’s remuneration will be increased or reduced accordingly on the basis of the unit prices specified in the tender form, expressed as a price for 1 kWp for photovoltaic installations and per 1 kWh for energy storage systems. 1.3. The Contracting Authority is not obliged to exercise the option right, and the Contractor shall have no claim for an additional or reduced order. 1.4. Description: Part 3 of the task consists of the supply and installation of photovoltaic panels with a total capacity of 642,80 kWp and energy storage systems with a total capacity of 1010 kWh for 159 households of residents of the Municipality and Town of Odolanów. The Contracting Authority specifies: - the approximate number of installations located on the roofs of residential/farm/garage buildings - 118 installations, - the approximate number of installations located on the ground – 41 installations. Depending on technical conditions, if it is not possible to install an installation on the roofs of residential/farm/garage buildings, the investment will be located on converted land on the plot adjacent to the residential building. The Contracting Authority reserves the right to change the indicated locations or installation capacity and storage capacity if a resident withdraws from the installation of a given installation or if it is technically impossible to construct the installation at a given location. In such a case, either a new location will be specified together with the type of installation and storage capacity from among the types of installations indicated in the annex to the tender and a storage capacity of 6 or 10 kWh, or the scope of the contract will be reduced under the option or by an amendment to the agreement. II. OPTION with respect to part 3 of the task. 1. The Contracting Authority reserves the possibility of exercising the option right referred to in art. 441 sec. 1 of the Pzp Act, within the scope described below: 1.1. The Contracting Authority reserves the possibility of increasing or reducing the material scope of the contract with respect to the number or capacity of photovoltaic installations and the number or capacity of energy storage systems. The Contracting Authority may increase: 1) the total capacity of the photovoltaic installations by a maximum of 198 kWp by adding new locations within the types of installations specified in Annex No 11 to the SWZ, 2) the total capacity of the energy storage systems by a maximum of 330 kWh by adding new locations within the types of installations specified in Annex No 11 to the SWZ. 2. Description: Part 4 of the task consists of the supply and installation of photovoltaic panels with a total capacity of 377,2 kWp for 12 public utility buildings of the Municipality and Town of Odolanów and energy storage systems for 11 public utility buildings of the Municipality and Town of Odolanów with a total capacity of 378 kWh. The Contracting Authority specifies: - the number of installations located on the roofs of public utility buildings - 8 installations, - the number of installations located on the ground – 4 installations, - the number of energy storage systems -11. The Contracting Authority reserves the right to change the installation capacity or storage capacity if the price offered is lower than the amount allocated to finance the contract. In such a case, the installation capacity or storage capacity may be changed within the types of installations indicated in the annex to the tender. II. OPTION with respect to part 4 of the task. 1. The Contracting Authority reserves the possibility of exercising the option right referred to in art. 441 sec. 1 of the Pzp Act, within the scope described below: 1.1. The Contracting Authority reserves the possibility of increasing the capacity of photovoltaic installations and the capacity of energy storage systems. The basic scope of the contract covering part 4 of the task comprises the supply and installation of 12 photovoltaic installations and 11 energy storage systems with a total capacity of 377,2 kWp and energy storage systems with a total capacity of 378 kWh. Under the option: 1. The Contracting Authority may increase: 1) the total capacity of the photovoltaic installations by a maximum of 200 kWp, 2) the total capacity of the energy storage systems by a maximum of 200 kWh. 1.2. The Contractor’s remuneration will be increased accordingly on the basis of the unit prices specified in the tender form, expressed as a price per 1 kWp for photovoltaic installations and 1 kWh for energy storage systems. 1.3. The Contracting Authority is not obliged to exercise the option right, and the Contractor shall have no claim for an additional order. 1.4. The Contracting Authority provides for the possibility of exercising the Option in the event of: 1. an increase in the basic material scope of the contract specified in the SWZ as a result of savings generated, i.e. where the price of the most advantageous tender is lower than the amount allocated for performance of the task, 1. 5.
