1. The subject of the contract is the purchase and installation of photovoltaic installations and electrical energy storage systems at public facilities in the Municipality of Myszków (including design, delivery, installation and commissioning), in the following quantities:

1. The subject of the contract is the purchase and installation of photovoltaic installations and electrical energy storage systems at public facilities in the Municipality of Myszków (including design, delivery, installation and commissioning), in the following quantities: - number of photovoltaic installations: 8 units, - number of electrical energy storage systems: 18 units, - number of buildings covered by the project: 7 buildings. 2. The subject of the contract has been described in detail in Annex No. 1 to the SWZ – Functional and Utility Program, constituting the description of the subject of the contract for this procedure. 3. Type of contract: supplies. 4. The Contracting Authority does not specify accessibility requirements for persons with disabilities, as the nature of this contract does not determine the occurrence of accessibility requirements for persons with disabilities. 5. In each case where the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and Article 101(3) of the Pzp Act, the Contracting Authority permits solutions equivalent to those described, and such reference shall be accompanied by the words “or equivalent”. 6. If certificates issued by a specific conformity assessment body referred to in Article 105(2) of the Pzp Act are required to be submitted, the Contracting Authority shall also accept certificates issued by other equivalent conformity assessment bodies. 7. A conformity assessment body referred to in Article 105(2) of the Pzp Act shall mean a body performing conformity assessment activities, including calibration, testing, certification and inspection, accredited in accordance with Regulation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 (Official Journal of the EU L 218, 13.08.2008, p. 30). 8. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key tasks, under the procedure specified in Article 121 of the Pzp Act, concerning work related to the placement of equipment and its installation under the contract in question. 9. The Contractor may entrust the performance of part of the contract to a subcontractor. The Contracting Authority requires the Contractor to indicate, in the tender, the parts (scopes) of the contract that it intends to entrust to subcontractors and to provide the names of any subcontractors, if already known. For this purpose, the Contractor should provide the relevant information in the tender form constituting Annex No. 3 to the SWZ. If the Contractor does not intend to perform the contract with the participation of subcontractors, it should enter “not applicable” or another similar phrase in the appropriate place in the tender form table. 10. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract. 11. Reasons for not dividing the awarded contract into lots. The contract is awarded in two parts constituting the subject of separate procedures. The initiation and conduct of two separate procedures comprising the entire contract is due to the specific nature and material scope of the supplies under the renewable energy project. Further division of the awarded contract into lots would cause difficulties in performing the contract with regard to coordination and achieving the designed parameters, as well as an increase in investment costs; in particular, if the task were divided into supply and then installation, there would be a problem of “dilution” of the Contractors’ warranty liability. One Contractor would bear warranty liability for the equipment supplied (photovoltaic modules, inverters, energy storage systems), while the other would bear liability for its installation. If defects occurred, the Contractor that performed the supply could claim that the defects were the result of faulty installation, while the Contractor that performed the installation could claim that the defects resulted from the equipment supplied. This would create a high risk that the costs arising from a lack of coordination between supply and installation would be borne by the Contracting Authority. Nor is there any rational justification for dividing the contract into lots based on a division of the scope of the contract. Such a division would increase the prices of the equipment and the costs of its installation, which means that it is therefore not justified from an economic point of view (with a larger scope of the contract, economies of scale reduce the tender price). 12. The contract will be implemented under the National Recovery and Resilience Plan, Investment B2.2.2, Renewable energy installations implemented by energy communities, Part B: investment support for energy communities, Measure B.1: Demonstration investment projects implemented by energy communities.
