The subject matter of the contract is being implemented under a targeted grant awarded by the Łódź Voivode to Radomsko County for the purpose of financing its own tasks carried out under the OLiOC programme, the implementing entity of which is a local government unit and/or another implementing entity designated by the local government unit 1. The subject matter of the contract is: Purchase, installation and connection of an energy storage system to the grid. The Contractor undertakes to design, supply and execute, together with commissioning, an energy storage system integrated with the Contracting Authority's power installation, including the existing renewable energy source, in accordance with the requirements specified in the Procurement Specifications (hereinafter SWZ), in particular the Description of the Subject Matter of the Contract contained in the SWZ. 2. The subject matter of the contract is described by means of design documentation, which includes: 1) Technical specifications for the execution and acceptance of works – Appendix No. 7 to the SWZ 2) CONSTRUCTION DESIGN Construction of a photovoltaic installation with a capacity of up to 1 MW as part of the task “PV installations and energy storage system for the County Hospital in Radomsko” – Appendix No. 10 to the SWZ VOLUME I Site development design VOLUME II Architectural and construction design VOLUME III Appendices to the construction design 3) Decision No. 625/2025 of 28 October 2025, building permit for 6 modular shelters and a photovoltaic installation with a capacity of up to 1 MW as part of the task ‘PV installation and energy storage system for the County Hospital in Radomsko - Appendix No. 11 to the SWZ 3. Details of the scope of work and the contractor's obligations are specified in Appendix No. 2 to the SWZ – draft contract. 4. Justification for the reasons for not dividing the contract into lots: The subject matter of the contract is the supply of an energy storage system, and the performance of this supply must be preceded by amendments to the design documentation held by the Contracting Authority and the obtaining of a decision amending the existing building permit so that this documentation corresponds to the energy storage system offered by the contractor and the description contained in the description of the subject matter of the contract (OPZ) prepared by the Contracting Authority. This necessitates commissioning the contractor responsible for supplying the energy storage system to perform ancillary design activities. The construction works involved are also merely ancillary, are associated with the specific device to be supplied by the energy storage system supplier, and are not independent in nature. In addition, the contracting authority has a single deadline for completion of the entire task, which also justifies awarding the entire contract to one contractor. Obtaining a single quality guarantee for the entire task strengthens the protection of the Contracting Authority. 5. All requirements specified in the documents indicated above constitute minimum requirements, and compliance with them is mandatory. Failure to meet the above minimum requirements will result in rejection of the tender as non-compliant with the procurement conditions pursuant to Article 226(1)(5) of the Public Procurement Law. 7. Whenever the documentation indicates the names of construction products, materials and equipment, as well as any wording that may indicate a specific manufacturer, it should be borne in mind that these were used as examples for the purpose of preparing the documentation. The parameter values in the documentation should be treated as the minimum required by the contracting authority. They indicate the minimum product quality, durability, safety, physical characteristics and functionality parameters and are not absolutely binding (equivalent solutions described in Appendix No. 7 to the SWZ – technical specifications are permitted). Equivalent solutions may not be inferior to those specified in the design documentation. Proposing equivalent solutions is permitted provided that they guarantee that the subject matter of the contract will achieve overall performance and functionality parameters no worse than those assumed in the design and technical documentation, which means achieving identical or better values. 1.
