1. The subject matter of the contract is the delivery of a used sewer-cleaning vehicle and the sale of a vehicle with the same function used by the Contracting Authority since 2016. 2. Brief description of the vehicle to be delivered: a. Chassis mileage not exceeding 50,000 km b. Suction pump max 670 mth c. Pressure pump max 550 mth d. Rotary pump max 170 mth e. Power take-off max 1300 mth f. First registration of the vehicle no earlier than in 2024 3. Brief description of the vehicle subject to buyback: a. Chassis mileage 58 444 km b. MAN TGS 6x4 chassis with KROLL K1,0-11,0/29P bodywork, 1. The subject matter of the contract is the delivery of a used sewer-cleaning vehicle and the sale of a vehicle with the same function used by the Contracting Authority since 2016. 2. Performance of the subject matter of the contract shall take place at the Supplier's cost and risk. 3. Under the contract, the Supplier is obliged to deliver, commission and conduct a test drive of the vehicle delivered as a result of this procedure, with parameters compliant with the tender submitted in this procedure. 4. The Contracting Authority requires the delivered vehicle to be complete and ready for operation, without any additional purchases or investments. 5. The Contracting Authority declares that the vehicle being sold is complete and ready for operation, and that its technical condition shows normal signs of use consistent with the vehicle's year of manufacture, and guarantees that the vehicle has the documents required by law permitting it to be driven in the territory of the Republic of Poland in accordance with the applicable provisions of law. 6. The Supplier guarantees that the delivered vehicle has the documents required by law permitting it to be driven in the territory of the Republic of Poland in accordance with the applicable provisions of law. 7. The Parties undertake to train the Parties' personnel in the use of the vehicles. 8. The offered subject matter of the contract to be delivered should meet the legal and technical requirements contained in the currently applicable provisions of law, in particular in: a) the Act of 20 June 1997, Road Traffic Law, b) the provisions concerning the technical conditions of vehicles and the scope of their necessary equipment, c) if applicable – it should have valid type-approval for a completed vehicle, in accordance with the applicable provisions of law. 9. Delivery location: Miejskie Zakłady Komunalne Sp. z o.o., ul. Mikołaja Kopernika 4a, 66-470 Kostrzyn nad Odrą. 10. The Contracting Authority requires the following to be delivered together with the vehicle no later than on the date of acceptance: - operating instructions for the chassis and bodywork, in Polish, - service books for the chassis and bodywork with the service and repair history, - at least two sets of keys enabling the vehicle to be opened and started, - all necessary documents meeting the requirements of the Road Traffic Law Act, the Road Transport Act and related acts, enabling the vehicle to be registered, including a current technical inspection, registration certificate, and third-party liability insurance.
