Poland – Special-purpose road passenger-transport services – SANITARY TRANSPORT SERVICE FOR PATIENTS BY A TYPE P BASIC TEAM USING TYPE C AMBULANCES

Opportunity description

1. The subject matter of the contract is a sanitary transport service for patients by a type P basic team using type C ambulances. 2. Name of the subject matter according to the Common Procurement Vocabulary: CPV 60130000-8 – special-purpose road passenger-transport services, CPV 60170000-0 – hire of passenger transport vehicles with driver. 3. A detailed description of the subject matter of the contract, estimated quantities and the conditions under which the subject matter of the contract will be performed are specified in the attachments (description of the subject matter of the contract, draft contract, tender form). 4. As part of the service provided, the Contractor is obliged to apply and comply with the provisions of law applicable to the subject matter of the contract, hold the relevant authorizations and bear full responsibility in the event of their violation. 5. Pursuant to Art. 95(1) of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ, under an employment contract within the meaning of the Act of 26 June 1974, Labour Code Labour Code (Journal of Laws of 2019, items 1040, 1043 and 1495), continuously throughout the entire term of the Contract, the person/persons performing dispatcher duties in the performance of the subject matter of the contract. In connection with the above, during the performance of the contract, the Contracting Authority is entitled to carry out inspections of the Contractor regarding compliance by the Contractor or Subcontractor with the requirement to employ under an employment contract the persons performing the above-mentioned activities in the performance of the subject matter of the contract. 6. No later than before conclusion of the contract, the Contractor shall provide the Contracting Authority with a declaration confirming compliance with the requirement referred to in paragraph 5, i.e. that the person/persons performing activities related to the performance of the subject matter of the contract will be employed under an employment contract within the meaning of the Act of 26 June 1974, Labour Code. 7. At every stage of contract performance, the Contracting Authority has the right to verify the declaration of the contractor/subcontractor (concerning the form of employment of the persons referred to in paragraph 5). For this purpose, it is entitled in particular to request the competent labour inspectorate to conduct an inspection. 8. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Art. 94 of the Public Procurement Law. 9. The Contracting Authority does not impose the requirements referred to in Art. 96 of the Public Procurement Law. 10. The Contractor is required to hold voluntary third-party liability insurance with a value of no less than PLN 1,000,000.00. No later than before conclusion of the contract, the Contractor shall provide the Contracting Authority with documents confirming compliance with this requirement. Procedure: open.
