The subject matter of the procedure and the contract is the selection of a Contractor for the supply of platform 4 comprising a vibrational circular dichroism (VCD) spectrometer together with a sample preparation station as part of the undertaking entitled "Establishment of the Laboratory of Biomedical Application Spectroscopy (LBSA) implemented under the National Recovery and Resilience Plan, Component D Efficiency, accessibility and quality of the healthcare system, Investment D3.1.1 Comprehensive development of research in medical sciences and health sciences, financed from the European Funds for Małopolska 2021-2027 (European Regional Development Fund). Number of the agreement covering the Undertaking with support: FEMP.01.04-IZ.00-0269/24-00-XXI/57/FE/25, respectively with regard to one to four lots of the contract. 1.1 Pursuant to Article 257 of the Public Procurement Law, the Contracting Authority provides for the possibility of cancelling this procedure if the public funds that the Contracting Authority intended to allocate to finance the contract have not been awarded to it. 1.2 The subject matter of the contract is divided into four lots: 1.2.1 For Lot I, the subject matter of the contract is the supply of a VCD Spectrometer together with accompanying equipment; 1.2.2 For Lot II, the subject matter of the contract is the supply of Weighing Equipment; 1.2.3 For Lot III, the subject matter of the contract is the supply of Sample Preparation and Dispensing Equipment; 1.2.4 For Lot IV, the subject matter of the contract is the supply of Refrigeration Equipment, cryogenic tanks and a water purification system. 1.3 A detailed description of the subject matter of the contract specifying the functions, technical parameters and required conditions of the subject matter of the contract is contained in Appendix A and/or Appendix B and/or Appendix C and/or Appendix D to the SWZ, i.e. Functions, technical parameters and required and additionally scored conditions, constituting an integral part of the SWZ. The Contracting Authority requires that all elements proposed by the Contractor be mutually compatible and ensure full functionality without the need for additional investment by the Contracting Authority. This description must be read together with any amendments to the content of the SWZ resulting, for example, from answers provided to Contractors' questions. 2. Together with the tender, the Contractor is required to submit: 2.1. a completed table of parameters: “Functions, technical parameters and required and additionally scored conditions”, Appendix A and/or Appendix B and/or Appendix C and/or Appendix D, 3.2. certificates of conformity or declarations of conformity in accordance with the applicable regulations, i.e. the Act of 30 August 2002 on the conformity assessment system (consolidated text, Journal of Laws 2023, item 215), confirming CE marking, or other equivalent documents or statements, or documents confirming that the certification procedure has commenced. If the certification procedure has not been completed, the certificate of conformity or declaration of conformity must be delivered no later than together with the delivery. The Contracting Authority permits the submission of the aforementioned documents in English, (the requirement to possess a CE declaration of conformity applies to each device indicated in a given lot of the procedure, except for dewars in Lot 4), 2.3. documents indicating that measures aimed at environmental protection have been undertaken, e.g. documents confirming compliance with the provisions of the RoHS Directive or the WEEE Directive (these documents may constitute the aforementioned certificate of conformity or declaration of conformity containing references to the listed directives), ISO 14001 certificate or TCO certificate or ACT Environmental Impact Factor Label, Ecolabel, Blue Angel, Energy Star or equivalent. The Contracting Authority permits the submission of the aforementioned documents in English. (It is sufficient to submit one of the listed documents for each device offered, except for dewars in Lot 4, for which the Contracting Authority does not require the submission of any documents in this respect. For Lot I – the Contracting Authority does not require the submission of the aforementioned documents if the Contractor submits together with the tender the document referred to in point 3.4 below), 2.4. For Lot 1: optionally – A sustainability certificate issued by an external body (e.g. an EGNATON certificate) for the offered device model or the product line within which the offered model is manufactured, or the manufacturer of the offered model. The overall assessment of the certified device may not be lower than 70% of the maximum score for the given certificate (in the case of certificates with a point-based assessment). The Contracting Authority permits the submission of the aforementioned document in English *criterion awarded additional points (may not be supplemented!) 2.5. documents from the manufacturer or its authorised representative in the form of catalogue sheets or printouts from websites or other documents or statements, or other equivalent documents or statements, in Polish or a foreign language together with a translation into Polish, confirming that the offered supplies (subject matter of the contract) meet the requirements specified by the Contracting Authority in the SWZ.
