The subject of the contract is the supply of steel elements for the material reserve for the reconstruction of LV poles. A detailed description of the subject of the contract is contained in Part II of the SWZ and Part IV of the SWZ. In each and every case in which the Contracting Authority describes the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Act, the Contracting Authority permits solutions equivalent to those described, provided that they make it possible to obtain characteristics or parameters no worse than those referenced. The above means that the contractor may apply the solutions described by the Contracting Authority “or equivalent”. Pursuant to Article 101(5) of the Act, a Contractor who invokes solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Authority, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104-107 of the Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree.
