Opportunity description

(I.) The subject matter of the contract is the performance of the Contract Engineer function during the implementation of the task entitled: Construction and modernisation of railway infrastructure in connection with the planned construction of an integrated transport hub in Bielsko-Biała. (II.) Procedure: 1. The contract award procedure is conducted as an open tender, in accordance with Division II, Chapter 3, Section 2 of the Public Procurement Law; 2. The tender, declarations and documents, under pain of nullity, must be prepared and submitted to the Contracting Authority in electronic form, signed with a qualified electronic signature; 3. The maximum total size of files constituting the tender or submitted with the tender is 250 MB. Communication in the procedure—other than the submission of tenders—takes place electronically via the communication forms available under the “Forms” tab (“Communication forms”) or by email. In particular, requests for clarification of the contents of the Contract Terms Specification (hereinafter: “SWZ”), the transmission of requests and notifications, and responses to transmitted requests are submitted via the “Communication forms” or by email. The communication forms enable an attachment to be added to the transmitted message (“add attachment” button). The maximum size of files transmitted via the “Communication forms” is 150 MB (this size applies to files transmitted as attachments to a single form). The minimum technical requirements concerning the equipment used to access the services of the eZamówienia Platform and information concerning connection specifications are set out in the eZamówienia Platform Regulations. In the event of technical problems and failures related to the operation of the eZamówienia Platform, users may obtain technical support by telephone at (22) 458 77 99 or electronically via the form made available on the website https://ezamowienia.gov.pl under the “Report a problem” tab; 4. To demonstrate the absence of grounds for exclusion from the procedure and confirm fulfilment of the conditions for participation in the procedure, Contractors are required to submit with the tender, in particular, the following declarations and documents: 1) the Contractor’s ESPD (for each of the Contractors jointly applying for the award of the contract); 2) Contractor’s declarations concerning the grounds for exclusion under Article 5k of Council Regulation (EU) 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine and Article 7(1) of the Act of 13.04.2022 on special measures to counteract support for aggression against Ukraine and to protect national security. Detailed requirements in this regard are set out in points 8.1–8.3 of the Instructions for Contractors (Chapter I of the SWZ). 5. Information concerning the grounds for excluding Contractors is provided in the procurement documents, including, in particular, point 7 of the Instructions for Contractors (Chapter I of the SWZ): 5.1. A Contractor with respect to whom any of the circumstances referred to in Article 108(1) of the Public Procurement Law applies shall be excluded from the contract award procedure. A Contractor shall also be excluded from the procedure on the basis of the circumstances specified in Article 7(1) of the Act of 13.04.2022 on special measures to counteract support for aggression against Ukraine and to protect national security and the circumstances specified in Article 5k of Council Regulation (EU) 833/2014 of 31.07.2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, added by Article 1(23) of Council Regulation (EU) 2022/576 of 8.04.2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, as amended by Council Regulation (EU) 2025/2033 of 23.10.2025 (mandatory grounds). 5.2. The Contracting Authority shall also exclude a Contractor with respect to whom any of the circumstances referred to in Article 109(1)(4) of the Public Procurement Law applies (optional ground). 5.3. The exclusion of a Contractor shall take place in accordance with Article 111 of the Public Procurement Law. 5.4. A Contractor subject to exclusion under Article 108(1)(1), (2) or (5), or under Article 109(1)(4) of the Public Procurement Law, may, in order to prove the absence of grounds for exclusion, take the measures specified in Article 110(2) of the Public Procurement Law. 5.5. The Contracting Authority may exclude a Contractor at any stage of the contract award procedure. 6. The tender, declarations and documents listed in point 11.4 of the Instructions for Contractors—Chapter I of the SWZ (including the Contractor’s ESPD), submitted to confirm the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure, shall be prepared in electronic form, in generally available data formats, particularly .txt, .rtf, .pdf, .doc, .docx and .odt, with the use of .pdf files being recommended. The tender, declarations and documents referred to above, under pain of nullity, must be prepared and submitted to the Contracting Authority in electronic form, signed with the qualified electronic signature of the person authorised to represent the entity issuing the document, in accordance with the form of representation specified in the register or another document applicable to the given organisational form, or by an authorised representative. 7. The Contractor shall be required to provide a performance bond in an amount equal to 5% of the offered gross price. Requirements concerning the performance bond are set out in point 22 of the Instructions for Contractors (Chapter I of the SWZ). 1. The subject matter of the contract is the performance of the Contract Engineer function during the implementation of the task entitled: Construction and modernisation of railway infrastructure in connection with the planned construction of an integrated transport hub in Bielsko-Biała. 2. The agreement with the construction works Contractor for the implementation of the above-mentioned construction and modernisation is hereinafter referred to as the “CONTRACT”. 3. The subject matter of the contract includes, in particular, performing the function of investor’s supervision inspector within the meaning of Article 25 of the Construction Law, including, in particular, representing the investor at the construction site by supervising the compliance of its implementation with the design or building permit, regulations and principles of technical knowledge; checking the quality of the construction works performed and the use, in performing those works, of products in accordance with Article 10 of the Construction Law; inspecting and accepting construction works that are to be covered or that will disappear, participating in tests and technical acceptance procedures for installations, technical equipment and chimney ducts, as well as preparing for and participating in the acceptance of completed buildings and putting them into use; confirming the works actually performed and the removal of defects, as well as monitoring construction accounts and supervising the works of the CONTRACT Contractor and approving all materials, construction techniques and technologies, and workmanship quality, in accordance with the Design Documentation, Technical Specifications for the Execution and Acceptance of Construction Works and the CONTRACT, including, in particular, supervision of: - expansion of the road system; - reconstruction of the gas network; - reconstruction of railway infrastructure; - demolition and construction of buildings; - reconstruction of the stormwater drainage network; - reconstruction of the water supply network; - reconstruction of the street-lighting network; - reconstruction of the electricity network - reconstruction of the telecommunications network; - other works (as required), as well as verification of the design documentation and technical specifications for the execution and acceptance of construction works prepared under the CONTRACT in terms of their completeness, correctness and compliance with the applicable regulations, as well as compliance with the functional and utility programme constituting part of the contract terms specification prepared in the public procurement procedure for the performance of the CONTRACT, and coordination of works with network operators. 4. A detailed description of the subject matter of the contract is contained in Chapters IV–V of the Contract Terms Specification. 5. The contract, in the part covering supervision of the implementation of Scope 2 of the CONTRACT, is co-financed by the Cohesion Fund under the European Funds for Infrastructure, Climate and Environment Programme 2021 2027, under measure FENX.03.01 “Urban transport”, Priority FENX.03 “Urban transport”.
