Poland – Supervision of building work – Performance of the function of substitute investor in the implementation of the investment entitled Construction of the headquarters of the DM13-01 Medical Dispatch Centre in Kielce

Opportunity description

The subject matter of the contract is the provision of services related to the performance of the function of Substitute Investor in the implementation of the investment entitled: “Construction of the headquarters of the DM13-01 Medical Dispatch Centre in Kielce”. The scope of the investment being implemented and the quality requirements are specified in the Functional and Utility Programme and the Feasibility Study. The Substitute Investor acts in the name and on behalf of the contracting authority. As part of the activities performed, the Substitute Investor is not entitled to sign contracts on behalf of the contracting authority or incur any financial obligations towards entities involved in the implementation of the investment. A detailed description of the subject matter of the contract is provided in Annex No 1 to the SWZ. The contract may be applied for by contractors who: 1) meet the conditions for participation in the procedure concerning technical or professional capacity – this condition will be met if the contractor demonstrates that: 1. it has duly performed at least one service involving the performance of the function of substitute investor during the last 3 years before the deadline for submission of tenders, or, if the period of business activity is shorter, during that period, with a value of at least PLN 300,000 gross. Where more than one service has been performed, the contracting authority will consider the condition met if the combined value of the services amounts to at least PLN 300,000 gross. Description of the method for assessing fulfilment of this condition: Fulfilment of this condition will be assessed on the basis of the declaration submitted in the JEDZ form and a list of services performed, stating their value, subject matter, performance dates and the entities for which the services were performed, together with evidence specifying whether those services were or are being duly performed. 2. it has or will have at its disposal persons capable of performing the contract (directly performing the service involving the function of substitute investor), holding qualifications in the following specialisations: a) Supervision inspector in the structural and building specialisation (1 person) A person who: - during the last 5 years before the deadline for submission of tenders, for at least 24 months, performed the function of investor’s supervision inspector in the structural and building specialisation; - holds building qualifications to supervise construction work in the structural and building specialisation. b) Supervision inspector in the installation specialisation relating to electrical and power networks, installations and equipment (1 person) A person who: - during the last 5 years before the deadline for submission of tenders, for at least 24 months, performed the function of investor’s supervision inspector in the installation specialisation relating to electrical and power networks, installations and equipment; - holds building qualifications to supervise construction work in this specialisation. c) Supervision inspector in the installation specialisation relating to heating, ventilation, gas, water supply and sewerage networks, installations and equipment (1 person) A person who: - during the last 5 years before the deadline for submission of tenders, for at least 24 months, performed the function of investor’s supervision inspector in the installation specialisation relating to heating, ventilation, gas, water supply and sewerage networks, installations and equipment; - holds building qualifications to supervise construction work in this specialisation. d) Supervision inspector in the architectural specialisation (1 person) A person who: - during the last 5 years before the deadline for submission of tenders, for at least 6 months, performed the function of author’s supervision inspector in the architectural specialisation; - holds unrestricted building qualifications to design in the architectural specialisation. One person may hold several of the above qualifications; however, the contracting authority will consider the condition met if the contractor demonstrates that it has or will have at its disposal at least two persons possessing the qualifications and experience. The period of 24 months of experience may be demonstrated both where the function of supervision inspector was performed continuously and where it was performed cumulatively. 2) are not subject to exclusion from the procedure pursuant to: - Article 108(1) and Article 109(1)(1) of the Pzp Act. 3) are not subject to exclusion from the procedure pursuant to: - Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2025, item 514). and - Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 229, 31.7.2014, p. 1), as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 111, 8.4.2022, p. 1). The contracting authority will assess whether the contractor meets the above conditions for participation in the procedure and is not subject to exclusion in the manner described in Chapter XVI of the Specification of Contract Terms. The contracting authority requires the contractor whose tender has been deemed the most advantageous to provide a performance bond. The performance bond will amount to 5% of the gross tender price. Details are provided in Chapter XXV of the SWZ. Pursuant to Article 257 of the Pzp Act, the contracting authority provides for the possibility of cancelling the contract award procedure if the public funds that it intended to allocate to finance all or part of the contract have not been granted to it. Time limit for performance of the subject matter of the contract: from the date of conclusion of the contract, but no earlier than 01.07.2026, until 15 December 2028.
