Opportunity description

1. The subject matter of the contract is the provision of services involving the performance of multi-discipline investor supervision duties over construction works connected with a contract being implemented under the “design and build” system, the scope of which is detailed in paragraph 2. 2. The subject matter of the contract for which investor supervision will be provided includes the construction of an indoor swimming pool building and a detached gas boiler house building, together with site development and the necessary technical infrastructure (stage I), as well as the demolition of the existing indoor swimming pool building together with the construction of a car park (stage II). Place of performance of the task – Pabianice, ul. gen. Stefana Grota Roweckiego / Jana Kilińskiego (registered plots Nos 216/6, 216/7, 217, precinct P-13): a) preparation of design studies and specifications, b) execution of construction and installation works together with obtaining the necessary documents (e.g. reports, consents, permits, approvals) enabling the facility to be put into use in accordance with the applicable regulations and standards used in construction. 3. Having regard to the scope of the subject matter of the contract, the Contractor shall ensure the participation of specialist supervision inspectors holding the appropriate authorisations, in the number and for the periods necessary for the proper performance of the subject matter of the contract. 4. Supporting information concerning the construction works for which the subject matter of the contract covered by this procedure will be performed: a) The gross value of the construction and installation works (including the preparation of design studies) to which the investor supervision relates has been set at PLN 94,759,053.94 (based on the value of the most advantageous tender selected in the procedure for the execution of the construction works). b) The scope of the work to be performed by the contractor is specified in detail by: the functional and utility programme, guidelines for technical and detailed designs concerning the detailed execution, finishing and equipment of the facility, the architectural and construction designs and the site development plan (PZT), for which the Contracting Authority obtained final building permit decision No 650/2025 dated 07.11.2025. As part of performing the function of supervision inspector, the basic duties shall include in particular: a) performance of the duties assigned to Investor Supervision contained in the contract for the execution of construction works under the “design and build” system (Annex No 9 to the SWZ); b) carrying out, on behalf of the Contracting Authority, a detailed assessment and verification of the design documentation supplied by the Contractor (the technical design prepared to the level of detail of a detailed design and the technical specifications for the execution and acceptance of construction works), in particular with regard to its compliance with the Functional and Utility Programme (PFU), the architectural and construction designs and the site development plan (PZT) (for which the Contracting Authority obtained a final building permit decision), technical conditions and the applicable laws and standards, culminating in the issuance of a written opinion, comments or recommendations concerning the scope of the design documentation being accepted within 7 working days of its receipt from the Contracting Authority or the Contractor – if defects, errors or inconsistencies between the documentation and the source documents are identified, the supervision inspector shall prepare and provide the Contracting Authority with a list of comments together with technical or legal justification, and after corrections have been made by the Works Contractor, the supervision inspector shall reverify the corrected documentation within 3 working days of receiving it again; c) supervising the execution of the works and their financing in accordance with the works schedule; d) participating in construction site councils, technical and problem-solving meetings and other meetings organised by all parties to the investment process (in particular those convened at the initiative of the Contracting Authority’s representative); e) retaining documentation related to project implementation and preparing draft correspondence related to the works being carried out for administrative and inspection authorities; f) initiating or issuing opinions on proposed amendments to the contract or the execution of additional works (Article 214(1)(7) of the Public Procurement Law), including verification of the necessity of their execution and their compliance with the law, and preparation of the necessary documentation. The Contractor shall be obliged to act to the same extent where substitute solutions and materials need to be used or where defects in the design documentation are revealed. g) taking all actions enabling the proper execution of the works; h) providing technical supervision over the execution of the works in accordance with the Construction Law; i) performing coordination functions at the construction site; j) managing the team of specialist supervision inspectors k) providing ongoing consultations and professional advice to the Contracting Authority; l) timely preparation of documents necessary for settlements with the construction works contractor, including preparation of settlement documents, reports and other documents required during the execution of the works, and cooperation in this regard with the Investor, designer and construction works contractor; m) taking all necessary actions to protect the Investor’s interests; n) for a period of 1 year from the final acceptance of the construction works, supporting the Contracting Authority’s activities aimed at enforcing the Construction Works Contractor’s obligations arising from the guarantee and statutory warranty by: supporting the Contracting Authority in the process of reporting any deficiencies and defects, supervising the activities of the Construction Works Contractor aimed at remedying the reported defects, participating in the acceptance of defect-remediation works, participation in two inspe Procedure: open.
