I. Subject matter of the contract: 1. The subject matter of the contract is the purchase and delivery of neurosurgical and laryngological instruments for the Zofia of the Zamoyski Family Tarnowska Regional Hospital in Tarnobrzeg, divided into 2 packages. II. Description of the subject matter of the contract: 1. CPV code according to the Common Procurement Vocabulary: 33169000-2 – Surgical instruments 2. A detailed description of the subject matter of the contract is contained in Appendix No. 2 to the SWZ – Pricing Form. 3. Equivalent solutions and equivalence assessment criteria: 1) The Contracting Authority shall consider a solution equivalent to the specified solution if it has the same intended use and technical, quality and functional characteristics corresponding to, or better than, the technical, quality and functional characteristics indicated in the description of the subject matter of the contract, and is designated by a different trademark, patent or origin. 2) The equivalent solution must enable the objective assumed by the Contracting Authority to be achieved through performance and functional parameters affecting operational effectiveness that are the same as or better than the indicated minimum requirements. 3) The use in the description of the subject matter of the contract of names of solutions, materials and devices serves to establish the minimum performance standard and define the properties and technical requirements assumed in the technical documentation for the designed solutions. 4) The Contractor is obliged to demonstrate that the equivalent solutions offered will meet the assumed minimum requirements. 5) The absence of the term “minimum” means a requirement at the minimum level, and the Contractor may offer a solution with better parameters. 6) In order to preserve the principles of technological neutrality and competitiveness, solutions equivalent to those specified are permitted, where an equivalent solution is understood as a solution which, in terms of technology, performance and functionality, does not differ from or is better than the technology, functionality and performance detailed in the specified solution. 7) Characteristics of a solution that are exclusive to the specified solution, such as proprietary patents, proprietary technological solutions, proprietary protocols, etc., are not subject to comparison; only those characteristics that constitute the essence of the entirety of the assumed technological solutions and have a counterpart in the equivalent solution are subject to comparison. Accordingly, the Contractor may propose solutions that provide the same functionalities specified by the Contracting Authority in a manner different from that stated. 8) A very similar (comparable) utility value is understood to mean similar behavior and provision of similar functionalities under the given conditions for which these solutions are intended, with minor differences permitted that do not in any way affect the system as a whole. The equivalent solution must include documentation confirming that it meets the Contracting Authority’s functional requirements, including the results of comparisons, tests or capabilities offered by that solution in relation to the specified solution. 9) Additionally, wherever the origin (brand, trademark, manufacturer, supplier, etc.) of materials or standards, approvals, specifications and systems referred to in the Public Procurement Law has been indicated, the Contracting Authority permits the offering of the subject matter of the contract or equivalent solutions, provided that they ensure technical parameters that are the same as or better than those required by the Contracting Authority in the tender documentation. The Contracting Authority permits the offering of equivalent materials or devices. Materials or devices originating from specific manufacturers define the minimum quality parameters and utility characteristics, as well as qualitative characteristics (including: dimensions, composition, material used, color, shade, intended use of materials and devices, aesthetics, etc.) that the materials or devices offered by the Contractor must meet in order to satisfy the requirements set by the Contracting Authority. The use of example manufacturers’ names is intended solely to clarify the level of the Contracting Authority’s expectations with respect to a specific solution. The use of manufacturers’ / products’ names is solely exemplary. When indicating a specific manufacturer (supplier), a specific product or materials in the description of the subject matter of the contract, the Contracting Authority simultaneously permits equivalent products with quality parameters and utility characteristics at least at the level of the parameters of the indicated product, thereby accepting any product with the indicated or better parameters. When describing the subject matter of the contract by means of specific standards, approvals or technical specifications and reference systems, the Contracting Authority permits solutions equivalent to those described. A Contractor relying on solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies it offers meet the requirements specified by the Contracting Authority. In such a situation, the Contracting Authority requires the submission of appropriate documents substantiating these solutions. 4. The rules for carrying out the delivery in question are specified in the “Draft Agreement” constituting Appendix No. 8 to the SWZ. 1. Package No. 1 - Set of instruments for neurosurgical operations 2. A detailed description of the subject matter of the contract is contained in Appendix No. 2 to the SWZ – Pricing Form. 3. The medical devices constituting the subject matter of this agreement must comply with the requirements of the current legal framework, particularly those introduced by the Act of 7 April 2022 on Medical Devices (Journal of Laws of 2024, item 1620, as amended). 4. The rules for carrying out the contract in question are specified in the “Draft Agreement” constituting Appendix No. 8 to the SWZ. 1. Package No. 2 – Set of laryngological instruments 2.
