1. The subject of the contract is the successive supply by the Contractor to the Contracting Authority of suture materials (hereinafter referred to as the goods), of the types and in the quantities specified in the price form constituting Appendix No. 2 to the SWZ and in accordance with the draft contractual provisions constituting Appendix No. 4 to this SWZ. 2. Detailed description of the subject of the contract by task: Task No. 1: Supply of non-absorbable, synthetic, polypropylene or polypropylene with added polyethylene, monofilament surgical sutures Task No. 2: Supply of sterile single-use instruments for skin closure Task No. 3: Supply of non-absorbable, synthetic, monofilament surgical sutures made of polypropylene Task No. 4: Supply of non-absorbable synthetic polyester sutures Task No. 5: Supplies of non-absorbable monofilament surgical sutures made of polypropylene (PP) Task No. 6: Supply of multifilament metal surgical sutures Task No. 7: Supply of synthetic, braided, coated surgical sutures absorbable within 56-90 days Task No. 8: Supply of autopsy sutures Task No. 9: Supplies of automatic sutures in accordance with the detailed description of the subject of the contract contained in the Price Form constituting Appendix No. 2 to the SWZ. The Contractor may submit a tender for one, several or all lots. During the examination and evaluation of tenders, the Contracting Authority will consider each task separately. 3. Surgical suture materials offered under a given task should be products from the same manufacturer (in accordance with the price form). 4. The Contractor guarantees that the suture materials offered will have the following characteristics: 1) needle: sharp, resistant to bending and breaking, stable in the needle holder; 2) thread: maintaining the durability of the first knot, resistant to breaking (of the thread and knot), having low shape memory after removal from the sachet, with a coating facilitating knot advancement, not fraying after cutting; 3) needle and thread: the step, i.e. the difference in thickness between the thread and the needle, not causing tissue trauma. 5. In the absence of demand for the assortment covered by the subject of the contract, the Contracting Authority reserves the right not to order part of the assortment specified in Appendix No. 2 to the SWZ, subject to paragraph 4. The Contractor shall not be entitled on this account to any claims for damages or claims based on any other legal basis, to which the Contractor agrees. 6. The Contracting Authority guarantees that the minimum value of supplies during the term of the contract within the basic scope will amount to 60% of the maximum value of the contract within the basic scope specified in § 5 of Appendix No. 4 to the SWZ for the given task. – the underlined provision applies to task No. 9 The Contracting Authority specified in Appendix No. 2 to the SWZ quality requirements relating at least to the main elements comprising the subject of the contract. The Contractor should offer and price all assortment items listed in the price form. The Contractor is required to provide in Appendix No. 2 to the SWZ the manufacturer's name and the trade name or catalogue number. The Contractor should offer a subject of the contract compliant with the parameters specified by the Contracting Authority. Wherever the Contracting Authority has not explicitly specified a dimension or another parameter, this is at the Contractor's discretion. Where references have been made in the description of the subject of the contract to standards, technical assessments, technical specifications and reference systems referred to in Art. 101(1)(2) and paragraph 3 of the p.z.p. Act, the Contracting Authority, pursuant to Art. 101(4) of the p.z.p. Act, permits the use of solutions equivalent to those described. Whenever a standard, technical assessment, technical specification or technical reference system is indicated in this SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation to them. Where the Contracting Authority indicates in the description of the subject of the contract a trademark, patent or origin, source or particular process that characterises the products – it shall be assumed that the indicated trademarks, patents, origin, etc. define the minimum parameters indicated in Appendix No. 2 to the SWZ, which constitute the criteria used to assess equivalence. Whenever a trademark, patent or origin, source or particular process that characterises the products is indicated in this SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation to them (legal basis: Art. 99(5) and (6) of the p.z.p. Act). The Contracting Authority informs that, in this procedure conducted under the open procedure, it provides for the possibility of applying the procedure referred to in Art. 139(1) of the p.z.p. Act. When applying the aforementioned procedure, the Contracting Authority will first examine and evaluate the tenders and then perform the eligibility assessment of the Contractor whose tender was rated highest with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. The subject of the contract is the successive supply by the Contractor to the Contracting Authority of non-absorbable synthetic polyester sutures (hereinafter referred to as the goods), of the types and in the quantities specified in the price form constituting Appendix No. 2 to the SWZ and in accordance with the draft contractual provisions constituting Appendix No. 4 to this SWZ.
