Description: A detailed description of the subject matter of the contract referred to in point 3.1 is provided in Annex No. 1 to the SWZ – Description of the subject matter of the contract (OPZ), Annex No. 2 – Tender Form, Annex No. 3 to the SWZ – Pricing Form, and Annex No. 12 to the SWZ – Draft Contract. I. The procedure is conducted as an unrestricted tender. II. Open procedure. III. Market consultations were not conducted. IV. Information on reserving the possibility of applying for the award of the contract exclusively to Contractors referred to in Article 94 of the Pzp Act. The Contracting Authority does not provide for any reservation in this regard. V. Pursuant to Article 139(1) of the Act, the Contracting Authority reserves the right first to evaluate the tenders and then to examine whether the Contractor whose tender was evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. VI. The Contracting Authority does not provide for settlement in foreign currencies. VII. Pursuant to Article 139(1) of the Act, the Contracting Authority reserves the right first to evaluate the tenders and then to examine whether the Contractor whose tender was evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. VIII. The Contracting Authority does not permit the submission of partial tenders in this procedure. The possibility of submitting partial tenders was not permitted in this procedure due to technical, functional and economic considerations. The contract has not been divided into parts because of the need to ensure consistency in contract performance, internal coordination, as well as the need to ensure the Contractor’s unambiguous responsibility toward the Contracting Authority for the performance of specified comprehensive processes, which results from the Contracting Authority’s justified and objective needs. Fragmentation of the task would have negative consequences for its performance. The absence of a division of the task into parts does not hinder access to the contract for the small and medium-sized enterprise sector. IX. The Contracting Authority does not permit the submission of equivalent tenders. X. The Contracting Authority does not provide for contracts referred to in Article 214(1)(8) of the Act. XI. The Contracting Authority does not provide for an electronic auction. XII. The Contracting Authority states that, before the opening of tenders, pursuant to Article 222(4) of the Pzp Act, it will disclose the amount it intends to allocate for performance of the contract, for the purpose of verifying whether the grounds for cancellation of the procedure referred to in Article 255(3) of the Pzp Act have materialized. XIII. Pursuant to Article 257(1) of the Pzp Act, the Contracting Authority provides for the possibility of cancelling this procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. XIV. Information concerning a site visit: The Contracting Authority does not provide for the possibility of the Contractor conducting a site visit; the contract does not require a site visit. XV. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key tasks. The Contracting Authority permits permits the participation of Subcontractors in the performance of this contract. 1) The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to Subcontractors and to provide the names of the Subcontractors pursuant to Article 462(2) of the Act (if already known). 2) If a change or withdrawal of a Subcontractor concerns an entity whose resources the Contractor relied upon, under the rules set out in Article 118(1), to demonstrate compliance with the conditions for participation in the procedure, the contractor is required to demonstrate to the contracting authority that the proposed other Subcontractor or the Contractor itself meets those conditions to a degree no less than the subcontractor whose resources the Contractor relied upon during the contract award procedure. Article 122 of the Act shall apply accordingly. NOTE: pursuant to Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU L 229, 2014, p. 1, as amended), it is prohibited to entrust parts of the contract to subcontractors (including service and supply subcontractors) in respect of whom the grounds referred to in Article Article 5k(1)(a)–(c) apply, where they account for more than 10% of the contract value. XVI. Employment requirements based on an employment relationship in the circumstances referred to in Article 95 of the Pzp Act. The Contracting Authority does not provide for requirements in this regard. XVII. Requirements concerning the employment of persons referred to in Article 96(2)(2) of the Pzp Act. The Contracting Authority does not provide for requirements in this regard. XVIII. Information on reserving the possibility of applying for the award of the contract exclusively to Contractors referred to in Article 94 of the Pzp Act. The Contracting Authority does not provide for any reservation in this regard.
