The subject of the contract is the service entitled: “Annual building inspections and periodic inspections of hydrotechnical structures within the area of the Elbląg Catchment Management Authority, divided into lots”. 2. The Contracting Authority permits the submission of tenders for individual lots. 2.1 The contract consists of the following lots: 1) Contract lot No 1: Annual and five-year inspections of hydrotechnical buildings and structures within the operational area of NW Elbląg; 2) Contract lot No 2: Annual and five-year inspections of hydrotechnical buildings and structures within the operational area of NW Elbląg – assessments of the technical condition of flood embankments; 3) Contract lot No 3: Annual and five-year inspections of hydrotechnical buildings and structures within the operational areas of NW Braniewo, NW Orneta, NW Olsztynek and OH Buczyniec; 4) Contract lot No 4: Annual and five-year inspections of hydrotechnical buildings and structures within the operational area of NW Braniewo – assessments of the technical condition of flood embankments; 5) Contract lot No 5: Annual and five-year inspections of hydrotechnical buildings and structures within the operational areas of NW Nowy Dwór Gdański and NW Malbork – assessments of the technical condition of flood embankments; 6) Contract lot No 6: Annual and five-year inspections of hydrotechnical buildings and structures within the operational areas of NW Nowy Dwór Gdański and ZPH MEW i KN – storm gates on the Tuga River, water stages of the Nogat Cascade: Szonowo, Rakowiec, Michałowo; 7) Contract lot No 7: Annual and five-year inspections of hydrotechnical buildings and structures within the operational area of ZHP pumping stations. The detailed description of the subject of the contract and the contract performance conditions for each contract lot are specified by: - Description of the subject of the contract for each contract lot (OPZ) – Appendix No 1 to the SWZ, - Draft contractual provisions (PPU) – Appendix No 8 to the SWZ. 2.2 The Contracting Authority does not permit the contract to be divided within the individual lots. 2.3 The Contracting Authority awards the service contract in lots, each of which constitutes the subject of a separate procedure, and this contract is one of those separated lots. 2.4 The Contractor may submit a tender for one or more contract lots. 2.5 The Contracting Authority does not permit the submission of variant tenders. 2.6. The Contracting Authority does not envisage the possibility of awarding contracts referred to in Article 214(1)(7) of the PZP. 3. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. The Contracting Authority permits the participation of subcontractors in the performance of the contract. If subcontractors participate in the performance of the contract, the Contracting Authority, pursuant to Article 462(2) of the Pzp Act, requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and to provide the company names of the subcontractors, if already known. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract. 4. The Contracting Authority does not envisage the possibility of exercising the option right referred to in Article 441 of the PZP. 5. Pursuant to Article 95(1) of the Act, the Contracting Authority does not specify activities related to the performance of the contract to which requirements apply concerning the employment, by the Contractor or subcontractor, under an employment relationship of persons performing activities during the performance of the contract. The Contracting Authority does not impose requirements concerning the Contractor’s employment of persons referred to in Article 96(2)(2) of the PZP. 6. The Contracting Authority does not envisage a requirement for the Contractor to conduct a site visit or for the Contractor to inspect documents necessary for the performance of the contract that are available on the Contracting Authority’s premises. 7. The Contracting Authority states that the estimated net value of this contract is PLN 235 822,27, including: 1) Lot 1 – PLN 11 972,07, 2) Lot 2 – PLN 65 246,06, 3) Lot 3 – PLN 15 286,32, 4) Lot 4 – PLN 7 827,25, 5) Lot 5 – PLN 19 538,44, 6) Lot 6 – PLN 3 418,80, 7) Lot 7 – PLN 112 533,33. 8. The Contracting Authority does not require a tender security to be provided in this procedure. The Contracting Authority does not require a performance bond to be provided in this procedure. 9. All costs associated with participation in the procedure, in particular with preparing and submitting the tender, shall be borne by the Contractor submitting the tender. The Contracting Authority does not envisage reimbursing the costs of participation in the procedure. 10. Procedure plan No in the BZP: 2026/BZP 00116193/12/P; plan item: 2.3.327. 11. The Contracting Authority reserves the right to cancel this procedure pursuant to Article 257 of the Pzp Act if the funds that it intended to allocate to performance of the contract are not granted to it in whole or in part. The Contracting Authority is entitled to cancel the procedure on the aforementioned grounds at any stage thereof and in alteration to selected contract lots. The Contracting Authority retains the right to cancel the procedure on the aforementioned grounds both when it receives unambiguous information that funds for performance of the contract will not be granted to it and when there is a delay in obtaining them relative to the anticipated deadline for completing the task, if the lack of funds by the deadline makes performance of the contract impossible. The Contractor is not entitled to make a demand of the Contracting Authority to take measures aimed at obtaining funds allocated for performance of the contract if those funds are not granted to it from the anticipated source. If the procedure is cancelled pursuant to Article 257 of the Pzp Act, Contractors shall not be entitled to claim reimbursement of any costs of participation in the procedure, including in particular reimbursement of the costs of conducting a site visit and the costs of calculating and preparing the tender, which – by the fact of participating in the procedure under the rules set out in this documentation – the Contractors accept without reservation. 12.
