Opportunity description
The subject matter of this procurement is the performance of Contract 1 under the “build” formula, i.e. the comprehensive execution of drilling and geological works (drilling, casing, cementing, completion) for the Kutno GT-1 and Kutno GT-2 boreholes on the basis of the Geological Works Designs (PRG) and the Technical Specifications for the Execution and Acceptance of Construction Works (STWiORB) provided by the Contracting Authority, as well as the preparation of an Operating Plan for the Establishment Performing Geological Works, the mobilisation and demobilisation of the drilling rig together with the accompanying infrastructure, the performance of hydrogeological tests, as well as the complete demobilisation of the base and drilling site and the final reclamation of the site after completion of the works. The subject matter of the procurement has been divided into the Guaranteed Scope and the Optional Scope and will be implemented in stages, in accordance with the material and technological breakdown specified in detail in point 1.1 of the STWiORB and in § 1(5) of the Draft Proposed Contractual Provisions (PPU – Part II of the SWZ). The Guaranteed Scope comprises the comprehensive execution of drilling and geological works for the Kutno GT-1 borehole and the Kutno GT-2 borehole using the design variant providing for the diameter of the casing and filter pipe strings under Variant II, specified in the PRG for drilling the Kutno GT-2 borehole, in accordance with the provisions of the Geological Works Designs (PRG), the STWiORB and the Material and Financial Schedule (HRF). Stage I of the Guaranteed Scope also includes the construction and installation of a discharge tank for thermal water, in accordance with the valuation included in the Tender Form. The Optional Scope, in turn, is the Contracting Authority’s unilateral right (option right), provided for pursuant to Article 441 of the Public Procurement Law, to decide to change the design of the Kutno GT-2 borehole, consisting of the unconditional abandonment of Variant II described in the PRG and provided for under the Guaranteed Scope and the implementation in its place of Variant I of the Kutno GT-2 borehole design, described in the PRG, resulting in a corresponding change to the Contractor’s remuneration according to the balancing (differential) principles specified in the Contract. The right to activate the Optional Scope may be exercised by the Contracting Authority during the performance of the Contract, within the time limits specified in the Contract. The Contracting Authority also reserves the right to unilaterally limit the Subject Matter of the Contract (including abandoning the Kutno GT-2 borehole or individual optional/conditional tests, measurements and works) in accordance with the principles specified in § 16a of the PPU, resulting in a corresponding reduction of the Contractor’s remuneration solely to the value of the works actually and duly performed.
