Opportunity description
The subject of the contract is: Successive supplies of colorants for printing devices. A detailed description of the subject of the contract, i.e. the characteristics, requirements and quantity of the specified type of assortment, is contained in the annexes: Annex No. 1 to the tender form, Annex No. 6 to the SWZ (description of the subject of the contract - OPZ) and Annex No. 2 to the SWZ (draft contractual provisions - PPU). The Contracting Authority declares that it will order materials for printing devices covered by the contract with a minimum value of 50 % of the gross value of the subject of the contract. The Contracting Authority envisages applying the procedure referred to in Art. 139 of the Pzp Act, the so-called “reverse procedure”, i.e. the Contracting Authority may first examine and evaluate the tenders and then carry out the subjective qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion. The GDPR information clause is contained in Chapter II of the SWZ. The Contractor will be bound by the tender until: 27.09.2026. The Contracting Authority does not envisage an option right. The Contracting Authority does not permit the submission of variant tenders or tenders in the form of electronic catalogues. The Contracting Authority does not envisage awarding contracts referred to in Art. 214 sec. 1 item 8 of the Pzp Act. The Contracting Authority does not envisage that the selection of the most advantageous tender will be preceded by an electronic auction (Art. 308 sec. 1 of the Pzp Act). The Contracting Authority does not reserve the possibility of applying for the award of the contract exclusively to Contractors referred to in Art. 94 of the Pzp Act. The Contracting Authority does not specify requirements regarding the employment of persons referred to in Art. 96 sec. 2 item 2 of the Pzp Act. The procedure is not being conducted for the purpose of concluding a framework agreement. The Contracting Authority does not envisage a site visit or inspection of the documents referred to in Art. 131 sec. 2 of the Pzp Act. The Contracting Authority does not envisage reimbursement of the costs of participation in the procedure. The Contracting Authority does not envisage granting advance payments toward performance of the contract. With regard to the condition specified in Art. 100 sec. 1 of the Pzp Act concerning accessibility for persons with disabilities, referred to in Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement (OJ EU L 94/65 of 28 March 2014), the Contracting Authority states that there are no specific requirements regarding the accessibility of the described subject of the contract for persons with disabilities. Requirements regarding employment on the basis of an employment relationship (Art. 95 of the Pzp Act). The activities associated with performance of the contract do not consist of performing work in the manner specified in Art. 22 § 1 of the Act of 26 June 1974, the Labour Code (consolidated text: Journal of Laws of 2025, items 277, 807, 1423, 1661, and of 2026, item 25). Pursuant to Art. 310 of the Pzp Act, the Contracting Authority envisages the possibility of cancelling the contract award procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. Part 1: covers the supply of colorants for printing devices in the quantities and with the minimum parameters specified in Annex No. 1 to the tender form (Annex No. 1 to the SWZ) and in Annex No. 1 to the Draft contractual provisions for Part 1 of the procedure. Performance period - 12 months from the date of conclusion of the contract, with the proviso that if the financial resources allocated for its performance, i.e. the gross value of the subject of the contract referred to in § 3 sec. 1 of the PPU, are exhausted before the expiry of that period, the contract shall be automatically terminated on the date those funds are exhausted. The contract shall also remain in force during the warranty period granted by the Contractor. Supplies will be made successively, on the basis of individual orders (Delivery Orders) placed by the Contracting Authority. 1) The subject of the contract is the supply of consumables for printing devices recommended by the device manufacturer. 2) The consumables must be recognisable by the printing devices and must not cause negative messages to appear on the device display or test pages, must be compatible with the equipment for which they were ordered, must not cause limitations to the functions and capabilities of the equipment, and must ensure full compatibility with the device software. 3) During the use of the supplied equivalent materials, no message other than one that would appear if a functional, original consumable were installed may appear in the device monitoring and management software and/or on the device in which the given consumable is installed. 4) All offered materials intended for a given device model must come from the same material manufacturer. 5) The Contracting Authority does not permit the offering of starter products. 6) In the case of consumables on which the manufacturer has placed a region code, the Contracting Authority expects the supply of materials conforming to the region code designated for Poland. 7) With reference to Art. 101 sec. 4 of the Pzp Act, if the Contracting Authority has described the subject of the contract by reference to standards, European technical assessments, technical specifications and technical reference systems referred to in Art. 101 sec. 1 item 2 and sec. 3 of the Pzp Act, the Contracting Authority permits solutions equivalent to those described. Furthermore, it must be assumed that all such references are accompanied by the words “or equivalent”. 8) By an original product, the Contracting Authority means a product offered by the manufacturer of the printing devices. 9) By an equivalent product, the Contracting Authority means a product: • compatible with the device for which it was ordered, • with parameters the same as or better than (toner yield, print quality) the original manufactured by the device manufacturer; the number of copies obtained/capacity may not be lower than when using originals; • where the original product has a built-in integrated circuit that monitors the printing process and ink/toner consumption, the equivalent product should have an analogous component. The Contracting Authority will consider a product equivalent when the Contractor proves that the equivalent product offered has the same or better toner/ink capacity and yield compared with the original product manufactured by the device manufacturer. If equivalent products are offered, documents containing information on capacity and yield parameters that are the same as or better than those of the original manufactured by the device manufacturer or under its licence must be submitted with the tender in order to demonstrate their equivalence. The products offered should be factory-new products. 10) By “factory-new”, the Contracting Authority means products: a) made from new components; b) not remanufactured, i.e. all product components must be factory-new; c) without signs of damage; d) in the manufacturer’s original packaging with a visible logo, product symbol and expiry date; e) bearing an individual toner code (type, model) on the packaging together with the name of the device for which they are intended. White packaging without the manufacturer’s logo, markings in the form of a sticker, or products in packaging not originating from the manufacturer indicated in the tender are not permitted; f) bearing on the product an individual manufacturer’s code enabling unambiguous identification and all safeguards used by the manufacturer, e.g. holograms or identification stickers; g) no component of the product comes from a recycling process; h) having all safeguards ensuring the tightness of toner containers; i) have not undergone a refilling process; j) do not cause damage to the devices in which they will be used; k) do not cause loss of the device manufacturer’s warranty or the loss by the Contracting Authority of rights arising from service warranties; l) do not cause limitations to the functions and capabilities of the devices or to the print quality specified in the device manufacturer’s technical conditions.
