Opportunity description

1. The subject matter of the contract is: Maintenance and upkeep of traffic signals on the provincial roads of the Mazowieckie Voivodeship in the years 2027–2029 – procedure no. 142/26 2. A detailed description of the subject matter of the Contract is provided in Part IV of the SWZ – Description of the Subject Matter of the Contract (OPZ – Part IV of the SWZ) and in the tender cost estimate (Part V of the SWZ). 3. For the purpose of comparing tenders, the Contracting Authority included 186 traffic-signal points for maintenance and upkeep in the tender cost estimate. 4. During the term of the Agreement, the Contracting Authority anticipates changes in the number of traffic-signal installations covered by maintenance (both decreases and increases). The Contractor shall take over the maintenance of new traffic-signal installations from the date specified by the Contracting Authority. 5. Performing work within the road right-of-way requiring changes to traffic organization is possible on the basis of the provided simplified traffic-organization and work-site protection diagrams for the duration of work related to the ongoing maintenance of provincial roads (…) – Annex No. 2 to the OPZ. Due to their validity period, the aforementioned diagrams shall be provided to the Contractor by the Contracting Authority, together with their current approval, in each year of the agreement. However, the Contracting Authority stipulates that the specific nature of the Contract may require the preparation of a traffic-organization design whose scope will be broader than the typical diagrams presented in the aforementioned annex to the OPZ. To the extent not provided for in the aforementioned annex, the Contractor shall, at its own expense, prepare, agree upon and obtain approval of the traffic-organization design and update it as needed throughout the entire period of performance of the Agreement. The possibility and timing of changing the traffic organization on the basis of the traffic-organization design must each time be agreed with the competent representative of the Road District, with whom a protocol on the implementation of the change must be drawn up. 6. The Contracting Authority does not permit the submission of partial tenders. The Contracting Authority has not divided the contract into lots because the subject matter of the contract covers a comprehensive service for the maintenance and upkeep of traffic signals located on the provincial roads of the Mazowieckie Voivodeship. The service requires a uniform method of organization, coordination and management. All devices covered by the contract constitute elements of a single road-traffic safety system, and their proper functioning has a direct impact on the safety of road users and the smooth flow of traffic. 7. The Contracting Authority anticipates awarding contracts referred to in Article 214(1)(7) of the PZP Act with a total net value of: PLN 1,707,660.38. Under the similar contract, it is anticipated that services related to the upkeep or maintenance of traffic signals on the roads of the Mazowieckie Voivodeship will be performed. 8. The Contractor should have liability insurance (OC) for damage caused during the performance of the agreement to the subject matter of the agreement and to third parties, for the entire term of the agreement and with a guaranteed sum of no less than PLN 500,000.00 gross. The Contractor is obliged to provide the Contracting Authority with a copy of a current and paid-up policy within 14 days from the date of conclusion of the agreement. Subject to maintaining continuity of insurance, the Contracting Authority permits the presentation, during the term of the agreement, of several policies confirming possession of liability insurance (OC) jointly covering the entire period of performance of the agreement. The Contractor is obliged to provide the Contracting Authority with a copy of the next current and paid-up policy within 7 days after the expiry date of the previous policy. If the Contractor fails to comply with the above obligation, the Contracting Authority shall charge the Contractor contractual penalties for delay in the amount specified in the agreement. If a copy of a current and paid-up liability insurance (OC) policy is not submitted within 14 days from the date of conclusion of the agreement, the Contracting Authority shall have the right to withdraw from the agreement for reasons attributable to the Contractor. 9. Contract performance period: 3 years from 01.01.2027. 8. The Contractor whose tender has been selected as the most advantageous shall provide a performance bond amounting to 5% of the total price stated in the tender. The requirements concerning the performance bond are described in Chapter XX of Part I of the SWZ. 9. The Contracting Authority anticipates applying the so-called reversed procedure referred to in Article 139(1) of the PZP Act, i.e. the Contracting Authority shall first examine and evaluate the tenders and then assess the eligibility of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 10. Pursuant to Article 257 of the PZP Act, the Contracting Authority anticipates the possibility of cancelling this procedure if the public funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 11. Where trademarks, patents or origin, source or a specific process characterizing the product or services supplied by a particular contractor are indicated in the description of the subject matter of the contract, the Contracting Authority permits equivalent solutions. Where the description of the subject matter of the contract refers to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority permits solutions equivalent to those described.
